Dear Ms. Mantell:
The proposal in your May 22, 2018 letter is not satisfactory to the Metropolitan Government.
For the reasons explained in my letter of May 8, 2018, and in the Warrant and Complaint filed with the
General Sessions Court in Case No, 186C11690, Bird riders must comply with applicable laws, and the
parking of Bird scooters may not continue within the Metropolitan Government rights-of-way unless
‘and until a regulatory scheme has been adopted by ordinance regarding the permitting and operation of
such scooters, Thus, in the interim, you are directed to remove all Bird scooters from the streets,
sidewalks, parks, greenways and public areas of the Metropolitan Government by the end of the
business day today. You are directed thereafter to refrain from replacing any scooters or other
obstructions in the rights-of-way and other public areas until and unless you have been given permission
to do so by the Metropolitan Government. Otherwise, the Metropolitan Government Department of
Public Works will begin impounding all Bird scooters that it finds unattended on a Metro street,
sidewalk, park, greenway or other public area, beginning tomorrow morning, June 7, 2018.
As lam sure you are aware, an ordinance to regulate the scooters, Ordinance No. BL2018-1202,
has been filed and was approved by the Metropolitan Council on first reading last night. This ordinance
is likely to be amended before final passage, and Bird is welcome to comment on the bill or any
amendments thereto. However, the continued illegal obstructions of the rights-of-way and other public
areas of the Metropolitan Government cannot continue in the interim,
