The home is a split level house accessed off of I Jwith a detached garage. The Garage is located on the east side of the main house. The main house has light yellow trim with a sandstone rock exterior. The Address, [IIE is clearly posted on the porch. |. Affiant's biographical information Ihave served as a law enforcement officer for 15 months. My Training and experience regarding investigations of the above crime includes the following: - Basic Law Enforcement Academy at the Washington Criminal Justice Training Commission. - Post Academy, | have received 4 months of Field Training with direct supervision of an MPO as well as 20 hours of Police Skills Refresher training SEARCH WARRANT AFFIDAVIT LINEBERRY v4 2/15, Page 2 2 LB “4 15 16 8 19 20 21 2 24 25 6 27 28 Il, Facts and circumstances supporting probable cause ‘On 2/13/18 at 09:25 hours | responded to a Threat call for service at [i Everett, Snohomish County, Washington. ~ | made a phone call first to the reporting party, Catherine E, Katsel-O'Connor DOB: who stated she had found her grandson's journal last night in his room, 2/12/18, after he left to go to a friend's house. Mrs. O'Connor identified her grandson as Joshua Alexander O'Connor DOB: IEE (verified by DOL). Mrs. ‘O'Connor stated that she read a couple of the recent entries in the journal that included a plan to shoot people at Ace's Alternative High School located 21 i Everett, Snohomish County, Washington. - Mrs. O'Connor said she then made copies of other journal entries, and placed the journal back where she found it on Joshua's bed. Mrs. O'Connor stated that she has lobserved Joshua writing in the journal and typically Joshua does not go anywhere ‘without it. Mrs O'Connor describes Joshua's journal as spiral-bound 8.5x11" with what looks like writing or drawing of some kind in black ink on the front cover. This journal outlines in detail how, when and why Joshua intends to carry out his shooting/bombing attack on ACES High School. -Mrs. O'Connor stated when Joshua returned home on 2/12/18 he was carrying a {guitar case. Mrs. O'Connor said it appeared from the way Joshua was carrying the jcase, something heavier was inside the case other than a guitar. The next morning, 2/13/18, Mrs, O'Connor waited until Joshua left for school. After Joshua left for school, Mrs. O'Connor went into his room and located the guitar case Joshua was carrying. Mrs. O'Connor opened the guitar case and found an AR style rifle. Mrs. O'Connor then decided to call 9-1-1, ~ | arrived at Mrs. O'Connor's home, EEE Everett, Snohomish County, Washington. Mrs. O'Connor handed me an excerpt of the journal she made which included 17 pages, which | took custody of and later submitted as evidence. Mrs. O'Connor stated while looking for the guitar case in Joshua's room, she saw two grenades. Mrs. O'Connor then asked her husband to inspect the grenades. Mrs. (O'Connor stated that Mr. O'Connor said they appeared to be “inert." - In Journal entry #4 dated 1/4/18, Joshua writes, "I'm preparing myself for the school shooting. | can't wait. My aim has gotten much more accurate." Joshua goes on to ‘write, "I'm 18 now, my plan is to save up more money and legally buy a Mossberg 590, shockwave 20 Ga 14-inch shotgun. It's small, easy to conceal, and will do the job.” Later in the same entry Joshua writes, "Can't wait to walk into that class and blow all ‘those MEMaway." - In Journal entry #5 dated 1/9/18, Joshua writes, "I've been thinking alot... | Need (underlined) to make this shooting/bombing at Kamiak infamous. | Need (underlined) to ‘SEARCH WARRANT AFFIDAVIT LINEBERRY v4 215, Page 3 10 n 3 4 1s 16 8 19 20 ai 2 23 Pry 2s 6 28 get the biggest fatality number | possibly can. | Need (underlined three times) to make this count. I've been reviewing many mass shootings/bombings (and attempted bombings) I'm learning from past shooters/bombers mistakes, so | don't make the [same ones. I'm thinking about using pressure cooker bombs for Kamiak (easy to hide and will fit in a backpack) and thermite/propane bomb for the MUK police distraction." Joshua also wrote, " I'm ecstatic for April 19th." In the entry April 19th is circled. The emphasis Joshua put in this entry on the date of April 19th is important because the ‘Columbine High School attack took place on April 20, 1999 and the Oklahoma City bombing took place on April 19, 1995. - Also included in the copies provided to me by Mrs. O'Connor is an entry labeled, "My Will which is signed by Joshua O'Connor at the top. In the entry Joshua proceeds give his belongings to his sisters and friends. - In Journal entry #7 dated 1/25/18, Joshua writes, "So today I just bought a Hi-Point 10 +1 9mm Carbine rifle. They