SECTION - I

QUALIFICATION CRITERIA

1.1 Qualification Criteria:

Agencies intending to participate in the bid should fulfill the Qualification Criteria (Experience and
Financial) given below.

Experience Criteria:

Bidder should have provided EPCM Services for at least one Bio-refinery/ Distillery plant/ Refinery/
Petrochemical/ (brown-field or revamp) successfully commissioned in the preceding 7 years (reckoned
from the bid due date) having one single project cost of not less than INR 5000 Million, which is in
continuous operation on the date of bid submission.

The Bidder should have provided EPCM Services including Residual Process Design, Detailed
Engineering including 3-D modeling, Procurement services including Tendering, Inspection and
expediting, Construction Management at Site including Site inspection and Quality Assurance
procedures, HSE Management, and Pre-commissioning/Commissioning Assistance.

Bidder should have full-fledged office set up in India for carrying out Residual Process Design,
Detailed Engineering including 3-D modeling, Procurement services including Tendering, Inspection,
Expediting and Construction Management.

Financial Criteria:

 Annual Turnover: INR 2000 Million minimum for continuous last two financial years each based
on Audited Results.
 Net-worth: Net-worth of the Bidder shall be positive for last two financial years based on Audited
Results.

Bidder should not be under liquidation, court receivership or similar proceedings. Bidder shall furnish
documentary evidence by way of copies of Work Orders, Completion Certificates and balance sheets
including Profit and Loss Accounts, Bank Certificates etc… along with their bid to establish Bidder’s
conformance to Qualification Criteria.

Failure to meet the above Qualification Criteria will render the Bid to be rejected. Therefore, the Bidder
shall in his own interest furnish complete documentary evidence in the first instance itself, in support of
their fulfilling the Qualification Criteria as given above.

SECTION – II

INTRODUCTION

2.1 Bio- Refinery Project:

- Assam Bio Refinery Pvt. Ltd.(ABRPL) plans to set up a bio-refinery at Numaligarh for production
of fuel grade Ethanol from Bamboo. The technology for the bio-refinery will be provided by M/s
Chempolis Oy of Finland. This initiative is a pioneering effort which will use this new technology for
conversion of ligno-cellulosic bio-mass to ethanol for the first time in the country on a commercial
scale. Besides ethanol, the bio-refinery will also produce furfural, acetic acid and bio coal which
shall be utilized for generation of power. The plant shall have capacity to process 300 TMT of
Bamboo (Dry basis) and shall produce 49 TMT of Ethanol together with associated platform
chemicals and power. The feedstock will be sourced primarily from North-East states of India.

- The Bio-Refinery at Numaligarh for production of fuel grade Ethanol from Bamboo will be a new
facility (green-field project) which will be implemented at an adjoining plot located in North East
corner of Numaligarh Refinery Limited (NRL) premise-hereinafter referred to as
“Project/project/PROJECT”
- The Bio-Refinery unit will be connected to the existing refinery through a utility corridor.
- As per guidelines of Ministry of Environment, Forest & Climate Change, the bio-refinery project falls
under category of Distilleries.

2.2 Project Promoters:

 The Bio-refinery project will be executed by Assam Bio refinery Pvt Ltd , a joint venture company
promoted by M/s Fortum 3 B.V , M/s Chempolis Oy, Finland and Numaligarh Refinery Ltd (NRL)

Brief descriptions of project promoters are furnished below:

NRL, a group company of Bharat Petroleum Corporation Limited, is a Government of India


Enterprise located at Numaligarh, Dist. Golaghat, and Assam. Numaligarh Refinery is designed for
processing 3 MMTPA of Assam Mix Crude Oil.

Fortum 3 B.V is a subsidiary of Fortum Oyj, Finland which is a leading clean-energy company
from Finland focusing on the Nordic and Baltic countries, Poland, Russia and India. Fortum operates
power plants and sells electricity & heat. Fortum's share is listed on Nasdaq Helsinki. Fortum is
having presence in India since 2012 and having solar power plants.

Chempolis Oy, a Finnish company, is a technology leader providing innovative and sustainable
solutions for numerous industries such as, paper, biofuel, energy, biomass & agro and oil & chemical
industries. The company is also the Technology Partner (Licensor) in building the proposed Bio-
Refinery.

SECTION-III

SCOPE OF WORK OF EPCM BIDDER

3.1 Project Facilities:

The following major facilities are envisaged under this project:

• Bio-refinery Unit
• Bamboo storage yard
• Bamboo chipper & conveyer system
• Co-gen power plant (Package delivery) including STG with fluidized bed boiler using biomass(bio-
coal) as fuel
• Storage facilities (intermediate and finished product(s), solvent & other chemicals)
• Associated Utilities and Offsite Facilities after carrying out adequacy study for the same.
• Central Control room along with the Service Building
• Administrative and Commercial services building
• Utility and product corridor
• Fire Detection and Protection Facilities

The Project includes facilities that are deemed necessary for making the Bio-refinery Unit operational
and hence not limited to the facilities described above only.

3.2 Unit specification and battery limits:

Apart from above products, there will be 20 MW power generation in Co-generation power plant

3.3 MANUFACTURING PROCESS - TECHNOLOGY AND PROCESS DESCRIPTION

The Bio- refinery technical concept is based on Chempolis’ formicobio™ technology that has been described
in this report and its appendices. The mill consists of process areas listed in Table 2-1.

Overall Block Diagram:

A. Bamboo handling

Bamboo logs are coming to the mill either with trucks or with rail cars. In both cases they are coming to the
same handling area. Logs are unloaded from vehicles with log stackers or with front-end loaders. Unloaded
logs are transferred either to the log storages or to the process. If log handling process is not running for
some reason (mechanical failure, chip storage is full etc.) logs are stored to the log storage. Log storage is
located near to unloading area. Size of the required area is approximately 1 to 2 hectare and there can be
stored logs of 30 days consumption in maximum

Logs which are going straight to the process are fed either to the chipping line 1 or 2. Chipping lines are
similar and they are working in parallel. One chipping line can produce all the chips for the process needs.
Chipping lines can work in the simultaneously or one at a time. Chipping capacity of one line is 150 solid
m3/h and total capacity is 300 solid m3/h. Chipping capacity is based on working form 2/7 where chipping is
working seven days per week and two 8 hour shifts per day. The calculation for chipper sizing also assumes
that all needed bamboo will be chipped from logs.

Chipper is drum type. Chipper has a rotating metal cylinder with 6 to 10 knives. Infeed system push the
bamboo bundle against the cylinder and knives cut the bamboo logs into the certain length of chips. After
cutting chips are led to the belt conveyor. This conveyor is part of a chip conveyor system which conveys
chips to the chip storage.

Main part of bamboo comes with rail cars, and the rest by trucks either chipped or unchipped.

The chip storage is longitudinal type and it has a triangle type cover round it. The feeding shuttle belt
conveyor is located in the top of the cover. Volume of the storage is 20 000 loose-m3. This form of chip
storage was selected because it allows a high enough pile to store the required chip volume in the space

available and it also allows covering it to prevent wetting of the chips during rainfall. A circular chip pile type
was also studied, but it was abandoned due to high investment cost and the inability to cover it.

The chips are fed in a continuous flow to a feeding trough at the top of the screen. From the trough the chips
fall to upper deck. Oversize chips remain on the upper deck and fall into the overflow trough at the discharge
end. From overflow trough chips are fed to the shredder. Shredder's rotating blades cut the oversized chips
smaller. The processed chips are fed back to screening.

Chip silo volume is 1500 loose-m3 which corresponds to about 8 hours average pulp production. Level of the
silo is measured with a level transmitter. The level controls the rotation speed of the chip storage discharging
screws and hence the chip screen feed capacity. Chips from silo are discharged to the process with a speed
controlled discharging screw. Capacity of process feeding can be varied from 300 to 700 loose-m3/h
depending on the desired digester fill time.

The main equipment of bamboo handling has been described in the enclosed equipment list. The equipment
of bamboo handling belongs to the section 105.

B. Fractionation of bamboo

The purpose of biomass fractionation is to efficiently degrade and dissolve lignin and hemicelluloses of
bamboo and enable production of purified cellulose for easy hydrolysis into glucose.
In biomass fractionation, bamboo is mixed with heated bio solvent that catalyzes the reactions of biomass
components. The bio solvent is an aqueous solution of formic acid containing acetic acid formed in the
process. The bio solvent dissolves hemicelluloses, lignin and ash (except silica) while cellulose and silica
remain insoluble. The main reactions and phenomena in biomass fractionation are as follows:
1. Degradation of lignin and dissolution of degraded lignin
2. Hydrolysis of hemicelluloses into sugars and dissolution of sugars (mainly xylose, glucose, and
arabinose as monomeric sugars). A part of dissolved sugars react further into furfural (C5 sugars)
and hydroxyl methyl furfural (C6 sugars)
3. Hydrolysis of acetyl groups of hemicelluloses into acetic acid and dissolution of acetic acid
4. Dissolution of ash components except silica. The ash components dissolve as anions and cations

Bamboo is fractionated in four batch digesters that operate in parallel. The desired reaction temperature is
achieved by circulating cooking liquor through heat exchangers, i.e. no direct steam is applied. Similar
digestion systems are and have been applied in the production of pulp from bamboo or wood chips.

In the case of batch digesters every process step is divided to different steps. These steps are called as
sequence. These sequences can’t be done in parallel, so process will continue automatically from sequence
to another sequence as it is programmed. Fractionation process will be divided to six different sequences.
These six sequences are following:
1. Feeding of bamboo and air disposal
2. Dosing of bio solvent to the digesters and evacuation of air
3. Circulation of bio solvent and heating of bio solvent indirectly with low pressure steam and
medium pressure steam
4. Reaction time at fractionation temperature in digester
5. Hot blowing and recovery of flash heat by a heat accumulator
6. Flushing of digesters with spent liquor

The main equipment of fractionation has been described in the enclosed equipment list. The equipment of
fractionation belongs to the department 110.

