UNSC RESOLUTIONS: “ALL MEASURES COMMENSURATE”

1973 (2011)

Libyan Jamahiriya attack on civilians

Decides that paragraph 11 of resolution 1970 (2011) shall be replaced by the following
paragraph : “Calls upon all Member States, in particular States of the region, acting nationally or
through regional organisations or arrangements, in order to ensure strict implementation of the
arms embargo established by paragraphs 9 and 10 of resolution 1970 (2011), to inspect in their
territory, including seaports and airports, and on the high seas, vessels and aircraft bound to or
from the Libyan Arab Jamahiriya, if the State concerned has information that provides
reasonable grounds to believe that the cargo contains items the supply, sale, transfer or export
of which is prohibited by paragraphs 9 or 10 of resolution 1970 (2011) as modified by this
resolution, including the provision of armed mercenary personnel, calls upon all flag States of
such vessels and aircraft to cooperate with such inspections and authorises Member States to
use all measures commensurate to the specific circumstances to carry out such inspections”

The UNSC authorized Member States for a period of one year to inspect vessels on the high
seas off the coast of Libya that they had reasonable grounds to suspect were being used for
migrant smuggling or human trafficking from that country.

Decides to authorise Member States acting nationally or through regional organisations to use
all measures commensurate to the specific circumstances in confronting migrant smugglers or
human traffickers in carrying out activities under paragraphs 7 and 8 and in full compliance with
international human rights law, as applicable, underscores that the authorizations in paragraph
7 and 8 do not apply with respect to vessels entitled to sovereign immunity under international
law, and calls upon Member States and regional organisations carrying out activities under
paragraphs 7, 8 and this paragraph, to provide for the safety of persons on board as an utmost
priority and to avoid causing harm to the marine environment or to the safety of navigation

The Security Council banned illicit crude oil exports from Libya today, authorizing States to
inspect vessels on the high seas

Authorizes Member States to inspect on the high seas vessels designated by the Committee
pursuant to paragraph 11, and authorizes Member States to use all measures commensurate to
the specific circumstances, in full compliance with international humanitarian law and
international human rights law, as may be applicable, to carry out such inspections and direct
the vessel to take appropriate actions to return the crude oil, with the consent of and in
coordination with the Government of Libya, to Libya
