PERRY states BOGGS-PEREZ was at home and had not left since he had spoken with her just moments earlier. PERRY then knocked several times and was also met with no answer. ! eft a Converse Police Department business card at the door requesting the resident call me regarding the ddog and as of the time ofthis report (11:23) | have yet to receive a phone call from the resident. | also left a voicemail for BOGGS-PEREZ eI et approximately 10:52 hours. BOGGS-PEREZ stales she placed @ “found publication on the NEXTDOOR app along with three (3) photos of the dog and received no responses, BOGGS-PEREZ further states she took the dog to receive medical treatment at Banfield ‘Animal Hospital and algo purchased a crate. Total expenditures by her estimation is $425,00-$450.00. | ‘asked BOGGS-PEREZ if PERRY would pay her the $425.00-$450.00 if she would return the dog but she refused to answer the question and staled she now considers herself the owner of the dog and ‘would be more than happy to take this issue to the Bexar County Dispute Resolution Center where she {is @ mediator. | informed her | would call PERRY and inform him of my conversation with BOGGS- PEREZ and will also provide him the contact information for the resolution center. Avllez #455 (On 05/30/2017 at approximately 00:48 hours, while assigned to telecommunications, | was contacted at the Converse Police Department located at 402 S. Seguin fora follow-up in reference to this case. I met with the complainant, Perry, Patrick Bit Perry stated that he has made several reports in reference to his neighbor, Boggs-Perez. Lynette £/F SEINE not returing his female dog, a mix between a Maltese and a Yorkie that he paid $800.00 for. Perry's cog got out of Pery’s yard, SHEENMRINEENNR, on 05/06/2017, Perry stated that his pet dog had not been chipped, but has a distinctive sear on the chest from being bitten by a Pitbull. The dog that Boggs-Perez has does have that same scar, but she attempted to change the dog's appearance by shaving it's fur. Perry stated that Boggs-Perez has been deceptive inthe information she provided to officers, and she always knew thatthe dog was not a stray and was, informed by other neighbors that the dog was his Perry stated that he has made numerous attempts and contacted Boggs-Perez to get his pet back, and Boggs-Perez will not retum it. Pery does want to pursue charges for the then. After conferring with Sgt. Martinez #435 about this case, he advised me to handle it as a theft and refer ito Investigations for review. Perry signed a prosecution form. Perry also completed an incident information form (writen statement). All the paperwork is attached to this report. Perry stated that he would bring in receipts showing what he paid for the dog. ‘After obtaining the information for the report, I returned to my telecommunication duties. "Nothing further. J sror7es Supplement ‘Kilwy #427 (On 06-31-17 | was asked to follow up with this case. | spoke to the complainant (Perry), and was provided with several pictures of the dog, and paperwork that he has in reference tothe dog. This ‘paperwork has been attached to this report. Perry advised that the dog, had escaped from a neighbor that was watching the dog around 05-06-17. He advised that they looked forthe dog for several days, He explained that he had put up fers around the neighborhood. He was informed by a neighbor that the dog was picked up by the resident of EENMEINBEER (wo house down from him). He made contact with the resident (Boggs-Perez). She informed him that she had picked up the dog, and spent money ‘on the dog: He was advised that she wasn't going to give the dog back, because she feels the dog is hhers now, and they could go tothe Bexar County resolution center. {informed Perry that | would follow up with Boggs-Perez. (0n 05-31-17 attempled o conlact her by phone, but the number wasnit good. I went othe residence later that afternoon, but met with @ negative response, My business card was lef onthe door. ‘On 06-01-17 | again attempted to go to her house the folowing day. | noticed my card was ‘missing from the door. | again met wih a negative response. 