C. Washing of cellulose

The purpose of the washing of cellulose is to purify cellulose for hydrolysis and to recover dissolved solids
and chemicals from cellulose. Cellulose is washed after bamboo fractionation in two parts: 1) after blowing,
lignin and other dissolved components are washed from cellulose with recycled bio solvent and 2) bio solvent
is washed from bio solvent with recycled water. Cellulose is washed counter-currently in several stages using
drum washers and wash presses.

Cellulose is washed with similar drum washers and wash presses that are commonly applied in pulp industry.
The main equipment of fractionation has been described in the enclosed equipment list. The equipment of
washing belongs to the department 115.

D. Hydrolysis of cellulose

The purpose of hydrolysis is to break carbohydrate chains of cellulose fraction into glucose that is then
fermented into ethanol. The figure below illustrates the principle of the hydrolysis process. The main steps
and features of the hydrolysis process are as follows:

• Hydrolysis uses fed-batch approach: cellulose (35% consistency) is gradually added to hydrolysis
reactors and mixed with commercial enzymes and water to maintain a low level of viscosity.
• because cellulosic is slightly acidic; ammonia is added to keep pH in around 5.
• After hydrolysis, suspended solids are separated from the hydrolysate (stream 13) by settling. The
separation is beneficial for the following evaporation stage.
• The supernatant (stream 14) from settling is evaporated to reduce sizes of fermenters and distillation
columns and energy consumption of ethanol separation.
• The solids from settling are mixed with evaporation concentrate (stream 19) to recover all the sugars and
obtain the final hydrolysate (stream 15).

According to the present design, hydrolysis is carried out in five parallel fed-batch reactors. The tank reactors
are equipped with agitators that facilitate the efficient hydrolysis. Because the evaporation of supernatant of
hydrolysate proceeds to a relatively low concentration, it is beneficial to apply MVR-evaporation (Mechanical
Vapor Recompression). The main equipment of hydrolysis has been described in the enclosed equipment
list. The equipment of hydrolysis belongs to the section 120.

E. Fermentation of hydrolysate into ethanol

The purpose of fermentation is to convert the sugars of hydrolysate into ethanol. Because the saccharides in
the hydrolysate are almost entirely glucose, fermentation can be carried out using conventional
Saccharomyces Cerevisiae yeasts.

Robust Saccharomyces Cerevisiae yeasts consume glucose practically completely producing ethanol with a
high selectivity (92%). Rest of glucose is converted to cell biomass, acetic acid, and other organic
components (e.g. lactic acid, glycerol). For simplicity, the present study assumes the bio refinery purchases
commercial yeast, although on-site propagation would be a feasible option as well. In addition to ammonia
used in hydrolysis, urea is added to provide nitrogen for yeast growth. Other nutritional supplements can also
be used.

According to the present design, fermentation is carried out in five parallel batch reactors. The tank reactors
are equipped with agitators that facilitate the efficient fermentation. The contents of reactors are circulated
through heat exchangers to keep the temperature in about 32°C.

The main equipment of fermentation has been described in the enclosed equipment list. The equipment of
fermentation belongs to the section 125. Fermentation can probably be sourced as a complete package from
domestic or international suppliers.

F. Separation of ethanol

The purpose of the separation of ethanol is to purify fermented ethanol into fuel-grade ethanol and to recover
water for re-use. Ethanol can be separated with conventional technologies including the following stages:

• Beer column for the separation of stillages and initial concentration of ethanol (to e.g. 40%)
• Rectifier column for the concentration of ethanol and recovery of water
• Molecular sieves for dehydration of ethanol

Ethanol separation can be sourced as a complete package from domestic or international suppliers. The
main equipment of ethanol separation has been described in the enclosed equipment list. The equipment of
ethanol separation belongs to the section 130.

G. Evaporation and concentration of spent liquors from fractionation

The purpose of the evaporation of spent liquors is to recover bio solvent in the spent liquor and to produce
bio coal from the dissolved solids. The spent cooking liquor is the filtrate that comes from the first washer
after blowing (stream 1213 shown in the block diagram above).

The liquors are evaporated counter-currently in a six-stage train of falling film evaporators. A vacuum pump
evacuates the non-condensable vent gases from the condenser and maintains a descending pressure and
temperature profile throughout the evaporation train. Bio solvent vaporizes during evaporation (stream 1641
in the block diagram) and can directly be recycled to biomass fractionation and cellulose washing.

The concentrate from multi-stage evaporation is further concentrated using thin film evaporators and finally
dried with an indirect drier (e.g. paddle or multi-coil) into bio coal that can be combusted at an on-site power
plant. The bio coal has a 95% dry solids content and net heating value 20 MJ/kg. Because the temperature
increases as the dry solids concentration increases, the conditions in evaporation facilitate dehydration of

dissolved pentoses into furfural. The vaporized bio solvent is transferred to distillation (stream 1823 in the
block diagram).

The main equipment of evaporation has been described in the enclosed equipment list. The equipment of
evaporation belongs to the section 135. The equipment of concentration belongs to the section 137.

H. Distillation of filtrates from washing

The feed to distillation consists of filtrate from washing and bio solvent vaporized during evaporation and
drying of spent liquor (streams 1229 and 1823shown in the block diagram, respectively). Filtrate from
washing is pre-evaporated before feeding into distillation. Therefore, the feed contains bio solvent diluted with
water and enriched with furfural. The purpose of distillation is to separate the feed into four product streams:-

1. Concentrated bio solvent that is recycled to biomass fractionation (stream 1923)


2. Water that is recycled to enzymatic hydrolysis (stream 1913)
3. Acetic acid that is generated during biomass fractionation from acetyl groups of hemicelluloses of
bamboo (stream 1921)
4. Furfural that is generated from pentose sugars in the spent liquor (stream 1916)

The distillation is carried in out in several columns using the principle of hetero-azeotropic extractive
distillation. The main equipment of distillation has been described in the enclosed equipment list. The
equipment of distillation belongs to the section 140. The equipment of pre-evaporation belongs to the section
136.

I. Treatment of stillages

Stillage is a suspension containing yeast, enzymes, and residual components of cellulose. The purpose of
stillage treatment is to concentrate stillages for combustion and recover water for re-use in the process.
Stillage treatment produces three streams: stillage cake (stream 2005 shown in the block diagram), stillage
syrup (stream 2114) and water for re-use (streams 2161, 2162). In general, the treatment follows the practice
of 1G ethanol plants.

The picture below illustrates the principle of the treatment. The process includes the following operations:
1. Suspended solids are separated, for example, by centrifugation, filtration, and pressing
2. The filtrate is evaporated into syrup.
3. Stillage cake and syrup are combusted. Alternatively, they can be combined with boiler ash and
returned to fields as fertilizer
4. Evaporated water is recycled back for re-use in the washing of cellulose
5. A small amount of water is removed to maintain overall water balance

Treatment of stillages utilizes conventional equipment used in 1G ethanol production and other chemical
industries. Suspended solids can be separated, for example by centrifuges, drum filters, or filter presses.
Because the filtrate has a low concentration of dissolved solids, filtrate is mainly evaporated by MVR-
evaporation (mechanical vapor re-compression). The main equipment of stillage treatment has been
described in the enclosed equipment list. The equipment of stillage treatment belongs to the section 145 and
150.

J. Cogeneration power plant

The proposed bio-refinery would be producing around 49 TMT of bio-ethanol using 300 TMT of bamboo (on
dry basis). Apart from ethanol, the bio refinery will annually co-produce around 160 TMT of bio coal and 80
TMT of moist stillages in 37% dry solids content. ABRPL is planning to use these biomass residues to
produce power through a biomass based power plant that also produces steam for the bio refining process.

Captive Power and Process Steam Cogeneration facility, producing 20 MW Power comprising of a Bio Fuel
fired Steam Generator and Steam Turbine Generator (STG) . There shall be +20% Design Margin on Rated
Capacity of the Power plant.

The power plant shall be based on an idealized Thermodynamic Cycle called Rankine Cycle, which converts
useful heat into mechanical energy. The heat source/fuel for the proposed power plant shall be bio coal and
moist stillages. Fuel shall be combusted in the steam generator/boiler at high temperature. Heat produced by
burning of fuel shall be used to provide sensible heat and superheat to the water which would be running in
the boiler tubes. The transfer of heat takes place in different zones of boiler. Water is then converted to
steam and is made to enter into the steam turbine at high temperature and pressure, thereby rotating the
blades of turbine to generate electric power by using an alternator coupled with the steam turbine.

3.4 Implementation Plan:

- The “Bio-refinery Project” shall be implemented by the conventional EPCM mode of execution.
- The Co-generation Power Plant/”Combined Heat and Power” Plant (CHP) will be implemented on
(EPC)basis ”Engineering, Procurement and Construction ” basis. The brief scope of work for CHP
Plant is indicated separately in Annexure-I. EPCM Bidder will accordingly provide services for
necessary engineering, lining up of EPC contract, monitoring progress schedule, expediting
delivery of packages and construction management of the plant till “Performance Guarantee Test
Run” (PGTR).

