22 WHEREAS, Republic Act 9512 otherwise known as the “National


23 Environmental Awareness and Education Act of 2008” provides that the State
24 shall protect and advance the right of the people to a balanced and healthful
25 ecology in accord with the rhythm and harmony of nature, and to recognize
26 the vital role of the youth in nation building and the role of education to foster
27 patriotism and nationalism, accelerate social progress, and promote total
28 human liberation and development;

29 WHEREAS, Section 53 of Presidential Decree 1152 otherwise known as “The


30 Environmental Code” states that government agencies implementing
31 environmental protection laws in coordination with public information agencies
32 of the government shall undertake public information activities for the purpose
33 of stimulating awareness and encouraging involvement in environmental
34 protection;

36 WHEREAS, Republic Act 9729, otherwise known as the “Climate Change
37 Act of 2009”, provides that the LGUs shall allocate from their annual
38 appropriations adequate funds for the formulation, development and
39 implementation of their respective climate change programs and plans. It shall
40 include public awareness campaigns, capacity building and continuing
41 educational and training programs on the effect of climate change;

42 WHEREAS, there is a need for the people of Cagayan to be aware of their


43 vital role in sustaining mother earth’s resources and to instill the value of
44 protecting the environment, which means protecting their children’s future; and,

45 WHEREAS, Environmental Awareness and Education is most significant and
46 well-timed issue considering the dangers caused by global warming.

48 NOW THEREFORE, be it ordained by the Sangguniang Panlalawigan of the


49 Province of Cagayan in session duly assembled, to enact:

51 CHAPTER I
52 SHORT TITLE AND DECLARATION OF POLICY

55 SECTION 1. TITLE. This Ordinance shall be known as the “CAGAYAN
56 ENVIRONMENTAL EDUCATION ORDINANCE OF 2018”.

58 SECTION 2. DECLARATION OF POLICY. It is hereby declared to be a policy
59 of the Province of Cagayan to promote Environmental Awareness and educate
60 its constituents on the importance and value of environmental conservation,
61 protection and rehabilitation; to intensify the youth’s role and awareness in
62 preserving the environment and to advance a balanced and healthful ecology
63 towards sustained development.

67 DEFINITION OF TERMS

70 SECTION 3. DEFINITION OF TERMS. When used under this Ordinance, the
71 following terms and phrases shall mean as follows:

73 a. “Province” shall refer to the Province of Cagayan;
74 b. “Provincial Government” shall refer to the Provincial Government of
75 Cagayan;
76 c. “DENR” shall refer to the Department of Environment and Natural Resources;
77 d. “CHED” shall refer to the Commission on Higher Education;
78 e. “DepEd” shall refer to the Department of Education;
79 f. “DOST” shall refer to the Department of Science and Technology;
80 g. “NGOs” shall refer to the Non-Government Agencies;
81 h. “Constituents” shall refer to the people of the Province of Cagayan;
82 i. “Tri-Media” shall refer to radio; local television and print are media entities
83 operating in the Province of Cagayan;
84 j. “Practicum” shall refer to a course involving activities emphasizing the
85 practical application of theories;
86 k. “TODA” shall refer to Tricycle Operations and Drivers Association; and,
87 l. “VODA” shall refer to Van Operations and Drivers Association.

91 ENVIRONMENTAL EDUCATION PROGRAM

94 SECTION 4. SCOPE OF THE ENVIRONMENTAL EDUCATION. All departments
95 and units of the Provincial Government of Cagayan shall integrate
96 Environmental Education in all their programs, projects and activities; including
97 the Child Development Program, Out-of-School Youth Learning Program, in the
98 continuing Education Program of Provincial-led Organizations and in other
99 programs of the Provincial Government.

101 SECTION 5. PROGRAMS. The Environmental Education Program of the
102 Provincial Government of Cagayan shall consist of:

104 a. ENVIRONMENTAL CONCEPTS AND CURRENT ISSUES. This refers to the study of
105 the definitions, terms and principles related to the environment, the different
106 problems affecting our environment, the root cause of such problems and the
107 possible solutions; and updates on the current status of our environment.

109 b. NATIONAL AND LOCAL ENVIRONMENT LAWS. This refers to all laws enacted by
110 the Congress pertaining to environmental concerns, such as Republic Act 8749,
111 The Philippine Clean Air Act of 1999; Republic Act 9003, The Ecological Solid
112 Waste Management Act of 2000; Republic Act 9512, The National Environmental
113 Awareness and Education Act of 2008; and Republic Act 9729, The Climate
114 Change Act of 2009; as well as provincial ordinances related to environmental
115 protection and preservation. It also includes ways to aid the implementation to
116 the different environmental laws.

118 c. ENVIRONMENTAL BEST PRACTICES. This refers to practices redeeming qualities
119 and attributes that has proven to be successful in its implementation and would
120 be of beneficial use to others for the preservation and protection of the
121 environment.

123 d. WASTE MANAGEMENT AND POLLUTION CONTROL. This refers to the collection,
124 transport, processing, recycling and monitoring of waste materials in relation to
125 their effect on health and in environment, as well as issues related to pollution,
126 ways and means to prevent and solve pollution and the effects and causes of
127 pollution.