didn't have it in stock at West Coast Armory, so it's |going to take a week to come in. I'm just so stoked that | bought it. | can't wait for the ‘carbine to come. It's too [lMeasy to buy a gun." Later in the same entry Joshua \writes, "I like the amount of ammo it holds, | won't have to reload as much. | already have some 9mm ammo, but | need more hollow points for my retribution. | can't wait for April, it will be a blast. Eric Harris had the right idea getting this rifle. It shouldn't be hard to conceal. | was thinking about using a guitar case. As of now I'm going to work lon getting more gunpowder and other supplies for my CO2 bombs and pipe bombs." The reference Joshua makes in this entry is significant because Eric Harris was identified as one of the shooters in the Columbine High School Attack on April 20, 1999. Eric Harris also used semi-automatic rifles and improvised explosive devices in their attack. - In Journal entry #9 dated 2/2/18 titled "Coin flip of Fate." Joshua writes, "The results: I'm coming for you Ace's. Damn Kamiak you I got lucky..." Later in the same entry jJoshua writes, "! can't wait to fuck up Ace's! April is gonna be a blast.” Included in the copies of Joshua's journal provided by Mrs. O'Connor is a page titled, Outline for Ace's Massacre”. In it Joshua details step by step how he plans to carry lout the attack to include the time of day. The steps include, "Bring gear and weapons (wait til lunch). Wait 2-3 mins after lunch bell and go to gym backdoors by student parking, and put zip ties on door handles (so BBMBER cant escape), Set up pressure cooker bomb by bleachers with most students. Walk out of gym and zip tie gym doors by Tom's history class. As soon as FTP bomb goes off start shooting spree and start music, Throw pipe bomb and smoke bomb in office. Mow kids down in hallway and jaym. Kill yourself at the end of Make a change.” Due to Joshua writing about his research of mass shootings/bombings Mrs. O'Connor was asked if Joshua had access to his own computer. Mrs. O'Connor stated that Joshua does not have a computer and she observes him accessing the Internet SEARCH WARRANT AFFIDAVIT LINEBERRY v4 2715 Page 4 10 a 2 13 1s 16 ” 18 20 21 2 23 24 6 7 28 exclusively on his cell phone. For this reason, | ask that the court also grant acess to Joshua's cellular telephone. The cellular telephone then will be impounded to the Everett Police Department property room and a supplementary search will be requested for obtaining pertinent information from it. Joshua O'Connor was located at ACES High School and arrested today at 1150hours. At the time of his arrest, he was armed only with a folding knife. Joshua had receipts from West Coast Armory for the recent purchase of a High Point 9mm rifle. SEARCH WARRANT AFFIDAVIT LINEBERRY v4 2115, Page 5 18 19 a 2 2 24 25 26 21 28 Il, Items to be seized Based on all the foregoing information, | believe that there is probable cause to search the above identified property/properties, vehicle(s), and/or person(s) for the following items and/or person(s): -Firearms and firearm parts and accessories including but not limited to a Hi-Point 10 +1 9 mm Carbine Rifle, (Unknown Serial Number), Ammunition, holsters, cleaning and storage supplies, documents of purchase, ownership and firearms research. -Explosive and Improvised Explosive Device (IED) related materials. These materials include: explosives, containers, fuzing systems, manufacturing tools and supplies, instructional information, purchase documentation and evidence of prior testing. -Explosives including both high explosives, such as TNT, dynamite, C-4 and commercial explosives (KineStik, ANFO, etc.) as well as low explosives such as black powder, Pyrodex, smokeless powder and flash powder. The main explosive charge can also be homemade (improvised) from various chemicals to include: fuels and oxidizers such as ammonium nitrate, fuel oil, nitro methane, phosphorous, peroxides, acids, sulfur, charcoal, perchlorate mixtures, potassium nitrate, acetone and powdered metals such as aluminum and magnesium. -nitiators, including: commercial blasting caps, electric matches, squibs, time fuses, cannon or hobby fuses or improvised initiators. An example of an improvised initiator would be a light bulb with the glass broken to expose the filament, -Containers used to manufacture, confine, enhance, camouflage, hide, or store explosives, fuzing components, including: PVC, metal pipes, metal boxes, metal sheeting, metal pieces, pressure cooker, cardboard tubes, plastic containers and cardboard containers. -Fuzing systems, components, and materials, including but not limited to: timed devices, victim-initiated