Dear Mr. Dyer:
‘As you know, my office represents the Electronic Classroom of Tomorrow (ECOT).
Enclosed are records responsive to your request from April 30, 2018. Included in these records
are all severance agreements in our possession that were formed from 2012 through 2017.
As you will see, these agreements do not “restrict[] former or current employees from
impugning ECOT or officials connected with ECOT," as stated in your request. Although the
‘agreements contain a standard non-disparagement provision, the agreements expressly provide
that the non-disparagement provision does prevent signatories from “filing a charge or
complaint with, reporting possible violations of any law or regulation, making disclosures to,
and/or participating in any investigation or proceeding conducted by... any governmental
authority charged with the enforcement of any laws..." However, ECOT is providing these
agreements and associated documents in good faith and in an effort towards full transparency.
Please note, most, if not all of the agreements do not state the amount in which each
former employee received. When an employee was laid off, the employee received two weeks
of pay and a certain percentage of accrued, but unused Paid Time Off and/or Sick Time. AS
such, we have also included a document that shows how much each employee received, and
how the severance amount was determined. Finally, also included is a list of employees who
signed severance agreements.
