CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS

This Contract made and entered by and between:

Department of Environment and Natural Resources – Provincial Environment

and Natural Resources Office ______________, a national government agency with
principal office at __________________________________________________________,
represented herein by Provincial Environment and Natural Resources Officer
(PENRO) ______________________________, herein referred to as the “First Party”;

- and -

ATTY. _________________________________ of legal age, Filipino and with

residence address at ______________________________________________________,
hereinafter referred to as “Second Party”;

WITNESSETH:

WHEREAS, the First Party is in need of the services of the Second Party who
shall render work not performed by the regular personnel of the First Party:

WHEREAS, the Second Party possesses the education, experience, and skills
required to render the services needed by the First Party;

WHEREAS, the Second Party has signified his/her intention, to which the First
Party has accepted, to provide the services needed by the latter;

WHEREAS, the Second Party hereby attests that he/she is not related within the
third degree of consanguinity or affinity to the: 1) hiring authority and/or 2)
representative of the First Party; that he/she has not been previously dismissed from
government service by reason of an administrative offense; that he/she has not already
reached the compulsory retirement age of sixty-five (65);

WHEREAS, it is understood that this Contract does not create an employer-

employee relationship between the First Party and the Second Party, that the services
rendered hereunder are not considered and will not be accredited as government
service; and that the latter is not entitled to benefits enjoyed by the regular personnel of
the First Party.

WHEREAS, the Second Party shall perform work at a time and schedule to be
agreed upon by both parties;

NOW, THEREFORE, both parties agree to the following:

Section 1. This Contract shall cover the period 03 January to 30 June 2018,
subject to Section 5 hereof.

Section 2. The Second Party is hereby contracted as LAWYER and shall perform
the following:
 a. Represent the CENR Office/Implementing PENR Office and/or the
DENR at hearings in the Court involving DENR and its officials, in the
performance of its functions;
b. Prosecute, in collaboration with public prosecutors, criminal cases which
involve violations of laws on forestry, land, protected areas, biodiversity,
environment, mining, solid waste, and other environmental laws, rules
and regulations;
c. Represent the CENR Office/Implementing PENR Office and/or other
DENR officials and employees who are respondents on certiorari,
mandamus, or prohibition proceedings;
d. Prepare pleadings for and in behalf of the CENR Office/Implementing
PENRO/ DENR;
e. Examine sufficiency of evidence and determine issues and course of action
to be taken, and assist the CENRO/Implementing PENRO in filing cases;
f. Provide legal advice to CENRO/ Implementing PENRO on official
matters; and
g. Assist the hearing officers on administrative proceedings handled by the
DENR;
h. Take accountability on all documents, equipment and information
received by him/her, and maintain confidentiality of information and
documents handled in the performance of the herein tasks;
i. Avoid handling cases with conflict of interest; and
j. Perform such other related work that may be assigned by his/her
immediate supervisor.

Section 3. For services rendered under this Contract, the Second Party shall
receive a monthly compensation of Forty Seven Thousand Seven Hundred and
Seventy Nine Pesos (P47,779.00), inclusive of tax, to be paid on monthly basis,
chargeable against DENR Funds.

For the purpose of payment for services rendered, the Second Party shall submit
the following to the Provincial Environment and Natural Resources Officer
(PENRO):

a. Detailed Accomplishment Report as proof of services rendered during

office hours and field work including report of status of cases assigned,
certified by the CENR Officer, when applicable;
b. Certified true copy of contract; and
c. Proof of attendance which may be in the form of Daily Time Record,
logbook, travel orders, and other such official records of services
rendered.

Section 4. In view of the nature as well as the necessity of his/her tasks, the
Second Party shall be entitled to attendance to seminars, and actual
transportation expenses chargeable to DENR funds, subject to the usual
accounting and auditing rules and regulations.

Section 5. This Contract may be terminated by either party for any reason as may
be deemed appropriate before the expiration of the period indicated in Section 1
hereof, giving the other party prior written notice not less than fifteen (15) days
before the intended date of termination.