- A few selected sub processes (e.g. separation of ethanol etc..) as recommended by Licensor will be
implemented as package supply.
- Due to critical nature of pulp handling and associated systems and combustion of Bio-coal and
stillages in CHP, successful EPCM Bidder shall line up the Advisory Services of renowned well
established Engineering/consultancy firm experienced in pulp handling , associated systems and
combustion of Bio-coal and stillages and seek advice as and when required.
- .The scope of work envisaged from the Advisory Services firm is highlighted in Annex-1.
- The successful EPCM Bidder shall prepare relevant tender document for engaging the Advisory
Services and select the agency from the list of firms provided by ABRPL. ABRPL will place work
order on the selected Advisory Services firm. The Advisory Services firm will work under
supervision of the EPCM consultant . Payment to Advisory Services firm shall be made by ABRPL
based on certification by EPCM as per agreed milestones an terms and conditions.
- The Advisory Services team shall work in close coordination with EPCM Bidder and Licensor. The
Advisory Services team shall review and check the documents within their scope and finalize the
contents and outcomes of Design Review with EPCM and Licensor.

- Application design of DCS will be carried out by DCS supplier .

3.5 Scope of EPCM Bidder’s Services:

3.5.1 The Engineering, Procurement & Construction Management Bidder (hereinafter referred to as
BIDDER) is responsible for engineering, procurement assistance, setting up, and commissioning of all
facilities that are required for implementing the Bio-Refinery Plant and making it operational. It also
includes any other work not specifically mentioned but required to complete the work for
implementation of BIO-REFINERY Plant.

Bidder shall render all required necessary services as mentioned below for implementing the project
facilities. However these services are indicative only but not limited to and EPCM Bidder is required
to carry out all activities/services for successful implementation of the project in Toto.

• Design and implementation of Enabling Facilities including rain shed whenever required
• Review/Checking of Basic Engineering Design Package, P&ID Finalization.
• Project Management, Planning & Scheduling,
• Cost Engineering,
• Residual Process Design,
• Process Design of non-licensed units & Offsite/Utilities.
• Lining up of Advisory services consultancy farm as mentioned above in implementation
plan..
• Detailed Engineering,
• HAZOP Analysis,
• 3D modelling,
• Procurement& Contract Services Assistance,
• Inspection & Expediting services,
• Assistance for Transportation of Over Dimensional Consignments including route survey, if
required;
• Material Control & Warehouse Management,
• Construction Management including Quality Assurance,
• Assistance for all Statutory/Govt. Clearances,
• Safety Management at work site,
• Pre-Commissioning/ Commissioning Assistance,

• Relocation of existing facilities, if required.

Salient work break-down of the aforesaid BIDDER services is given below for better clarity.
However scope of BIDDER services is not limited by such detailing and BIDDER is responsible for
achieving completion of the PROJECT as indicated earlier.

3.5.2 Project Management:

BIDDER shall
i. Develop complete project scope and procedure including those for procurement and
construction contracts and establish formal lines of communication including way of working
with ABRPL, Vendors and Contractors.
ii. Develop project strategy and schedules; establish monitoring system, reporting system and
project information system.
iii. Prepare preliminary schedule for discussion and finalization with ABRPL.
iv. Identify suitable weightage for various project activities and prepare PERT/S-curves for the
project monitoring including critical Path monitoring.
v. Prepare overall project schedule/network identifying critical path, priority activities, target
dates, milestones for completion and material flow. L1, L2 and L3 networks shall also be
furnished to the ABRPL. These refer to different levels of Network. L1 refers to Master
network while L2 and L3 refer to systems and equipment wise granular networks.
vi. Update the networks and project schedules as required by ABRPL.
vii. Prepare detailed discipline-wise schedules for setting out targets in line with overall project
schedules.
viii. Preparation of design basis.
ix. Responsibilities of the EPCM Bidder will be as follows –

a. Develop project information system for highlighting slippage and hold-ups for management
action and control to bring the project back on Track/catching up schedule
b. Maintain constant surveillance to ensure that commitments are met, schedules are
maintained & the engineering work is performed as per the engineering design basis agreed
for the project.
c. Monitor the purchasing, expediting/inspection activities and initiate necessary actions for
timely delivery of purchased items to the project site.
d. Convene monthly project review meetings with ABRPL. During detailed engineering &
procurement phases, these meetings will primarily be held at EPCM Bidder’s
offices handling detailed engineering/procurement. Thereafter, these review meetings shall
be carried out only at ABRPL site.
e. Maintain surveillance of the progress of construction by visits to the job site for identifying
and discussing field problems affecting the progress with the Resident Construction
Manager(RCM) of the BIDDER.
f. Prepare reports, which will be issued to ABRPL on monthly basis, summarizing the status of
the project. The report will include the status of engineering, procurement, tendering,
manufacturing & delivery and construction activities. The progress report will highlight the
specific delays, reasons for such delays, major hold-ups and suggested remedial actions.
g. Monthly report should include cost follow-up, schedule, HSE, risk assessment and reporting,
correction of cost, catch-up plan etc.

Job Planning, Resource Planning, Material Planning and Issue, Progress Monitoring and
Identification of Critical Issues and broken links including remedial measures will be in the scope of
the Bidder. The Bidder shall conduct all Progress Review Meetings (Weekly/Fortnightly/ Monthly
etc), liaison with the vendors; expedite delivery of equipment, co-ordinate in all intra and
interdepartmental issues with various departments in case of hold up in project progress including
publication of all Progress Reports.

x. EPCM Bidder shall have to form a team for expediting various equipment and bought out items
ordered on different agencies.

xi. Ensure review/approval of all designs/drawings/specifications submitted by contractors/vendors


within a very short time. If required BIDDER shall approve electronic copy of such documents to
meet schedule & thereafter approve hardcopy for records. Soft copies of such drawings may also
be submitted to ABRPL wherever there is confusion and involvement of multi-disciplinary personnel
to expedite the process in order to meet the target.

xii. Overall responsibility for all procurement or any job done on package concept will be solely on the
EPCM Bidder.

xiii. Any equipment found malfunctioning during start up or during commissioning / trial run, EPCM
Bidder’s technical team shall own up direct responsibility for setting things right in consultation with
all concerned.

xiv. At the pre-commissioning stage EPCM Bidder shall extend full support for all kinds of re-
engineering / modifications which needs to be done in the plant for operational reliability and
operational requirement.

xv. Ensure that all facilities as defined under project description are installed in the project & take
necessary corrective actions for incorporation of left out facilities.

xvi. Ensure implementation of all recommendation/ stipulations/suggestions of statutory/advisory bodies


such as Ministry of Environment & Forest (MOEF), Assam State Pollution Control Board (ASPCB),
Central Electricity Authority (CEA), Chief Inspectorate of Factories (CIF)& Chief Inspectorate of
Boilers (CIB), State Excise Authority, Ministry of water resource etc. and recommendations/
suggestions in Risk Assessment (RA) / Environmental Impact Assessment (EIA) study report. All
other standards/ statutory requirement to fulfill requirement of distillery units.

xvii. Ensure environmental and human rights regulations are being upheld in the construction of the
biorefinary. (IFC Standards)

xviii. Intimate ABRPL upon mechanical completion of each piping loop and thereafter liquidate ABRPL’s
check-lists, if any. This shall include flexibility analysis and cold and hot setting of the Hanger
Supports with Readings

xix. Issue compliance certificate indicating that the new facilities are installed as per the mutually
agreed drawings, standards, specifications and meeting the norms of all the statutory/advisory
bodies noted above before commissioning each facility.

xx. Prepare cost estimate for “material requisitions” (MR).These Cost estimate to be provided to
ABRPL before opening of priced bids.

xxi. Prepare SOR (schedule of rate ) item based cost estimate for all tenders. The SOR quantity
indicated in the Tender Document should be practicable as far as possible backed by suitable
engineering inputs to avoid change in SOR quantity post ordering.

xxii. Separate SOR items for Pre-commissioning and Commissioning assistance to be considered in the
Tender Document for all relevant contracts.

xxiii. Provide office space and facilities at Bidder’s project office (Corporate/H.O) for ABRPL’s
representatives during the period of the PROJECT. The facilities shall include two independent and
furnished cabin complete with executive table, executive chair, visitor chairs, visitor sofa, Desktop
PC (with Intel I-5 or I-7 processor – 5 GB storage space + 2 GB Memory or equivalent complete
with 21” LCD slim wide screen monitor) for 4 client engineers including Laser Jet Multi-function
Printer or equivalent capable of printing, copying, scanning and faxing. Dedicated telephone line
with STD facility and dedicated broad band internet.

xxiv. Utilize the surplus material available with ABRPL to the extent possible after carrying out necessary
inspection by BIDDER. If any external testing is required, same shall be carried out by ABRPL at
ABRPL’s cost as per advice of the BIDDER.

xxv. Restrict surplus material generation within a reasonable level of the total cost of bulk material.
However, BIDDER will assist ABRPL in disposal of the surplus materials.

xxvi. Co-ordinate activities relating to the project with the various departments within BIDDER.

xxvii. Review equipment list to identify items to be procured including imported ones and depending on
the standard lead time of such items, plan the engineering and procurement action.

xxviii. Assist ABRPL in answering queries of statutory bodies such as CTE/CVC, auditors etc…, and for
arbitration with contractors, if any.

xxix. Assist ABRPL by preparing technical documentation for obtaining statutory clearances as may be
applicable for project execution such as approvals from Factories & Boilers and Electrical
Inspectorate etc. and if required visit the offices of the authorities concerned. EPCM Bidder shall
have a Documentation Centre, Document Retrieval System. Also a Project Drawing Office at the
site with all CAD facilities

xxx. Furnish
- Project cost status report and comparison with DFR cost; and
- Delays (if any) in completion schedule with justification.

xxxi. Provide adequate number of engineers, planners, specialists, inspectors, expeditors, etc… along
with adequate support staff in all phases of Project to ensure timely completion. Over and above
the technical team required for execution of the project on conventional mode, EPCM Bidder should
maintain a team to look after labour/boundary related issues for smooth execution of activities at
construction site.

xxxii. Place planner at site during the construction phase. The progress of the site work shall be
meticulously monitored and report shall be submitted to ABRPL at periodic interval with recovery
plan if applicable.

xxxiii. Provide adequate number of dedicated qualified safety engineers, safety Stewards to cover the
construction activities at construction site on round the clock basis.

xxxiv. Provide adequate number of dedicated inspection engineers at site for quality assurance.

xxxv. Provide cost break up of mandatory/insurance spares, which may be supplied by vendors and
package contractors.

xxxvi. Forward entire bids received including that of disqualified Bidder’s to ABRPL.

xxxvii. Extend services till completion of all facilities of the project including arbitration and closing of all
contracts.

xxxviii. Provide all necessary services as required for relocation of existing facilities to facilitate setting up
of new facilities in the event such requirement arises during finalization of plot plan. QAP and
quality implementation Plan to be furnished

xxxix. In order to expedite execution of the Project on fast track basis the following are required to be
adopted by the Bidder.
 Detail engineering for all Structural Work and As-Built Drawings will be in the scope of the Bidder.