1 was later able to contact her husband, and informed him to have her contact me in reference fo this case. She has not yel contacted me back. ‘On 08-08-17 Boggs-Perez returned my phone call. She informed me thatthe issue over the {dog is a civil matter, and that she doesn't need to speak to me. | then spoke to Perry, and asked that he send a cerlifed letter to Bogs-Perez requesting his dog back. (On 06-10-17 Perry provided me with a copy of the leter that was sent to her. (On 08-23-17 I wrote a search warrant for the dog. (On 06-27 -17 | went to the San Antonio Magistrates office, and presented the search warrant to the Judge. He signed the warrant, and! returned tothe city. Later Myself, Sgt Bocconcelli, and Officer Morris went {oMNNSNINNIREIEB to execute the search warrant. { knocked on the door, and no one answered. | knocked a second time, and again no one answered. | knocked a third time, and the door ‘opened. | knocked again, anc with the door partially open, | announced Converse Police with no response. | knocked again, and the opened a litle further. A the door opened, | observed two females by the kitchen. One of them was Boggs-Perez. Boggs-Perez answered when she saw me, ‘and | asked if | could speak to her. At this point a dog ran outside of the house. The dog greeted Sot Bocconcell, then ran into the front yard. Boggs-Perez came to the door, and | introduced myself. | informed her | had a search warrant for the dog, and hanged her a copy of the warrant. She read the warrant. We asked Boggs-Perez if that was the dog in question, and she advised that she was reading the warrant. Boggs Perez made no attempt to stop the dog from leaving the house, nor did she make an attempt to recover the dog. She informed me that the dog she had had a diferent name. 1 informed her that the name of the dog was relevant. She began to inform me that when she had found the dog ‘she had put an ad on the Next Door App. | informed her that not everyone has that app. She then Monday, Oc 22017 160s MCKENZIE, Page 8 of 10 (cate No: 1701785 ‘advised that Pery failed to provide her with any proof that the dog was his. During this conversation she referred to the dog as hers, and advised that she had registered the dog as hers after finding it ‘She then informed me that our city code would require that the dog be euthanized due to the fact that the dog was found injured. | informed her that the ordinance is notin dispute only the ownership of the dog was. She again advised that she was never shown ownership of the dog. She further advised that her lawyer served him papers for Perry to show ownership of the dog. She advised that there were no pictures of the dog, and thatthe pictures he had did not look lke the same dog. She further stated that we couldn't prove that the pictures he had were not hers just photo shopped. 1 informed her that | ‘would return after speaking to Perry. After the dog had run into the front it appeared that it was searching. twas running eround with i's nose to the ground. It ran to the yards to the east of {WEEEME. St Bocconceli attempted to call the dog, butit ran past him, itthen ran back past this residence, and again began searching for a scent. It went across the street, and then ran straight for EEE (Pers residence), I then went to speak to Perry. Perry informed me that the dog an straight to him. | searched the dog for any scars thet were related tothe injury that happened to the dog prior to it running of Perry informed me that he stil had the hair that he had cut off ofthe dog while he was dressing the injury. He provided me wih the halt, end it was later placed into propery. With the fact thatthe dog {ound Perry's house, and the hair that Perry stil had, I believe thatthe dog isin fact Pery's. Officer ‘Mortis retrieved my camera, and took photos ofthe dog. While speaking to Perry, he informed me ‘that this was all about getting his dog back. Perry informed me that he no longer wanted to prosecute ‘Officer Mortis provided me with @ non prosecution form, and Perry signed it. lef the dog with Pemy, ‘and I retuned to Boggs-Perez. | spoke to Boggs-Perez, and her husband. | informed them that they could fle 2 chil suit ‘against Pery for restitution for any costs that they had paid to treat the dog. She advised that if she ‘decides to get reimbursed she would flea civil sut against Perry. She began to tell me how they had a dale sel with the Bexar County Resolution Center on the June 19th, and he canceled it. She also ‘stated that she does not believe that this dog is Perry's based on the fact that the dog was injured and ‘appeared to have been on the street longer han his dog was missing. Boggs-Perez’s husband advised that they just rescued the dog, and that Boggs-Perez was adamant about finding the owner of the dog. They advised that they had the dog for two weeks before Perry came to them. | informed them that Perry did not know they had the dog untl that time. They continued to explain their situation ‘about someone showing them proof of ownership of the dog. | again informed them of the civil process they ean fie if they want to, and I departed. The thank you card and the giftcard were from Perry, Patrick (6/M DOR. Later informed Captain Hunt ofthis and she advised me that the gif card would be retumed to Perry and to inform Lt.
