For the reasons stated in the Court’s memorandum opinion and order [520], the Court grants Defendants’ motion for summary judgment of non-infringement [369] and denies as moot the remaining motions for summary judgment, [375], [377], [384], [387], [392], motions to exclude expert testimony, [367], [370], [373], [389], [395], and [398], and miscellaneous motions, [362-1], [457], [495], [500]. A separate judgment order in compliance with Federal Rule of Civil Procedure 58 will be entered today in favor of Defendants and against Plaintiffs. Consistent with the discussion held on the record at the March 9, 2018 hearing, the Court has temporarily sealed its memorandum opinion and order [520] resolving the pending motions in this case and has made copies of the opinion available to counsel (and, by extension, their clients) today. Given the immense volume of filings that have been made under seal in this case and in an abundance of caution, the Court has adopted, with the parties’ consent, a procedure based on Seventh Circuit Internal Operating Procedure 10(b) to allow the parties until April 5, 2018 to file a motion to redact any material in the opinion that they believe meets the very high standard in the Seventh Circuit for sealing matters that are referenced in judicial opinions or otherwise part of the judicial decision- making process. If no such motions are filed—or if a motion is filed and denied—the Court will direct the Clerk to lift the seal and make the memorandum opinion and order public as soon as practicable and in any event no later than April 12, 2018. Pursuant to Federal Rule of Civil Procedure 59(e), any motions to alter or amend the judgment must be filed no later than April 26, 2018.