 EPCM Bidder shall have to depute within their ranks a Field Engineering Service team to take care of minor
engineering issues as and when required which calls for technical inputs, construction /fabrication drawing
modification, small changes in structural / piping supports, piping layout etc.

 Outsourced agencies/ Contractor/ Procurement agencies selected for various jobs / purchase of equipments should
be strictly scrutinized on the basis of data bank on performance available with the Bidder. Their performance in
recent projects and their technical credibility in achieving project targets should form one of the major criteria for
technical acceptability. EPCM Bidder will have to carry out detail study and gather inputs and advise the client on
order placement accordingly so that the project does not suffer due to wrong selection. In case of below par
performance of any such agencies the EPCM Bidder suggests means and ways to come out of the situation by a
definitive plan of action. Also EPCM to ensure ABRPL’s concurrence while sub-contracting by main contractor.

 The Bidder should also make a plan to maintain a pool of engineers, supervisors and safety officers giving a suitable
contract to a resourceful party so as to place them in case contractors fail to mobilize/ deploy as per requirement at
site.

 In order to recover the jobs arising out of the slow progress under a defaulting contractor, suitable back up
arrangement should be considered in all the critical tenders so that time delay can be avoided in finalizing a new
contract.

 BIDDER should also adopt mechanized modern methods for carrying out all construction activities for speedy
execution of site activities. Besides, grit blasting including two coats of painting in all the piping may be kept in the
scope of the supplier to minimize activities at site. Similarly, grid blasting, painting and fabrication of structural steel
may also be considered as a supply item instead of doing these activities at site through Civil & Structural contractor
or through any other dedicated contractor.

 Platforms and walkways associated with static equipments like reactors, vessels and columns may be kept in the
scope of the manufacturer. Guard Rails to be provided on all ladders/stairs

 EPCM Bidder shall have to determine a suitable cut off point so that for Vendor and Contractor selection who bid
below a particular percentage than the estimated one are either summarily rejected or instructed to explain their
view point for quoting much below the estimated value. In case EPCM Bidder is satisfied with their explanation and
recommend order placement to the client than the EPCM Bidder should also furnish an undertaking / justification on
the performance credibility of the party.

 For all equipments particularly foreign vendors suitable care should be taken so that the party has suitable presence
in India and have a established technical team in the country to take care of equipment related problems during pre-
commissioning, equipment start ups and future maintenance.

xl. EPCM Bidder will have to submit a sub-contracting plan /procedure for the subject works which
shall serve as the guideline in case the principal contract offload/sublet portion of their work scope
to some other agency .

xli. Ensure that the final payment to vendors and contractors is linked to submission of final documents
by them in format desired by ABRPL including all compliance schedules including royalty fee if any.

xlii. Be the Engineer-In-Charge (hereinafter referred to as EIC) for administering all contracts involved
in the project.

xliii. Coordinate for initiating pre-commissioning/commissioning and start-up activities and ensure
participation of specialist in the performance test run.

xliv. Project Accounting: BIDDER shall keep detail accounting of stores, contracts and other activities so
as to provide asset wise identification of materials used and contracts performed to facilitate
capitalization of the project.

xlv. Submit Commissioning and Performance Guarantee Test Procedures for all equipment/system .

xlvi. Set up and maintain online document management system. ABRPL and its representatives shall
have access to the repository. Define maker and checker, for reviewing and approving
documents

3.5.3 Residual Process Design:

BIDDER shall
i. Review BEDP for licensed units prepared by the licensor including Equipment Datasheets, PFD
and P&ID
ii. Prepare and finalize BEDP for non-licensed units, offsites & utilities.
iii. Carry out Residual Process Design including that of utilities &offsite.
iv. Carry out adequacy check for existing utilities/offsite
v. Prepare utility distribution P&IDs
vi. Submit as-built PFDs and P&IDs
vii. Prepare data sheets/line schedule for equipment/lines identified consequent to residual process
design.
viii. Prepare utility summary (based on vendor/ engg. inputs during detailed Engg.)
ix. Prepare interconnection diagram between units, utilities and offsite. Detail battery limit
information for the Utilities and other interface will be provided to successful Bidder.
x. Prepare design basis and scope for package items.
xi. Review PFD, P&IDs and all other process documents required for the package items.
xii. Conduct P&ID review and revision after incorporation of all tie-in points and interfacing
points, package items, Hazop recommendations, recommendations from detailed
engineering and package suppliers, ABRPL’s comments etc One such review shall be
conducted at least 8 months ahead of mechanical completion of the project facilities.
xiii. Prepare process package for package items covering process duty specification, PFDs/ P&IDs
showing package scope, B/L interface and all other related basic engineering. deliverables like
equipment datasheets (outside package if any) including updating/modifying P&IDs outside
package B/L, instruments datasheets, line schedules etc.
xiv. Prepare Hazardous Area Classification Drawing.
xv. Submit all HMBDs and SLDs

xvi. Stores management philosophy-open warehouse vs covered storage, cold and hot storage

3.5.4 Hazop Study:

BIDDER shall
i. Undertake HAZOP study of unit and offsite/utilities.
ii. Undertake HAZOP review for the tie-in points along with connected facilities in offsite.
iii. Update all P&IDs incorporating HAZOP recommendations.
iv. Make HAZOP study report covering all details of HAZOP study including recommendations.
v. Prepare close out report before commissioning giving action taken on HAZOP recommendations

3.5.5 Detailed Engineering:

BIDDER to carry out detailed engineering by specialists such as civil, structural, mechanical,
electrical, instrumentation engineers etc… to cover all activities that are required for satisfactory
completion of the project as per the scope defined in this section but not limited to the following.
BIDDER to use computer aided designs to develop optimum layouts & designs to ensure
construction, operation and maintenance convenience.

3.5.5.1 General Civil:

BIDDER shall
i. Prepare design basis.
ii. Verify and update overall plot plan of refinery incorporating all facilities showing arrangement of
buildings, structures, tankages, roads, paving and other facilities
iii. Prepare site development drawings including roads, storm water disposal system, underground
sewage systems like storm water, industrial waste and domestic waste
iv. Relocate the project facilities in the areas identified by ABRPL within the existing Refinery
complex and prepare plot plan for the facilities
v. Prepare unit plot plan/equipment layout conforming to required standard.
vi. Prepare documents/drawing for CIF approval and assisting ABRPL in technical discussions with
regulatory authorities.
vii. Prepare PFD for extension of fire water network (including underground piping if required) in the
units
viii. Prepare U/G piping and other underground facilities drawing for collection of OWS / process
waste /CBD / CRW including hook-up with existing system and material take-off.
ix. Design Fire Protection System and prepare MR of all items required thereof. Fire water system
to have risers and monitors for technological structures, sprinkler system for hot equipment/fin-
fan coolers as per standard, if required.
x. Prepare cooling water layout
xi. Carry out technical evaluation of offers and prepare recommendations
xii. Review and approve vendor/contractors drawings
xiii. Prepare specifications for carrying out soil/water investigations as required including scrutiny of
report.
xiv. Prepare firefighting philosophy including inert gas based system for control room , Transformers
,Storage Tanks, etc.

3.5.5.3 Heat Exchangers:

i. Prepare design basis
ii. Carry out thermal design in accordance with the various codes.
iii. Carry out mechanical design indicating minimum requirements to suit the process operating
conditions
iv. Prepare mechanical drawings with sufficient details for residual design by the fabricators
v. Prepare Material Requisition (MR) for procurement.
vi. Carry out technical evaluation of bids and prepare technical recommendation.
vii. Review and approve drawings and documents prepared by exchanger manufacturer.
viii. Prepare tender inputs for installation, erection, testing and commissioning

3.5.5.5 Columns Internals / Demisters:

BIDDER shall
i. Prepare design basis
ii. Prepare data sheets of column internals and demisters.
iii. Carry out procurement activities including preparation of MR, offer evaluation, TBA, technical
recommendation and preparation of Purchase Requisition.
iv. Review hydraulic design of column trays/ packing and demisters made by vendors
v. Review mechanical design of column trays/ packing and demisters made by vendors in
accordance with various codes and standards to suit the process operating conditions
vi. Review and approve vendor drawings.
vii. Inspect, review and certify installation of trays.

