MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THIS PRESENT:

This agreement made and entered into by and between:

The REGIONAL HUMAN RIGHTS COMMISSION (RHRC) with postal address IF

JICA Bldg., ORG Compound Cotabato City, represented by ATTY. ABDULNASSER A.

BADRUDIN herein referred to as PARENT AGENCY.

and

The DEPARTMENT OF SOCIAL WELFARE AND DEVELOPMENT (DSWD), ARMM

with postal address at ORG Compound Cotabato City, represented by ATTY. ALAISA

MASUHOD-ALAMIA herein referred to as RECEIVING AGENCY.

WITNESSETH, that:

WHEREAS, the OIC Regional Secretary of the RECEIVING AGENCY, ATTY. LAISA

MASUHOD ALAMIA requested that ATTY. EDY LYNN S. SANTIAGO be detailed in

her office to act as her Chief of Staff;

WHEREAS, the PARENT AGENCY authorize the detail of Atty. EDY LYNN S.

SANTIAGO, Attorney VI to Department of Social Welfare and Development-ARMM

(DSWD) office, the receiving agency;

NOW, THEREFORE, for and in consideration of the foregoing premises, the PARENT

AGENCY and the RECEIVING AGENCY mutually agree and stipulate the following:

A. THE PARENT AGENCY shall:

2. Authorize the detail of ATTY. EDY LYNN S. SANTIAGO, Attorney VI to the


Department of Social Welfare and Development-ARMM for a period of one (1)
year effective January 22, 2018 renewable every year; as conferred by the

detailed.

3. During the detail, the PARENT AGENCY relinquishes the administrative

supervision and control over the detailed employee.

4. Have the authority to discipline the detailed employee where she belongs. As

used herein, the authority to discipline includes the determination of the

existence of a prima facie case against the detailed employee, issuance of a

formal charge, issuance of the order or preventive suspension if the case so

warrants, conduct a formal investigation, and rendering of the decision on the

administrative case.

5. Has the jurisdiction to all human resources actions and movements, including

monetization of leave credits, concerning the detailed employee,

notwithstanding that the detailed employee is detailed in the RECEIVING

AGENCY;

6. Pay the monthly salary of the detailed employee;

B. The RECEIVING AGENCY shall:

1. Monitor the punctuality and attendance of the detail employee, approve

request for leave, evaluate the employee’s performance, grant the authority to

travel and exercise other acts necessary to effectively supervise the detailed

employee; provided, a report on said matters is submitted to the PARENT

AGENCY for record purposes;

2. Designate the detailed employee to a position whose duties are comparable to

her position in the parent agency. However, she shall not be designated to a

position exercising control or supervision over regular and career employees.


3. Shoulder the Representation and Transportation Allowances (RATA),

Extraordinary Miscellaneous Expenses (EME), and other bonuses of the

detailed employee.

4. Have the right to initiate or file the complaint against detailed employee subject

to the provisions of the 2017 Rules on Administrative Cases in the Civil

Service(RACCS) With respect to the administrative case arising from acts done

by the employee in its jurisdiction.

B. DURATION

This agreement shall take effect immediately upon signing hereof and shall

continue for a minimum period of one (1) year and maximum period of 3 (three)

years thereafter, without prejudice to the agreement of the parties to extend the

period, subject to the provision of paragraph 3(b) Section 13, Rule IV of the 2017

ORA-OHRA of the Civil Service Commission.

C. MISCELLANEOUS

This agreement shall be governed by and construed in accordance with Rule IV

Section 13, paragraph b of the 2017 Omnibus Rules on Appointments and other
Human Resource Actions 2017 ORA-OHRA of the Civil Service Commission

(CSC).

In case any of the provision contained herein shall, for any reason, be held to be

invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or

unenforceability shall not affect any of the provision of this agreement. In such

manner, the parties shall consult each other as to the manner by which their

intention can be fulfilled as closely as possible and they will amend this agreement

accordingly.

IN WITNESS WHEREOF, the parties herein have hereunto set their respective

signatures this 19th day of January 2018 at Cotabato, Philippines.