devices, command- detonated devices, power supplies such as batteries, wires, conductors, switches (including clothespin switches, lever/pressure switches, improvised loop switches, electric and electronic switches), light emitting diodes (LEOs), relays, digital and mechanical timers, wire, solder, radio controlled transmitters and receivers, electronic pagers and cellular phones. -Manufacturing tools and supplies, including but not limited to: metal used to construct explosive devices, drills, drill bits, pipe wrenches, plumbers’ tools, sockets, raichets, wrenches, bench vises, vise grips, pliers, hack saws, grinders, metal files, wire cutters and strippers, welders, welding rods, saws and other cutting devices, soldering irons, glue guns, caulking, tar, epoxy, contact cement, tape (electrical, duct, masking, sealing and strapping tape) and other fasteners including zip-ties. Affiant’s biographical information In addendum to the previous search warrant and affidavit attached and incorporated herein; | have served as a law enforcement officer with the Everett Police Department for 2 years. - Conducted Basic Law Enforcement Academy at the Washington Criminal Justice Training Commission. - On a patrol level, conducted multiple robbery investigations for robberies involving force or threats of force used SEARCH WARRANT AFFIDAVIT LINEBERRY v4 2715 Page 2 10 ul 2 25 26 27 28 II. Facts and circumstances supporting probable cause In addendum to the previous search warrant and affidavit attached and incorporated herein; ‘On 02/12/2018 at approximately 2212 hours, Everett Police officers were dispatched to a robbery at ARCO AMIPM, | verett, WA 98204. The clerk reported that two men had come in and robbed the store at gunpoint using a black rifle. ‘At 2158 hours, two suspects entered the store wearing full-face masks. One male was |wearing a face mask that resembled the likeness of Donald Trump. The other was |wearing a similar material face mask that was unidentifiable at the time. The suspect with the unidentifiable face mask was wearing a distinctive patterned green and black outer shell jacket. He was holding a black rifle pointed at the clerk. The rifle was covered with a gray and black sweatshirt, however the front sight was clearly visible and distinctive in that it was an abnormally high front sight. The suspect wearing the Donald Trump face mask collected approximately $100 in cash from the cash register and placed it in a black backpack. Both suspects then left on foot. The robbery occurred under EPD case number 2018-16818 ‘On 02/13/2018 at approximately 2010 hours, the aforementioned and attached search warrant was served on O'Conner’s residence. | observed the clear and in color surveillance video of the robbery at ARCO AMPM. (On O'Connor's bed was a black, HiPoint $mm rifle. The stock appeared to match that of the stock of the rifle observed in the surveillance video of the robbery. The front sight of the rifle also exactly matched the distinctive, abnormally high front sight of the rifle observed in the surveillance video. Inside of the northeast closet in his room, a cardboard shoe-box was located. Upon ‘opening the shoe-box in service of the warrant, two full face masks were observed |depicting the likeness of Donald Trump and Kim Jong Un. The Donald Trump mask matched the mask observed in the surveillance video exactly. The second mask appeared the match the Kim Jong Un masked discovered in (O'Connor's residence, however the hair portion was not visible in the surveillance video due to it being partially covered by the hood of a coat. [Also observed in this same closet in O'Connor's residence was a distinctive patterned green and black outer shell jacket exactly matching that of the suspect holding the rifle SEARCH WARRANT AFFIDAVIT LINEBERRY ve 2715 Page 3 2 21 2 B 4 25 26 a 28 in the surveillance video. In interviewing O'Connor's grandmother, Catherine E. Katsel-O'Connor DOB: she advised that Joshua had returned home on the evening on 02/12/2018 at approximately 2230 hours. This is consistent with approximate walking time from the ‘ARCO AMPM that was robbed. Catherine also advised that Joshua was not wearing a coat and was carrying his guitar case, She asked him where his coat was and he advised it was in the guitar case. She noted that the case seemed unusually heavy at the time. The morning of 02/13/2018, she discovered the above mentioned rifle in the guitar case. The face masks, green and black jacket and rifle found in O'Connor's bedroom all exactly match the surveillance video of one of the robbery suspects. The suspect holding the rifle pointed at the clerk was wearing the green and black coat and the Kim Jong Un mask.