3.5.5.6 Rotating Equipment:

BIDDER shall
i. Prepare design basis
ii. Prepare specifications

3.5.5.8 Piping:

BIDDER shall
i. Develop detailed plot plans fixing the co-ordinates and elevations of all equipment, outlining the
requirement of structures and platforms, determine the routing of all buried and above ground
pipelines, electrical and instrument cable routing and carry out detailed engineering of the
complete system.
ii. Prepare design basis
iii. Prepare equipment layouts, piping layout drawings with true-to-scale representation of all runs,
fittings, valves, expansion loops etc.
iv. Carry out stress calculation, flexibility analysis and review of configuration.
v. Carry out system integral analysis, if applicable.
vi. Prepare piping GADs.
vii. Prepare IBR system isometric drawings along with IBR package
viii. Prepare isometric drawings for all piping
− Prepare material take off (MTO) based on Piping Material Specification given in BEDP.
The number of MTOs shall be restricted to four i.e. Preliminary, Intermediate, Final
&Top-up MTO.
− The engineering should be done in such a manner that it does not overshoot and client
is not recommended to place order for piping material every now and then. 95% of the
piping material should be covered in the first 03 MTOs.
− the engineering should consider special requirements and solutions for handling of pulp
ix. Prepare Material Requisitions and evaluate offers i.e. technical bid analysis, technical
recommendations, Purchase Requisition with agreed deviations, etc…
x. Review and approve vendors documents
xi. Prepare detailed specification for insulation, painting and steam tracing.
xii. Carry out design of supports, anchors, expansion loops, hangers etc… including special
equipment supports.
xiii. Prepare tender inputs with detailed specifications and quantities for fabrication including NDT,
erection, insulation & painting, testing, flushing and commissioning of piping.
xiv. Carry out technical evaluation of tenders and recommendation for the same.
xv. Carry out field engineering for obtaining site details and site verification for preparation of
approved for construction (AFC) drawings, and for trouble shooting at site etc…

xvi. Carry out identification of hook-ups and preparation of hook-up drawings/sketches. For process
streams, tie in points to be shown in the P&ID and actual location to be decided during Detail
Engineering. For utilities, tie in points to be decided after adequacy check by EPCM Bidder.
xvii. Carry out 3-D modeling and hold stage wise model review. Ensure that there are no stresses in
the pipes.
xviii. All buried pipes shall have wrapping and coating with cathodic protection

3.5.5.9 Package Equipment:

BIDDER shall
i. Prepare specification of package equipment
ii. Prepare Material Requisition (MR) for procurement.
iii. Carry out technical evaluation of bids and prepare technical recommendation.

iv. Check adequacy of existing electrical system for tapping power for new sub-station
v. Prepare cable layout diagrams.
vi. Prepare lighting layouts
vii. Prepare cable schedules, panel schedule and LC schedule.
viii. Prepare Motor Data sheets, Cable Data sheet, Panel Data sheet and any other Electrical
equipment data sheet as applicable
ix. Prepare interconnection drawing – Electrical-Electrical, Electrical –Instrumentation/DCS as per
requirement.
x. Develop electrical sub-station layout drawings for modification, if required.
xi. Prepare electrical area classification drawings.
xii. Prepare Material Take Off, purchase specifications of all electrical equipment, lighting
accessories, cable, motors, bulk items and other electrical equipment and materials.
xiii. Carry out technical evaluations of offers and prepare technical recommendations.
xiv. Prepare equipment layouts showing location of electrical equipment and power and control cable
routing.
xv. Prepare relay coordination chart considering the facilities added.
xvi. Prepare working drawings for installation of equipment.
xvii. Prepare cable/earthing layout and arrangement for lightning protection, for the whole plant
wherever required.
xviii. Prepare standard installation drawings for power lighting and earthing installation.
xix. Review and approve vendors drawing and data.
xx. Prepare specifications of complete electrical installation work with schedule of quantities.
xxi. Carry out electrical system study of the existing facility for integration of new facility, and prepare
a report of the study, implement study recommendations wherever required. Existing single line
Diagram, short circuit rating of existing switchgear, feeding substations etc. will be collected by
BIDDER from ABRPL.

3.5.5.11 Instrumentation, control and Automation

BIDDER shall
i. Prepare Instrument Control and automation design basis and philosophy
ii. Instrument design shall be made considering minimum hardware in Control Room. Advantages
of Foundation Field Bus shall be fully explored / utilized to transfer maximum instrumentation
hardware to field and minimize Control Room load. However, all critical controls like compressor
controls, anti- surge control, over speed control & trip, ESD controls, reactor indications,
cascade loops, etc shall be conventional hardwired
iii. Design cable entry & cable tray layout inside the Control Room in such a manner that power,
control & signal cables are well segregated with sufficient space for accommodating all cables in
scope with provisions for additional cables & future expansion. Enough care will be taken in
design to avoid cable congestion leading to overcrowding of cables in cable routes and
consequent fouling with false floor.
iv. Control room shall be equipped with its own UPS & Battery system, HVAC system, Fire & Gas
Detection & Flooding systems conforming to norms
v. EPCM shall design the control philosophy and description of control loops in such a manner that
third party control systems are avoided and all control & shutdown logics are built in the main
DCS/PLC. Wherever unavoidable due to proprietary design, the philosophy to be adopted shall
be at par with the main DCS/ PLC so that the redundancy, operation functions, trending, alarm
annunciations, etc are not less than facilities available in main DCS/ PLC
vi. Design & size field cable route, ducts, trays, road crossings, etc is such a manner that at no point
along the cable route up to the Control Room, there is any cable overcrowding/ congestion
vii. Carry out sizing of control valves, safety valves, pressure relief valves and flow elements
viii. Design and prepare complete specifications of various components, items of all control loops
e.g. control valves, safety valves, ON/OFF valves, Direct/ DP transmitters, Recorders,
Controllers, Signaling systems, Interlocking and Tripping Systems, Level Gauges, Pressure
Gauges, DP Gauges, Thermometers, Gas Detectors, Analyzers etc…
ix. Prepare purchase specifications, MR, technical evaluations, TBA, technical recommendations,
purchase recommendation etc… for all instrumentation elements including DCS & PLC
x. Prepare tender inputs
xi. Carry out technical evaluation and recommendations
xii. Review/approve vendor drawings
xiii. Prepare instrument schedules giving complete bill of materials for all items such as temperature,
level and pressure gauges, pressure switches, solenoid valves, transmitter, controllers,

xxi. Design all inter-system hook-up including testing/ simulation procedure for DCS-PLC (Main),
DCS – PLC (Third Party), Gas Detection – DCS, Fire Alarm-Clean Agent, etc and mandate clear
cut responsibility on the suppliers to avoid confusion on the scope for seamless testing &
commissioning
xxii. In any Instrumentation package, wherever foreign & indigenous supplies are involved, EPCM
shall ensure that all deliverables are included with clear responsibility at both ends to avoid any
kind of dispute at any stage during procurement, supply, installation & commissioning. The onus
on proper liaison between the Principal & Indian agent would lie solely on EPCM Bidder.
xxiii. Design and installing of CCTV camera in Bio refinery Site with access on mobile phones

3.5.6 Procurement Services & Contracts Assistance:

BIDDER shall perform the following services for procurement of all indigenous and imported
equipment and materials, except for civil construction materials like reinforcement steel, cement,
sand, aggregates, bricks, timber etc. and other materials, fittings and fixtures which would be
supplied by the concerned construction contractors.
i. Prepare procurement and tendering procedure and obtain ABRPL’s approval.
ii. Provide procurement and contract services in accordance with aforesaid agreed procedure.
iii. Provide procurement services for all items required for implementing the project.
iv. Provide contract services for all tenders required for implementing the project.
v. Identify commissioning, mandatory and two years operational & maintenance spares and the
same shall be procured along with the main items. The requirement of these spares shall be
specified in the enquiry document.

The detailed scope of procurement and contract services is given below.


a) Prepare Vendor List for the procurement of different type of material to be approved by ABRPL.
Safety Management system and Code of Conduct to be conveyed to Vendors
b) Prepare RFQ documents/tender documents and invite quotations for materials (both indigenous
and imported items) and contracts.
c) ‘General Purchase Conditions’ and ‘General Conditions of Contract’ of ABRPL shall be an
integral part of all tenders, as the case maybe i.e. procurement or contract respectively. SCC

shall be prepared by BIDDER for works contracts covering specific special requirements of the
project in consultation with ABRPL.
d) In case of Tenders for works contracts, BIDDER shall provide detailed estimate before floating of
tenders. BIDDER to ensure all estimates are realistic and based on updated inputs. For press
advertised tenders, cost will be borne by ABRPL. Bidder will prepare the short NIT and ABRPL
will publish the same in newspapers.
e) In case of material procurement, BIDDER shall provide cost estimates for MRs before price bid
opening.
f) Receive technical and commercial bids, technical evaluation of bids, raising of technical and
commercial queries (if any) to the vendors / contractors, seeking clarifications. BIDDER will open
the price bids in presence of ABRPL representative, carry out commercial evaluation, prepare
purchase recommendation and forward the same to ABRPL. ABRPL will place purchase orders
on technically and commercially acceptable vendors, with intimation to BIDDER.
g) Provide services for re-floating/re-tendering for purchases/contracts, if required.
h) Prepare draft Fax of Acceptance (FOA), Purchase Order and Order Amendments.
i) Prepare draft Letter of Acceptance (LOA) and statement of agreed variations to enable ABRPL
release LOA for tenders.
j) Prepare amendment to purchase orders/contracts, if required.
k) BIDDER shall include in Purchase Orders and contracts a requirement for guarantees from
material suppliers, contractors and package vendors against defective material or poor
workmanship, and also the BIDDER shall assist ABRPL in the enforcement of such guarantees.
BIDDER to obtain documents from suppliers, contractors and package vendors etc… in the
prescribed format and submit to ABRPL.
l) Follow-up and liaison with equipment vendors for clarifications of technical details and approval
of drawings, wherever required. In case of any deviations, ABRPL’s consent to be taken.
m) Certify after thorough scrutiny extra claims if any by contractors and submit their
recommendation complete with rate analysis to ABRPL to effect payment.
n) Initiate procurement action for replacement of shortage/damaged items of indigenous/imported
purchase orders.
o) BIDDER to render their service for route survey and transportation of major equipments and
Over Dimensional Consignments up to the work site.
p) In case of any damage to the equipment during transportation, BIDDER to depute their
Engineers/inspectors/specialists etc for carrying out necessary study to assess the damages and
implement recommendation for rectification, if required.

