4@ @ ALJABER aa ee eae eel TEKFEN CONSTRUCTION ALTHUMAMA STADIUM | _ALJABER-TEKFEN JOINT VENTURE ‘CONFIDENTIALITY STATEMENT | (we) the undersigned have been invited to engage in the tender process for certain works by Al Jaber Engineering LLC and Tekfen Construction and Installation Co Inc. acting as a “IV” for the MAIN. ‘WORKS FOR THE FIFTH PRECINCT STADIUM, (hereinafter referred to as the “Project”). | (we) hereby declare to be bound by, and to comply with the same terms and conditions and restrictions of the confidentiality provisions contained of the Main Contract, and committed to by the JV towards the Supreme Committee, and that | (we) are obliged to the same extent that the JV is obligated thereunder. Thereby undertake that any officers, directors, employees, agents or representatives of the ‘undersigned shall not; (i) without the prior written consent permit or authorize the making of any reference to or disclosure of information relating to the Works, the Contract, FIFA or to SC, its Affiliates, or any of their business activities, marketing or other plans in any media including , leaflets, brochures, publications, journals, articles, newspapers, radio, television or the internet. The Contractor and its Sub-Contractors and Suppliers shall refer to SC any enquiries conceming the Contract or the Works from any media. (i) reveal to any persan other than an authorized recipient the fact that discussions are taking place between the Parties nor any information concerning the status or progress Of such discussions or negotiations or the Services; (il) use SCs Confidential Information for any purpose other than the permitted purpose; in particular, not use SC’s Confidential Information in its trading operations, to gain a ‘commercial or other advantage, or for any marketing or advertising purpose; or (iv) make any media releases, announcements, public statements or other public disclosures to any third parties relating to SC, the Competitions or this Agreement (which shall include promotional or marketing materials). If any breach of this Confidentiality Agreement is made by or any of the undersigned’s representatives, then this will result in the immediate termination and withdrawal of the invitation to Tender and possible imposition of penalties at the discretion of the Supreme Committee i accordance with the Applicable Law. | take personal responsibility for any said breach by the undersigned or any of its representatives.
