EVIDENCE OF CONTRACT
 Banking relationship is a contract between the Bank
& the Customer. (Indian Contract Act, 1872).
 Customer should be legally capable of entering into
a valid contract .
 Application from customer to the Bank must be in
the proper form.
 Above holds good for both Deposit & Borrower
accounts.
 Banker needs to be conversant with legal provisions
of various Acts.
 Banker should take care more caution in respect of
lending.

 CHA 1 (Composite Hypothecation Agreement) excluding Vehicle (Annexure I)
with Annexure,
 CHA 2 (Composite Hypothecation Agreement) including for Vehicle for
priority Sector Advance (Annexure II) with Annexure,
 CHA 2 Attracts DUAL STAMP DUTY i.e. FOR AGREEMENT AND POWER OF
ATTORNEY
 CHA 3 ‘Deed of Guarantee’ in PSA. (Not in use now, replaced by OD-194)

 CHA Series of documents does not cover limits against Book Debts in which
case normal documents meant for Book debts to be obtained.
 Where terms of sanction stipulates creation of EQM by Deposit of Title
Deeds, Oral Assent has to be recorded with due compliance of the extant
guidelines and in such cases CHA 4 or CHA 6 will not be used.

 Duly acknowledged copy of sanction letter signed by Borrower/Guarantor/s
to be attached to CHA 1 or CHA 2.
 CHA Series of security documents will not be applicable to :
 Indirect Finance to Agriculture,
 Advances to High Tech Agriculture,
 Co-operative Societies,
 Sugar Factories,
 Trawlers and Boats,
 Book debts.
 Applicable to limits up to Rs. 25 lacs in Agriculture, MSME (Services) and
Star Personal A/Cs only:
 CHA Series of document (CHA-I or CHA-II) has replaced Ag-1, Ag-3, Ag-23,
Ag-30, Ag-37, Ag-51, Ag-57, Ag-62, Ag-GSSI-1,CBD-9, CBD-13, CBD-22,
CBD-25, CL-1.

N.B.- IFD-X can be used wherever Hypothecation of


stocks, book debts and plant and machinery are

duty shall be consolidated as per local law applicable to
an Agreement, Hypothecation and Power of Attorney.

CHECK POINTS FOR SHG
1. In the Inter-se Agreement to be executed by the members of the
SHGs, our bank is also a party. Besides, further covenants as to
trust obligations of the authorized representatives are also added.
The Inter-se agreement contains covenants both, for Demand
Loan and Term Loan up to the respective sanctioned limit.
2. The Inter-se agreement will have to be stamped as an agreement
cum power of attorney with applicable stamp duty.
3. The articles of agreement to be entered into with authorized
representatives has been duly modified to suit bank’s needs.
4. The articles of agreement will have to be stamped as a simple
agreement with applicable stamp duty.
5. It should be ensured that the Inter-se agreement and articles of
agreement are duly stamped and executed by all the members of
SHG and by the authorized representatives, respectively.
6. Appropriate acknowledgement of date and security should be
obtained periodically with due regularity.
7. With the adoption of model set of security documents as above,
joint Demand Promissory Note and Continuing Security Letter
need not be obtained.

(g) Search and Title Investigation Report from an approved advocate
certifying that the title to the loaned house/flat is clear, marketable and
free from any encumbrances. The report should also list out any special
document to be taken for creation of the mortgage. The Report should
be addressed to the Branch of the Bank where loan is to be granted.
HOME LOAN DOCUMENTS
(h) Extract of record of rights and Plan specification of the property
as approved by the local authority (copy of approved plan).
(These are not necessary when the building has been completed
and occupation certificate has been issued by local authority).
(i) Insurance policy for the cost of house/flat above plinth level
covering fire risks and other hazards duly endorsed in bank's
favour. (If the society has insured the entire building a copy of the
policy may be obtained and kept).
(j) A letter of authority issued by the borrower authorising the Bank
to pay premium on both Life Insurance Policy and Fire Insurance
Policy to the debit of borrower's loan/savings bank account.
(k) In the case of salaried persons, a letter addressed to the
employer, authorising them to deduct from his/her salary the
instalments and interest payable to the Bank and remit the same
to the Bank.
HOME LOAN DOCUMENTS
(l) Wherever salary deduction is not available , Standing
Instruction to debit the account / ECS (Debit) Mandate to be
obtained; ECS Mandate duly verified and registered.
(m) 2-3 CTS 2010 standard compliant cheques as PDCs (Post
Dated Cheques) Along with an undertaking to keep sufficient
balance in his/her account to honour the cheque/Standing
Instruction / ECS whenever the same is presented for payment.;
(n) A letter cum NOC from the builder/promoter/ vendor, in their
letter pad, as per banks standard format. The letter —cum- NOC
shall necessarily contain the Account Number of the Builder /
Promoter .
(o) Documents necessary to perfect collateral security, if any.
(p) Equitable mortgage of the property by deposit of title deeds
and recording of oral assent.
(q) Sanction letter duly acknowledged by borrower /guarantor.
LOAN AGAINST PROPERTY

In case of Limited Company Borrowers following
additional precautions need to be taken
 Branch must have on its records the address of the
Registered Office of the Company, where all documents and
notices need to be served.
 Branches should ensure that Corporate Borrowers deal
exclusively with the Bank or Banks where credit limits are
granted to them under consortium. An undertaking to the
effect that Company will not open any account or approach
any other Bank for facilities with prior consent in writing
from the Bank should be obtained.
 Branches must pursue the Memorandum of Association of
Ltd. Co. to ascertain that the purpose and the amount of
facility are authorized under it. It must be ascertained
whether there is any restriction on the Borrowing by the
Company. If yes, that limit should never be breached, since
this excess borrowing will be ultra-virus and such
borrowing cannot be regularized by the General Meeting.
Thus Bank cannot avail itself of any security held to cover
such borrowing.
IN CASE OF LIMITED COMPANY BORROWERS FOLLOWING
ADDITIONAL PRECAUTIONS NEED TO BE TAKEN
 The Board of Directors of a Company, is required, under
Section 292 of the Companies Act 1956 to exercise the
powers specified therein on behalf of the company only
by means of Resolutions passed at duly convened
meetings of the Board and such powers cannot be
exercised by means of a Circular Resolution passed
without calling a meeting of the Board.
 The Board of Directors cannot borrow in excess of Paid-
up Capital and Free Reserves (apart from temporary
limits) of the Company without consent of the Company
in General Meeting. A Certificate that total Borrowings of
the Co. together with the advance limit fixed by the Bank
are not in excess of the limits prescribed under Section
293(1) should be incorporated in the Board Resolution.
