WITNESSETH:
WHEREAS, the parties have agreed to settle the above-mentioned case and
indeed have already settled the same by executing this Amicable Settlement
with the Terms and Conditions hereforth stated;
WHEREAS, both parties agree to settle the case amicably on the ground
that the incident was not covered with malice and intent, under the following
terms and conditions to wit:
1. That the Second Party shall pay the total amount of Php 95,322.68
due. The whole amount shall be payable within 36 months which is
Php 2,648.13 per month payable every end of the month;
2. That the payment shall commence on February 28, 2018;
3. That if the Second Party fail to pay her monthly obligation, her total
amount of debt shall be due and demandable after the failure to pay
the amount agreed every month;
4. That the Second Party shall personally pay at the office of the First
Party the amount due each month in the respective month without
further demand or notice for compliance from the First Party;
Furthermore, the Second Party or her duly authorized representative
shall make payments at the office and shall not require for the
representative of the First Party to go to her house or residence;
5. The Second Party shall also have the option to fully pay the amount
before the expiration of the thirty-six (36) months;

6. That because of the aforementioned development, I, Nestor C. Paez,
for and in behalf of the ZANORTE COMMUNITY CREDIT
COOPERATIVE, has decided not to pursue anymore the further
prosecution of this case;
7. That the First Party is therefore praying the Honorable Municipal Circuit
Trial Court of Sindangan hearing the said case, thru the Honorable
Provincial Prosecution Office, for the immediate dismissal of Criminal
Case No. 12774 against MYRNA R. ACAYLAR for Violation of Batas
Pambansa Blg. 22;
That we, First and Second Party, are all of legal ages and of sound mind
when we executed this amicable settlement, and have executed the same
freely and voluntarily, without being coerced or intimidated;