129 e. NATURAL RESOURCE MANAGEMENT. This refers to proper discipline in the
130 management of natural resource such as land, water, soil, plants and animals,
131 with a particular focus on how management affects the quality of life for both
132 present and future generations. It focuses on scientific and technical
133 understanding of resources and ecology and the life-supporting capacity of
134 those resources.

136 f. GLOBAL WARMING AND CLIMATE CHANGE. This refers to the definitions and
137 terms related to global warming and climate change, their root causes, their
138 harmful effects and the possible solutions to prevent global warming. It aims to
139 create awareness about environmental problems and its link to global warming
140 and climate change and provides knowledge and tools to address climate
141 change.

143 g. THREATS OF ENVIRONMENTAL DEGRADATION AND ITS IMPACT ON HUMAN
144 WELL-BEING. This refers to the study on the deterioration of the environment
145 through depletion of resources; the destruction of the ecosystems and
146 biodiversity loss and its effects to mankind. It also includes any change or
147 disturbance to the environment that causes people and properties vulnerable
148 to disasters.

150 h. RESPONSIBILITIES OF THE CITIZENRY IN THE ENVIRONMENT. This refers to the
151 programs which inculcate in the minds of our constituents their responsibility
152 towards the environment. It aims to create awareness with regard to
153 environmental crisis gripping the world; the values of conservation, protection
154 and rehabilitation of natural resources; disaster risk reduction; and the
155 environment in the context of sustainable development.

157 i. ENVIRONMENTAL FRIENDLY ALTERNATIVE LIVELIHOOD. This refers to the
158 introduction and promotion of alternative livelihood that fulfill human needs
159 while maintaining the quality of the natural environment for current and future
160 generations.

163 SECTION 6. STRATEGIES. Pursuant to the implementation of the
164 Environmental Education Program referred to the preceding section, it shall also
165 cover practicum modules comprising projects and activities including, but not
166 limited to, proper method of tree planting; segregation, recycling and
167 composting; regular clean-up drive or oplan-linis within the barangay; fresh
168 water and marine conservation and other undertakings to aid in the
169 implementation of the different environmental laws.

172 SECTION 7. BARANGAY ENVIRONMENTAL EDUCATION. All Barangay units of
173 the Province of Cagayan in collaboration with the DENR, NGOs and other
174 relevant agencies, shall regularly undertake seminars, lectures and workshops on
175 environmental protection and conservation of their respective constituents. They
176 shall incorporate Environmental Education in their sessions, Barangay assemblies,
177 Sangguninang Kabataan assemblies, PTCA meetings, TODA/VODA meetings
178 and in other barangay affairs.

183 ENVIRONMENTAL AWARENESS MONTH

185 SECTION 8. ENVIRONMENTAL AWARENESS MONTH. Pursuant to the Republic
186 Act No. 9512 and in order to institute continuing awareness of the importance of
187 the environment to its constituents, the Provincial Government of Cagayan in
188 partnership with other government agencies and NGOs shall join the
189 celebration of the “Environmental Awareness Month” on the month of
190 November every year.

193 CHAPTER V
194 COLLABORATIVE AND MULTI-SECTORAL EFFORT

196 SECTION 9. COLLABORATIVE AND MULTI - SECTORAL EFFORT. The Provincial
197 Government of Cagayan shall promote collaboration and linkages with the
198 DepEd, CHED, DENR, DOST and seek active participation of NGOs, the
199 Academe and other concerned sectors in the effective and efficient
200 implementation of ordinance.

202 SECTION 10. CREATION OF A MULTI - SECTORAL ENVIRONMENTAL
203 EDUCATION COMMITTEE. There is hereby created a multi - sectoral
204 environmental education committee that will formulate the Implementing Rules
205 and Regulation (IRR) for the successful execution of this ordinance. The
206 committee shall be composed of the following:

219 SECTION 11. QUAD-MEDIA PARTICIPATION. All radio stations, local cables,
220 print and social media networks operating in the Province of Cagayan shall
221 include environmental education in their regular programs to simulate
222 environmental awareness. Print media circulating in the Province shall feature
223 environmental issues and articles on their publications.

225 SECTION 12. INFORMATION MATERIALS. The Province of Cagayan in
226 coordination with the DENR, DepEd and the Academe shall develop, produce

227 and distribute Environmental Education materials/modules to all schools and
228 barangays in the Province.
229 CHAPTER VI
230 APPROPRIATIONS

232 SECTION 13. APPROPRIATIONS. The amount of Three Million Pesos
233 (P3,000,000.00) necessary to implement the provisions of this Ordinance shall be
234 appropriated in the Annual Budget of the Province of Cagayan.

237 CHAPTER VII
238 FINAL PROVISIONS

240 SECTION 14. SEPARABILITY CLAUSE. The provisions of this Ordinance are
241 hereby declared to be separable and in event that one or more of the other
242 provisions are held illegal or unconstitutional, the validity of the other provisions
243 shall not be affected.

245 SECTION 15. REPEALING CLAUSE. Ordinances, executive orders and other
246 local legislation inconsistent with this Ordinance are hereby modified or
247 repealed accordingly.

249 SECTION 16. EFFECTIVITY. –The Ordinance shall take effect immediately
250 upon its approval and accordance with the provisions of the Local Government
251 Code.
