Lam in receipt of your August 10, 2018 correspondence to Mike Matthews, President, Delaware
State Education Association (“DSEA”) regarding the recent Supreme Court decision in Janus vy.
AFSCME. Rest assured that DSEA has been monitoring the Janus case since its filing in the Supreme
Court and since its issuance, has reviewed the Opinion thoroughly and is well aware of what the decision
does and does not hold.
DSEA began working with the State’s payroll processing agent (PHRST) in early 2018 to ensure
that should an adverse decision issue in Janus, DSEA would be in a position to immediately stop the
collection of fair share fees. As a result of DSEA’s proactive steps, promptly following the issuance of
the decision on June 27, 2018, DSEA notified PHRST, and all public school districts and state agencies
employing DSEA-bargaining unit personnel, to immediately cease any future collection of fair share
fees, DSEA was notified that the collection of such fees was stopped. DSEA has met its obligations
under Janus.