Suitable formula for variation of price for cement, reinforcement steel and structural steel shall be
incorporated in tender to take care of abnormal price variation during contractual period.

3.5.7 Inspection & Expediting Services:

BIDDER shall
i. Carry out inspection of all indigenous equipment, machineries, material at vendors/sub-
vendors/package vendors/contractors works as deemed necessary to ensure compliance with
design, codes/specifications and good engineering practices. This shall include raw material
certification, mill or foundry inspection of critical parts, and final inspection, wherever required.
ii. Arrange third party inspection for imported materials and equipment through vendors and include
the same in purchase orders (cost to be borne by ABRPL). Review the third party inspection
agency’s inspection reports and advice vendor for dispatch.
iii. Check dimensions on final assembly and witness unit test/performance test/shop test.

iv. Inspect materials of critical duties to be procured from within India followed by progressive
inspection and non-destructive tests/dimensional checks in the shops.
v. Perform inspection at works of supplier/sub-supplier/contractor/sub-contractor any where in
India.
vi. Expedite all purchase orders (covering indigenous and imported equipment and materials) with
vendors/sub-vendors/contractors regularly to ensure delivery as scheduled.
vii. Submit consolidated expediting report (Material Status Report) on status of procurement on
monthly basis.
viii. Follow–up with vendors for submission of IBR Certificates and ensure submission of approved
final vendor drawings.
ix. Post expeditors at the works of vendor/sub-vendor/contractor/sub-contractors for critical and
major items as required and mutually agreed.
x. Ensure inspection at vendor/sub-vendor’s works within two days of inspection call by vendor.
xi. Carryout inspection of field welding for assembly of equipment which are supplied in more than
one piece by vendors/contractors.
xii. Certify completeness of documents to be submitted by vendors as per terms & conditions of
contract
xiii. Define Customer Hold Points, QAPs and 3rd Party Inspection

3.5.8 Construction Management & Quality Assurance:

• BIDDER shall be responsible for overall construction management of all construction areas of the
Bio- Refinery Project. Bidder will establish requisite site organization staffed by competent and
experienced specialists to meet the project schedule.

• BIDDER shall take necessary action for establishing enabling facilities for smooth execution of the
project by deploying adequate manpower at site. A multi-disciplinary team to visit site immediately
after placement of FOA/ LOI to identify the requirement of enabling facilities and take action for
implementation.

• Following minimum manpower shall be placed by the Bidder at site towards construction
management & quality assurance:

• All manpower deployed at HO/Site shall be in the permanent role of the EPCM Bidder. No hired
(temporary) staff shall be acceptable.

• Above manpower is a minimum requirement only. In case of site requirement BIDDER to provide
adequate man-months as and when required. ABRPL will not compensate for any extra man-month
that is deemed necessary for completing services within schedule as detailed in this tender.

• Resident Construction Manager (herein after referred to as RCM) shall be engineering graduate
having requisite experience.

• Technical Personnel posted at site will be transferred in consultation with the client only.

• BIDDER to submit ‘Organization Chart’ proposed for this Project.

• Construction management services shall include but not be limited to the following:

i. Organize, plan and manage the construction work as a whole.


ii. Prepare execution methodology and erection philosophy independently, considering safety rules
and regulations of ABRPL, for the entire Project considering all the phases of work i.e.
Civil/Mechanical/ Electrical/Instrument.
iii. Barricade the construction areas properly for facilitating issuance of Safety Work Permit for a
longer duration
iv. Fix construction programs, detailed schedules, targets, etc with the construction agencies and
periodical review the same.
v. Bidder to ensure flow of materials to site as per site requirements.
vi. Coordinate, inspect and expedite work of contractor in order to secure completion of contracts in
conformity with plans, specifications and approved schedules.
vii. Preparation & submission of weekly and monthly progress report of site work
viii. Review and approve erection schemes submitted by contractor
ix. BIDDER to ensure preparation of loop files for piping as per execution methodology and maintain
loop-wise status.
x. BIDDER will work out the detail requirement of cranes/lifting equipment i.e. types of cranes
required inclusive of loading capacity, boom length, etc…Mobilization of these cranes/lifting
equipment to be included in the scope of the mechanical contractor.

xi. BIDDER to maintain proper records for issue of material to contractors with line details and
consolidated list shall be made available to ABRPL once in a month.
xii. BIDDER to maintain proper records on radiographic inspection with respect to line numbers,
joints numbers, details of balance joints to be radiographed etc… and the films shall be kept in
the custody of BIDDER during construction.
xiii. BIDDER to ensure that the materials issued by ABRPL are safely and properly stored. BIDDER
to also ensure that the pre-fabricated spools are properly numbered & stacked.
xiv. Certify quality and quantity of work performed by Contractor and maintain necessary records
required for verifying contractor’s bills according to condition of contracts.
xv. Analyze extra claims, if any, and forward recommendations to ABRPL.
xvi. Process recoveries from contractors for issue of materials hire charges, rents and taxes etc… as
per contract provisions.
xvii. Arrange services of vendor specialists as required for satisfactory execution of erection and
mechanical trial run, in terms of respective contracts.
xviii. Prepare construction progress report, construction schedule, material shortage reports, action
plan and other reports as required by ABRPL.
xix. Provide field engineering services as required for successful completion of the PROJECT. The
required engineering team shall be posted as and when required at site for this purpose.
xx. Provide calibration reports and test reports.
xxi. Prepare and arrange to liquidate check list/punch list for mechanical completion and
commissioning. Bidder to intimate ABRPL on mechanical completion each loop, on liquidation of
check list provided by ABRPL, on completion of testing etc… to enable ABRPL to make
arrangements for pre-commissioning / commissioning.
xxii. Provide contract assistance at site for site tenders, which shall include preparation of vendor list,
cost estimate, tender document, NIT, tendering, evaluation of offers, recommendation to ABRPL
for award, preparation of draft LOI / purchase order, etc…
xxiii. BIDDER shall supervise, witness and approve assembling and alignment (Hot/Cold) of all rotary
equipment and machinery by contractors.
xxiv. Visual Inspection of all incoming materials and package items for identifying any damage during
transit and short supply and to submit suitable reports to supplier &ABRPL.
xxv. Identify the requirement of construction power/water and provide input for tendering.
xxvi. Identify technical deviations from specification, in the work being executed by construction
contractors, and suggest further course of action.
xxvii. Ensure Inspection and Quality Assurance for the total project works at site.
xxviii. BIDDER will maintain material consumption as per specific and approved BOMs prepared for the
work and will ensure that there is no unnecessary wastage or consumption.
xxix. Bidder to scrutinize and certify all bills/invoices of contractors/suppliers and forward to ABRPL for
releasing payment. Bidder to prepare and raise GRN for goods receipt in ABRPL’s ERP/ SAP
system.
xxx. Material reconciliation for contractors bills settlement.
xxxi. BIDDER shall ensure contractor compliance with statutory labor laws/rules.
xxxii. Assistance in responding to queries by audit/ statutory authority for a minimum period of 18
months from date of Mechanical Completion of the last facility in the PROJECT.
xxxiii. BIDDER to provide their services till closing of all contracts.
xxxiv. Assistance to ABRPL for arbitration if required for a minimum period of 18 months from date of
Mechanical Completion of the last facility in the PROJECT.

• BIDDER’s RCM shall be stationed at site and shall have overall responsibility for the site. The RCM,
supported by a team of adequate engineers (as detailed at the beginning of this clause) and
administrative staff, will supervise and direct the field technically and administratively. RCM will also
arrange to direct the contractors to have adequate men and equipment to meet the overall

construction schedule and prepare construction Progress Report/ Construction Schedule and other
reports. The RCM shall
a) Liaise with BIDDER’s project office in order to ensure adequate & timely flow of drawings, data,
equipment & material to the field and for Engineering/Procurement related works.
b) Convene review meeting regularly once in a week time or as per the requirement of the work site
with ABRPL and Contractors.
c) Take part in the kickoff/review meeting with contractors/package vendors.
d) BIDDER to arrange for direct handling of test coupons/cubes from the site to the authorized lab
which are approved by ABRPL. These shall not be handled by the contractors.
e) Maintain the following registers / records and make available to ABRPL as and when required.
− Hindrance Register for each contract in ABRPL approved format
− Measurement Book
− Site Order Book (SOB)
− Safety Register
− Material issue registers.
− Radiography register for each contract
− Manpower deployment register for each contractor.

• Bidder is also responsible for control of entire material and ware house management system to
ensure proper receipt of equipment and material at site, inspection, verification, storage, issue of
material for sequential and systematic execution of the contract, identification of surplus material,
handing over of the same and the spares to ABRPL, uploading of above transactions in ABRPL SAP,
certification of invoices for payment, etc. Bidder can operate his own Stores Management System.
However, material receipt has to be entered in ABRPL’s SAP system by Bidder. BIDDER shall
 Develop material control system/procedure and obtain ABRPL approval.
 Verify and certify material issue and return statements of all contractors.
 Receive the spares supplied by contractors and hand over to ABRPL with cost break up.
 Prepare material receipt, issue and inventory status to ABRPL once in a fortnight.
 Furnish advance plan of storage, both covered and uncovered, of materials and in case the
present available space falls short of the requirement projected by the Bidder, give necessary
inputs (design, estimate, etc…) for construction of the same.
 Line up agencies for material handling, if required, payment for which will be made by ABRPL.

