JUDICIAL AFFIDAVIT OF
BARBIE SUYO
I, Barbie G. Suyo of legal age, married, and living at Brgy. Tabuc Suba, Jaro,

Iloilo City, petitioner in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Katy Perry with address at Santa Barbara,

Iloilo. The examination is being held at the same address. I am answering her

questions fully conscious that I do so under oath and may face criminal liability for

false testimony and perjury.

This affidavit/testimony of petitioner Barbara G. Suyo is being offered to prove

that the respondent Belen G. Pacana is indebted to plaintiff the sum of One Hundred

Thousand Pesos (php 100,000.00), Philippine Currency. The petitioner’s testimony

is also offered to prove that defendant Belen G. Pacana unlawfully refused to pay

the lawful demand of the plaintiff.

1. Q. Please state your name and other personal circumstances for the record.

A. I am Barbie G. Suyo, 35 years old, farmer and residing in Brgy. Tabuc Suba,

Jaro, Iloilo City.

2. Q. Are you the same Barbie G. Suyo, the petitioner in this case?

A. Yes ma’am.

3. Q. Do you know a certain Belen G. Pacana?

A: Yes ma’am. She borrowed money from me in the sum of Php 100,000.00

4. Q: When did Belen borrow money from you?

A: December 25, 2016

5. Q: Do you have any proof that indeed Belen borrowed money from you on the
said date?

A: Yes ma’am. He executed a document in an Hiligaynon dialect in the presence

of Flynn Aguilar, as Barangay Kagawad, Kenon Bueron as Barangay Secretary and
Maria Labo as Barangay Captain where she had acknowledged his indebtedness and
where she had promised to pay the me the sum of php100,0000(Exhibit “A”)

6. Q: Did Belen pay her indebtedness?

A: She failed to pay the remaining balance of Twenty Five Thousand Pesos of the
obligation on despite several demands,

7. Q: How did you settle this matter?

A: I approached Atty. Cookie Aguilar to formally send letter of demand payment

of their indebtedness. (Exhibit“B”)

8. Q: Did she answer your demand?

A: She failed to comply with such demand.

9. Q: What did you do next?

A: I tried to settle the matter with her to the level of the proper lupon of Brgy.

Tabuc Suba, Jaro, Iloilo City, but he refused to settle it.

10. Q: Do you have any proof that Belen indeed refused to settle his indebtedness?

A: Yes ma’am .Certificate to file Action (Exhibit “C”)
