State v. David Eugene Hawkins (061402321)
DA 06020088
Blake,
have reviewed all the materials you provided me regarding this conviction integrity question. Upon my review, | see
the conviction as sound and the present recantation by victim and his brother to be suspect.
The CIC interviews appear to me to be honest recitations from memory of actual events made in age appropriate
language. There appears to be no evidence of coaching by anyone, especially his brother. The victim and witness
brother's events were consistent throughout the court proceedings. There was also information that the original
disclosure remained consistent in therapy sessions, although we did not have the therapy records.
In contrast, there Is troubling information regarding family pressure being placed upon Jeremy and Nathan to presently
recant there statements. Jeremy and Nathan’s explanation that then 13 year old Jeremy convinced 9 year Nathan to
allege abuse inerely because he was upset with his father has greater inconsistencies than the original disclosure.
Hopefully this will be of help to you in your evaluation of the case.
