BUSINESS LAW IN THE WORKPLACE

Currently, the law has become a critical part of every single business. The two have been

intertwined and thus is mandatory for a non-legal person to appreciate the existence and

application of the law in the workplace. The law helps in setting the legal boundaries that govern

how employees and the management operates. Therefore, a non-legal person will be required to

have essential monitoring, implementation, and adaptive skills; having these will make it

possible for the said person to observe the code of conduct as stated by the law.

An entrepreneur requires having a certain level of knowledge about the law to be able to

operate smoothly in a business setup. These individuals need training on the administrative law

that outlines the limitation of running a business as per the court order. The administrative

legislation will help a businessperson to understand critical issues that affect the employees-

workers relationship and the legal interpretation of the same. Example of these issues is the tax

litigation, immigration audits, harassment laws, and patent rights. The basic understanding of

these laws will ensure that the entrepreneur complies with the law and avoid committing offenses

that will harm the business. Training on the antitrust issue will also be a critical legal component

that a business owner requires to acquire. Knowledge of antitrust law, notably “the Clayton Act”

and “the Sherman Act” will be vital in deciding how to compete fairly in the market (Kritzer,

2017, p. 72). A business person can make appropriate decisions on how to tackle competitors

without violating the law.

A typical business set-up different professionals who operate in varying capacities to

ensure its success. An ideal working environment can have an administrator, receptionist,

department heads, assistants, record officer, and team secretary. Among this personnel, there are

non-legal positions that require adequate understanding and interpretation of the law

(Amucheazi, 2018). A good example is the human resource management. The individuals in this

position are mandated to know how to treat employees; the legal knowledge can address the

issue of compensation policies, equal pay act, minimum wages, and working environment

requirements. The knowledge will also be used by the department to protect the employers from

the exploitation of workers due to misinterpretation of the law. A working position at the export

department in business also requires a better understanding of the law. These individuals ought

to understand the law that regulates importation and exportation of goods and services; the

knowledge of legal issues will address the law that exists between the trading countries,

continents, or international companies.

The average salary for legal personnel varies with the years of experience, level, country,

and the hiring company. On an average, in the U.S. a legal secretary can have an annual salary of

$69,000. The senior administrative secretary will have $80,000 while the law clerk stands to

pocket $54,000 per year (Half, 2018).

Lastly, if I have an enterprise, I would enjoy liaising with legal personnel. Having a good

rapport with professionals who have extensive knowledge of the law will be beneficial to the

business and on a personal level. Personally, I will acquire useful insights about the law, not only

the “Sherman Act” and “the Clayton Act,” but I will get to understand more aspects of statute

include interpretation of the constitution. The enterprise will benefit from adoption of policies

that ensure strict adherence to the administrative law. It will also be an important concept that

will indicate the role of legal professionals in a given business.
