APPENDIX – SPECIMEN BANK GUARANTEE FOR PERFORMANCE BOND

THIS AGREEMENT is made the ______________ day of _________________ between

Contractor) (hereinafter called the Principal) of the other part.

WHEREAS

This agreement is supplemented to a Contract No. _______________ (hereinafter called the

Contract) dated ________________ and made between _____(Name of Company & Address)__
(hereinafter called the Contractor) of the one part and the Principal of the other part whereby the
Contractor agreed and undertook to see the successful conclusion of the contract in accordance
with all terms and specifications specified in the said contract for the sum RM_______________.

1) The Guarantor hereby agreed to guarantee the due performance for the Contract in
manner hereinafter appearing.

NOW the Guarantor hereby agrees with the Principal as follows: -

1. If the Contractor (unless relieved from the performance by any clause of the Contract or
by statute or by the decision of a tribunal of competent jurisdiction) shall in any respect
fail to execute the Contract or commit any breach of his obligations hereunder then the
Guarantor will indemnify the Principal the sum of RM __________ provided that the
Principal or his authorised representative has made a claim against Guarantor not later
than two (2) months after the end of Defects Liability Period.

2. The Guarantor shall not be discharged or released from this Guarantee by an

arrangement between the Contractor and the Principal with or without the consent of the
Guarantor or by any alteration in the obligations undertaken by the Contractor or any
forbearance whether as to payment time performance or otherwise but the Guarantor
shall be entitled to be informed of such arrangements or alterations.