3.5.9 Pre-Commissioning/Commissioning Assistance:

BIDDER will assist ABRPL to co-ordinate the start-up and commissioning activities of various
equipments, systems & plants including electrical and control systems. For rendering these services,
BIDDER will depute suitable Operation/Commissioning Engineers at appropriate time. Scope of
Operation/Commissioning Group shall be as given below.

Pre-Commissioning:

i. Organize and prepare detailed operating manuals for each system/unit based on in-house
data, licensors manuals/information, data from equipment vendors etc…
ii. Review pre-commissioning, commissioning and standard procedures for start-up, normal
operation, shutdown and handling of abnormal situation.
iii. Prepare detailed start up/commissioning procedure, schedule and program.
iv. Review operating manual prepared by Licensors / package vendors.
v. Joint inspection with process licensor for the licensed units as per licensor’s protocol and
implement the recommendations of the licensors.

vi. To carry out system check as per licensor protocol wherever applicable.
vii. Ensure that all the pre-commissioning/commissioning activities of the Project are carried out
in accordance with established procedure, schedules and program, as detailed below.
- Flushing, blowing and chemical cleaning.
- Check vibration, governor trip/safety device & other required operating tests/adjustments.
- Hot alignment checks and running of components parts as a unified system.
- Adjustments and replacements of mechanical seals, packing and accessories as required.
- Installation of temporary screens, strainers, and blinds.
- Checking for installation of appropriate gaskets.
- Necessary purge operations, including installation of temporary purge piping or hoses to
equipment connections.
- Checking of bores of orifice plates and installing them after flushing operations.
- Functional check on all instruments and controllers.
- Instrument calibrations with standard test equipment& required adjustments/settings.
- Check all instrument loops for proper functioning.
- Checks on pipe hangers, supports/guides for hot/cold settings and necessary adjustments.
- Checking and recording positions of all valves.
- Conduct simulation runs to allow run-in and operational testing of the equipment.
- Ensure that defects and deficiencies found during the course of commissioning are rectified
by contractor/ supplier.
- Preparing punch/check lists for verifying mechanical completion
- Advise ABRPL of satisfactory completion of pre-commissioning activities and recommend
issuance of certificate for relevant part of project.
- Give Check-List ,Testing Procedures and Acceptable Limits

Commissioning and Start-up Management:

During this phase, BIDDER shall provide necessary assistance to ABRPL in planning and organizing
commissioning, start-up and performance test run of the Project facilities, in due co-ordination with
process licensors and contractors. The Bidder’s scope of work will comprise of but not limited, to the
following:
i. Set-up, review and implement start-up program.
ii. Coordinate and supervise commissioning schedules, start-up schedule, etc… with process
licensors, contractors, machinery suppliers, and others.
iii. Perform comprehensive pre-startup inspections of all completed equipment and systems and
supervise all activities for equipment check-up including certification of its proper functioning.
iv. Ensure that Contractor provides sufficient manpower, special tools and spare parts
necessary for assisting commissioning activities given below.
− Operational tightness testing.
− Pre-startup inspections by governmental bodies, as necessary
− Loading of chemicals
− Filling of lubricants
v. Certification to the effect that the plant has been installed as per the codes and standards.
vi. Bidders commissioning personnel shall be available at plant site as per agreed schedule and
get involved with the process licensor and ABRPL personnel to carry out the commissioning
activities. The action as advised by the process licensor to be actively sought and followed.
The actual plant operation shall be done by ABRPL personnel under advice from licensor.

Testing & Commissioning:

The following work will be performed by BIDDER until the Project is ready for commercial operation.

i. Review of Operating Manual in consultation with process licensor wherever involved.
ii. Supervise/monitor check-up and calibration of various instruments used in plant system
commissioning and testing.
iii. Supervise all activities for commissioning and testing of various sub-systems and of the
whole system, all in accordance with the startup schedule.
iv. Develop criteria for initial and final acceptance
v. Analysis and evaluate test results obtained during testing and commissioning in order to
determine actual performance of equipment, sub-systems and the whole plant against both
construction contract requirements and Licensors/Contractor(s) guarantees.
vi. Preparation of a check list of all defects, deficiencies, shortages etc… and development of a
program for their correction and completion. Corrective action with respect to Malfunctioning
of any equipment during commissioning shall be proposed by EPCM Bidder in consultation
with the vendor.
vii. Advise ABRPL to review and approve performance test procedures provided by
contractors/licensors and specify, among other things, the following:
− Operating data to be recorded in a log sheet
− Sampling methods
− Analytical methods
− Methods of calculations
− Interpretation and measurement of tests
− Manner of taking operating data and its frequency
− Manner of evaluating performance of the unit, raw material consumption, utilities
consumption and energy consumption, yields etc… including appropriate corrections if any
for test conditions such as feed stock quality etc…
− Ensure that performance test of all units are performed in accordance with professional
engineering standards, plant safety and operating standards.
− Evolve acceptable formats for handing over plants to ABRPL including all required
documentation, completion certificates etc… and recommend to ABRPL regarding taking
over of facilities.

3.5.10 Health, Safety And Environmental Guidelines:

Bidder shall establish, operate and maintain the HSE programme for the term of the contract. He
shall be responsible for the implementation of HSE programs by contractors.

BIDDER shall ensure contractors comply with safety measures. BIDDER will appoint a sufficiently
experienced person (as detailed in Clause 3.3.8) to be designated as Safety Officer and will ensure
safety of work at site as per ABRPL Safety Rules in consultation with ABRPL Safety Department.
BIDDER shall comply with all rules, regulations and orders of various statutory authorities, insurance,
Engineer-In-Charge of ABRPL etc… at no extra cost to ABRPL. BIDDER shall also depute adequate
officers for safety coverage round the clock including Sundays and holidays. BIDDER shall maintain
safety register for each contractor and report any accident/incident immediately to ABRPL in
ABRPL’s prescribed format. BIDDER shall submit weekly report on HSE compliance by contractors
working at site.

BIDDER shall at their own expense, provide and maintain sufficient first aid boxes at their
workstations at site.

3.5.11 Documentation:

BIDDER shall prepare a Master Document Index (herein after referred to as MDI) for the entire
project (including vendor drawings/documents) which shall be serially numbered and this will be the
master database to ensure completeness of documentation. MDI with search facility shall be
forwarded to ABRPL along with the ‘As Built’ drawings and final documents to ensure that all
drawings are received by ABRPL. Traceability of Document shall be clearly defined.

Further BIDDER shall:


 Provide 1 hard copy + 1 copy of RTF + 1 editable soft copy of final PFD, P&ID, Design Basis,
tender document/RFQs quotation , datasheets, equipment list , instrument list , list of hand valves
, Equipment General Arrangement Drawings, Piping General Arrangement Drawings /Isometrics,
Support Specifications, Material Take Off (MTO), Line Schedule, Electrical Drawings / Documents,
Instrumentation Drawings / Documents and Civil / Structural Drawings. Amendments,
additions/deletion, DCNs (Document Change Notes), if any, shall be forwarded to ABRPL
subsequently.
 Provide 1 hard copy + 1 copy of RTF + 1 editable soft copy of documents obtained from
equipment suppliers / package contractors, etc. in bound volume for ABRPL’s monitoring and
reference as and when they are finalized.
 On completion of the PROJECT, BIDDER to submit 1 Hard Copy + 1 Original in RTF+ 1 Editable
Soft Copy (Auto CAD) of ‘As Built’ drawings of all PFD, P&ID, GAD,ISOMETRICS, and all piping,
equipment, civil and structural, electrical, instrumentation drawings, VENDOR Drawings and other
final documents of the PROJECT including those given below. All drawings drawn in Auto CAD
shall be submitted in Auto CAD latest version BIDDER to also submit 3-D model (in PDS/PDMS)
on PROJECT completion.
i) Purchase Requisition
ii) Final approved vendor drawings
iii) Material test certificates
iv) Stage-wise inspection reports
v) Radiography and other NDT reports.
vi) SR reports
vii) Performance test reports for rotary equipment.

 On completion of the PROJECT, BIDDER to submit 1 Hard Copy + 1 Original in RTF+ 1 Editable
Soft Copy (Auto CAD) of the following
1. Operating and maintenance manuals for all equipments including bought out components of
package equipments if any.
2. Operation and Maintenance Manual for all additions.

SECTION - IV

PROJECT SCHEDULE

4.1 Time Schedule:

As the Bio-refinery project has to be implemented on fast track basis as such EPCM Bidder must
take all requisite action particularly for the placement of adequate no. of experienced and
knowledgeable experts in each and every area/ activity to complete the project within the agreed time
schedule.

The BIDDER will commence the work immediately on issue of Fax of Acceptance (FOA)/ LOI. Date
of Issue of FOA will be considered as ‘Zero Date’. Project Mechanical completion (as specified at
Clause 4.2) shall be 28 months from ‘Zero Date’. Commissioning and availability of Marketable
Product from BIO-REFINERY by BIDDER shall be considered as 3 months from Mechanical
completion.

Bidder in his offer shall provide a Schedule of Work showing the dates / period for the Project
Activities. The Schedule of Work shall be in the form of a bar chart schedule or schedules covering
all aspects of the PROJECT (including milestones) from award of FOA to Mechanical Completion of
the PROJECT considering the various activities detailed in this document.

Time of completion of the project as specified herein is the essence of the contract. The time for
performance/completion of supplies/contracts will be duly covered along with applicable liability
clause in the purchase orders/contracts and BIDDER will maintain adequate follow-up/generation of
documentation to monitor suppliers/contractors progress and assist ABRPL in claiming the
liability/damages as per the purchase orders/contracts.

