Vance P8541) conducted a follow up investigation In regards to a report ofa Battery committed by a CCSD teacher (Jason Wright) to a student (Jayden Zelaya-Ramos, DOB 08/03/07), which oceurred on 03/08/18 at about 1700 hours, at Haris Elementary School (3620 S. Sandhill Ra, Las Vegas, NV 89121). Officer Dakake Pt542 responded to the schoo! to initiate an investigation. Ofc. Dakake reported that Jayden was outside with his class. The class was lining up outside on the playground when Jayden bent down to pick up a caterpillar he saw on the ground. Wright approached Jayden and kicked his right hand with his loft foot. This caused pain in Jayden's right pinky finger. t was also reported Wright grabbed Jayden by his shirt collar and pulled him using enough force to stretch out the collar of his shir. Officor Dakake checked Jayden's hand for injury and saw his pinky fingor was swollen compared to his let hand. Officer Dakake photographed the injured hand and attached the photos to this report. | ater downloaded the photographs to a POF filed and burned to CD which was placed into Evidence. The Assistant Principal at Haris ES, identified as Julie Borchers, individually interviewed several students who witnessed the incident. The students wrote statements detaliing the incident. Jayden wrote the following: “Mr. Wright took the class to the fleld and | went to.go pick up a caterpillar and then he purposely kicked my hand kind of hard, and that made me feel mad. About 6-10 minutes later we were walking back to class hhe grabbed the neck area of my shirt and stretched it out 0n 03/09/18 at about 1030 hours, | conducted a recorded interview with Jayden at Haris ES. Jayden corroborated his written Statement in the interview. Jayden showed me his right hand and | saw his ight pinky finger was still swollen compared to hie if. HB 0005 BER, 2140 AEE stated in a writon statomont that Mr. Wright pulled and kicked Jayden. | spoke 12 Ina recorded interview and he said Mr. Wright kicked Jayden in his hand because he picked something up ‘off the ground. He also sald Mr. Wright pulled Jayden by the colar of his shirt. ‘Several other students wrote statements which stated that while they were lining up outside there wore alot of bees fying around and they were afraid because some of them are allergic, so they were running around away from the bees. All statements writen by student witnesses were attached to the original report completed by Ofe. Dakake. I reviewed surveillance cameras at Harris ES. Cameras 12 and 19 cover the outside area where the incident occurred. The ‘cameras wore panning and did not have any video that would be of evidentiary value. | contacted CCSD Secunty Systems and requested the video be burned to a CD. The CD was placed into Evidence and a copy attached to this report. (0m 03115118 at 1600 hours Wright provided a signed typed statement which read as follows: “To the best of my recollection, the following is what occurred on March 7,201 | picked up the students from thelr music special in the portables outside at 10:58am. The class in general was not following Instructions to line up to walk back ito the school to the classroom. Bocause they were behaving in a raucous manner. | determined it would be beneficial to practice walking in a line quietly in the grass next to the music portable. | have been told by the sehoo's administration that walking isan acceptable redirecting practice, 2s is being outside. | Intended to have thern line up and walk tothe backstop on the field and beck, about 100-160 fest each direction. | informed them Hf they walked {uietly, we would be able to go to lunch on time. They lined up loosely, better than before, but not everyone was paying attention. Then students noticed that bees were on the ground. Some ran away screaming, thers were just detracted by the bees. Several students began to say that one student Jayden Zelaya ("Jayden") was going to touch a bee. | turned to lock at what was going on, but the commotion had stopped, $0 | assumed that the bee had flown away, After about a minute lator, Several students again started to say Jayden was going to touch a bee. | was a few feet away, and | quickly moved to -Jayden's position. | saw Jayden bending down with his hand reaching out toward a bee, and | swiftly intervened with my lft foot to move his hand out of the way to protect him from being stung by the bee. My foot swiped from left to right, hovering, from one-to-two inches above the ground to move Jayden's hand away. | was sure to be careful NOT to step on his hand, {and his hand was never under my foot. Once his hand was away, Jayden Stood up. | then used my right hand to gently but
