ORDINANCE 1

AN ORDINANCE AMENDING CHAPTER 351, PARKING GENERALLY, TO


ALLOW RESTRICTED OVERNIGHT PARKING AND DECLARING AN
EMERGENCY.

WHEREAS, the Council of the City of Chardon recognizes that private overnight
parking is not available for residents who live on Main Street; and

WHEREAS, §351.14 C.O. prohibits overnight parking on city streets; and

WHEREAS, §351.16(c) prohibits overnight parking in municipal parking lots; and

WHEREAS, the Council desires to provide limited overnight parking for the Main
Street residents.

NOW, THEREFORE, Chapter 351, Parking Generally, is amended as follows:

SECTION 1. Section 351.14, Overnight Parking Prohibited, is hereby amended in


its entirety to read as follows:

Section 351.04 Overnight Parking Prohibited; Exceptions. No person shall


park a vehicle on any street within the Municipality between the hours of
12:00 midnight and 6:00 a.m. on any day, except emergency vehicles,
physicians on emergency calls and as permitted in §§351.16 and 351.24
C.O.

SECTION 2. Section 351.16, City Parking Lots and Parking Spaces, subsection
(c), is hereby amended in its entirety to read as follows:

(c) All parking spaces in the following parking lots owned by the
Municipality may be used by the public:
(1) Parking lot located south of the former Village Hall, 110 South
Hambden Street.
(2) Parking lot at the Municipal Center, 111 Water Street.
(3) Parking lot at 108 South Street.
(4) Parking lot at 106 Water Street.
(5) Parking spaces abutting the Alley between Court Street and Water
Street.
(6) Parking lot on Court Street abutting the Alley.

(d) Parking between the hours of 12:00 midnight and 6:00 a.m. is prohibited
except in the 108 South Street parking lot.

SECTION 3. Section 351.24, Specified Parking Time Limits, is hereby amended


to add the following:

(b) Overnight parking of motor vehicles is permitted:

(1) Upon the north and south sides of Short Court Street bounded on
the west by Main Street and on the east by East Park Street.

(2) In the six parking spaces immediately north of Short Court


Street on the west side of East Park Street.

SECTION 4. The Police Department shall amend the traffic control map to
conform with the amendments to Chapter 351 regulating parking.

SECTION 5. The Police Department and the Public Service Department shall
erect or cause to be erected signs designating the parking spaces where overnight parking
is permitted.

SECTION 6. It is found and determined that all formal actions of this Council
concerning and relating to the passage of this ordinance were adopted in an open meeting
of this Council, and that all such deliberations of this Council and any of its committees
that resulted in such formal action, were in meetings open to the public, in compliance with
the law, including §121.22 of the Ohio Revised Code.

SECTION 7. This ordinance constitutes an emergency measure necessary for the


immediate preservation of the public peace, health and welfare, and for the further reason
that the Council desires to provide convenient parking for the residents of Main Street at
the earliest time, and for this reason this ordinance shall become effective upon its passage.