4.2 Mechanical Completion:


Mechanical Completion shall be achieved when the constructions of the unit/area/system/plant has
been completed, all civil construction works is completed., all equipment and machinery are installed
and aligned, all piping and instrumentation work is completed, all electrical work is completed, all
hydrostatic and pneumatic testing is done, speed and direction of rotation of all prime movers are
checked, liquidation of all the check-list generated by ABRPL. On achieving mechanical completion,
BIDDER shall notify ABRPL that the unit/area/system/plant is ready for pre-commissioning activity.
Setting devices and recorders etc. though generally a part of Mechanical Completion, shall be taken
up concurrently with the commissioning activities. Mechanical completion shall also include
completion electrical and instrumentation system.

4.3 Liquidated Damages:

Failure of BIDDER to make available Marketable Product from BIO-REFINERY within 28 months
(+03 months for commissioning) of issue of FOA would attract Liquidated Damages as detailed
below.

100% Project Commissioning of the PROJECT shall be achieved as per the time schedule detailed in
Clause 4.1 of this document titled ‘Time Schedule’ to the full satisfaction of ABRPL and in case the
BIDDER fails to achieve ‘Project Completion’ within the stipulated period from ‘Zero Date’, BIDDER
shall pay Liquidated Damages at the rate of 1% of lump-sum fee per week of delay and prorated for
part thereof, subject to a maximum of 10% of the lump sum fee. The Parties agree and recognize that
any delay shall cause financial and other loss to ABRPL, and the Liquidated Damages mentioned
herein is intended to mitigate such loss to some extent. Any delay on the part of Bidder except natural
calamities will also be accounted for while exercising this clause.

SECTION -V

REMUNERATION

5.1 Bidders shall quote ‘Lump-sum Fee’ for the scope of services of this tender.

5.2 ‘Lump-sum Fee’ quoted by Bidders shall exclude taxes and duties, which shall be reimbursed by
ABRPL at actuals against documentary evidence. Income tax shall be to Bidder’s account and shall
be deducted as applicable at source.

5.3 Lump-sum Fee’ as mentioned above shall not include cost towards any international travel in
connection with this work. If any such travel is required, ABRPL will pay for travel expenses including
air fare, lodging, out of pocket expenses, visa expenses, travel insurance expenses as may be
mutually agreed.

5.4 The BIDDER will complete the project in it’s entirety within the quoted “Lump-sum Fee’ and there will
be no ‘Change Order’ as all facilities required for safe operation are deemed to be included in the
scope of services of the EPCM BIDDER.

5.5 Bidder shall quote rate for man-efforts on overseas travel / services on per-diem rate basis. Such
overseas services shall be executed as per requirement of ABRPL and with prior written consent of
ABRPL.

5.6 No extended stay compensation will be paid except for natural calamity.

SECTION -VI

TERMS OF PAYMENT

6.1 BIDDER’s ‘Lump-sum Fee’ shall be payable in the following manner:

1) Payment Terms:

A) 3% : On completion of kick off meeting, Review /checking of Licensor’s BEDP, Residual Process
Design.

B) 5% : On design of non license units, offsite /utility P&D and submission of Project Schedule and
Milestones.

C) 75% : Payment shall be made considering average of “ Physical Progress of Project and EPCM Services
Progress” as defined below for release of monthly Running Account (RA) bill payment till
Mechanical Completion based on certification from EIC.

D) 2% : On signing of mechanical completion document

E) 5% : On successful commissioning

F) 5% : On handing over of final documents

G) 5% : On closing of all contracts.

SECTION -VII

WARRANTIES & GUARANTEES

7.1 The BIDDER shall guarantee the services as specified and described in this tender document and
the technical documentation to be developed will be in accordance with sound and established
engineering practices using international standards and Indian codes / regulations wherever
applicable, for the purpose specified, free from defects& deficiencies and suitable for respective uses
intended.

BIDDER’s obligation to manage, design and develop the work correctly and the general warranties
set forth above shall not be reduced or affected by any inspection, test, acceptance or payment
made by ABRPL and/ or ABRPL’s approval of any design, drawing or specification, or by the issue of
the Certificate of Acceptance of the work or any re-performance or replacement of any part of the
work.

7.2 REMEDIAL MEASURES:

7.2.1 Notice: At any time, but not later than 24 months from date of mechanical completion or 12 months
from the date of commissioning, whichever is earlier. ABRPL may by notice in writing to BIDDER ask
for remedy of any defect in work by re-performance by BIDDER.

7.2.2 Obligation to remedy breach: BIDDER shall be obligated to affect, at its own expense, in the shortest
practicable time, such re-performance of work as are necessary to remedy such defect. BIDDER’s
obligation to remedy any defects shall expire unless a notice as contemplated in 7.2.1 hereinabove is
served within 24 months after mechanical completion or 12 months from the date of commissioning,
whichever is earlier. In case of any defect or deficiency in the work which has not resulted from a
failure by BIDDER to perform its obligations under this Contract, BIDDER shall nevertheless correct
such defect or deficiency and shall be entitled to reimbursement of the costs subject to satisfaction of
ABRPL with documentary evidence of incurring such expenses. The amount of such costs shall be
agreed between the parties or in the absence of agreement, decided by ABRPL and reimbursed to
the BIDDER based on proof.

7.2.3 Programme for re-performance : As soon as practicable, and in any event within 5 days after receipt
by BIDDER of ABRPL’s notice under Section 7.2.1 above, BIDDER will within a mutually agreed date
not exceeding 15 days from the date of intimation mentioned in 7.2.1 hereinabove, submit for
ABRPL’s approval a plan for effecting the re-performance required to remedy such defect. If required
by ABRPL, BIDDER shall attend at the site or at place(s) specified by ABRPL to inspect the defective
work and where appropriate carry out repairs of the defective work.

7.2.4 ABRPL’s recourse : If BIDDER does not begin its plan for re-performance within the time mutually
agreed, or if BIDDER and ABRPL fail to reach agreement on such a program within 5 days of the
receipt by ABRPL of BIDDER’s plan submitted pursuant to Section 7.2.3, ABRPL after advising
BIDDER in writing, perform or have third parties perform such work as is necessary to remedy or
cause to be remedied such defect at the cost of the BIDDER. The cost incurred by ABRPL in this

respect will be supported by written documents and the BIDDER will be bound to accept such written
documents as proof of expenditure incurred.

If ABRPL is compelled to perform the Job which the BIDDER was supposed to do at the BIDDER’s
cost, even in that situation the BIDDER will be liable for the guarantees given under this Contract and
those guarantees will not be discharged.

7.2.5 Other rights and remedies: The rights and remedies of ABRPL provided in SECTION-VII are in
addition to any other rights and remedies provided at law or in equity or otherwise.

7.2.6 Neither party shall have any liability for any consequential damage, loss of revenues, loss of
production or loss of profits sustained by the other.

SECTION-VIII

ABRPL’s OBLIGATIONS

The following shall constitute ABRPL’s obligations under this contract till completion of the PROJECT.

8.1 Provide ‘As Built’ drawings/ details to the extent available for existing units/facilities and to the extent
it is required for detailed engineering of the new facilities.

8.2 Act as Principal Employer and deal directly with local administration, labour laws, audit queries, etc…
BIDDER shall provide necessary backup data.

8.3 Interact and liaise with statutory authorities including Petroleum & Explosive Safety Organization,
Pollution Control Board, Excise& Custom Authorities, Sales Tax Authorities, and CEA/Elect
Inspector. BIDDER shall provide required technical documents for clearance by these bodies.
BIDDER shall accompany ABRPL to provide technical assistance, if necessary.

8.4 Arranging hot/ cold work permits for working in the existing areas.

8.5 Enter into contract agreement with Licensors/ Contractors/Vendors.

8.6 Handle litigation dispute, arbitration cases, if any. BIDDER will provide required technical assistance
to ABRPL.

8.7 ABRPL shall provide to the BIDDER, Office with utilities/ amenities, warehouse with utilities/
amenities, intercom, telephone (landline), fax, photocopier, Desktop PC, printer and LAN connection,
furnished bachelor / family accommodation for the staff, local transportation - for the staff for office,
transportation from Airport/ Railway Station to site and back for visiting personnel of BIDDER, guest
house/ hotel accommodation (only lodging) at site for visiting personnel of BIDDER. Cost towards
office stationeries of BIDDER shall not be borne by ABRPL.

SECTION-IX

INTELLECTUAL PROPERTY RIGHTS

9.1 All manner of documentation (both hardcopies and softcopies) prepared by the BIDDER pursuant to
the contract for providing EPCM Services for ABRPL’s BIO-REFINERY Project, shall be deemed to
be ABRPL’s intellectual property, and cannot be copied or disclosed to any third party without
obtaining specific written approval from ABRPL. Therefore all manner of project documentation
prepared by the BIDDER shall carry a disclosure to this effect.

9.2 BIDDER shall at all times indemnify and hold harmless ABRPL from all liabilities, costs, damages
and expenses arising out of any claims, actions or suits brought against ABRPL by third parties or
any related claims thereof in respect of any actual or alleged infringement of, patent rights or
registered design or copyright or trade secret or trademark or other intellectual property right or any
similar rights resulting from the use of technology or technical information or any improvements
thereof, provided by BIDDER to ABRPL. Upon ABRPL's prompt notification to BIDDER in writing of
any such claims, actions or suits, upon such notice or upon BIDDER otherwise coming to know of
such claims, actions or suits, BIDDER shall, at its own expense, conduct, defend or dispose of,
including settling of such claims, actions or suits on its own behalf and on behalf of ABRPL and are
obliged to follow all instructions from ABRPL in this respect.
