Bicol Sr. Citizens get Cash Aid

195,107 indigent senior citi-
zens in Bicol began receiv-
ing PHP2,400 under the Un-
conditional Cash Transfer
(UCT) Program of the De-
partment of Social Welfare
and Development (DSWD).
The payout started over the
weekend and continues to date
in the towns of Catanduanes,
Albay, Sorsogon, Camarines
Norte, and Camarines Sur.
"The UCT is a cash sub-
sidy provided under the Tax
Reform for Acceleration and
Inclusion (TRAIN) law to
lessen the adverse economic
effects brought by the said law
to poor Filipinos. This will be
implemented for three years
(2018-2020)," Arnel Garcia,
director of DSWD 5 (Bicol),
said in an interview with the
Philippine News Agency
(PNA) on Tuesday.
“The UCT cash grant can-
not cover all the household
expenses. This is only an aug-
mentation to the poor affected
by the inflation,” he added.
For this year, each ben-
eficiary will receive a total of
PHP2,400, which is equiva-
lent to PHP200 per month. For
the succeeding years, a ben-
eficiary will receive PHP300
monthly or PHP3,600 annu-
ally.
The UCT is given to ben-
eficiaries of Social Pension,

Who’s in Charge?
The cracks in the PDP-Laban monolith perhaps
started way back in Iloilo when unseated House
Speaker Pantaleon Alvarez who also sits as
Secretary General of the party clashed with party
president Koko Pimentel on the appointment of the
party chair in the city. Pimentel backed the widow
of the late Raul Gonzales, while Alvarez supported
an incumbent lone district representative of the city.
The two would later figure on Charter change, with
Alvarez threatening to have the House go on its

he belongs to the “lower house, but Koko’s Senate
(when he was still President), was the slower house.
Ah well, this seems to be all sound and fury now
as both of them have been unseated by a disgruntled
group in an assembly at a sports stadium in Quezon
City that had been known for its boxing matches.
In a word, the two had been ruled losers via TKO.
After all, both have also lost their erstwhile powerful
seats, Alvarez to phoenix-like GMA (yes of the “I’m
sorry fame”), and Pimentel to Sotto.
If at all, what these recent events show is the
absence and fiction of a political party system in
the country. What we have are really political, nay
vested interest groups. That means, all our local
leaders who have backed GMA or stood at the sides,
were just that, waiting at the wings for whoever
wins. All because there are no political principles or
vision to speak of or fight for in the first place. Even
President Duterte himself is said to have distanced
himself from the squabble, as some say he is no
PDP-Laban supporter himself even if he chairs the
party.
Times like this, it would be rare for politicians to
listen to what really the people, the much abused
“taumbayan”, the “banwaan”, want. We do not
want of people like them of course, for instance, Doy
Laurel when he deferred to Cory during the dying
days of the Marcos dictatorship. Yet, as we have
said, it is rare as no one wants to take responsibility.
This is the kind of times aptly described by the
philosopher Hannah Arendt in her The Origins of
Totalitarianism. She wrote:
“Nothing perhaps illustrates the general
disintegration of political life better than this vague,
pervasive hatred of everybody and everything,
without a focus for its passionate attention, with
nobody to make responsible for the state of
affairs—neither the government nor the bourgeoisie
nor an outside power. It consequently turned in
all directions, haphazardly and unpredictably,
incapable of assuming an air of healthy indifference
toward anything under the sun.”
Times like these call for the faceless masses to
once more take over and assert that they are the
true source of power, the one truly responsible for
making the promised change so long and late in
coming.

Rights
What are rights? What are the
foundations of rights?
Before we can positively and
logically assert certain acts and
“states of being” or conditions as
fundamental rights, we must first have
a working definition of what is a right
and establish the foundational validity
of rights.
Basic Definition
By definition, a right is defined as “a
moral or legal entitlement to have or
obtain something or to act in a certain
way.” For the sake of simplicity, we
should take the simple definition of right
as entitlement. This can be considered
as axiomatic in some sense. In other
words, a right is something that is
inherent to an individual or entity. It
is generally understood as something
that can be demanded without the need
for special grant from any authority. To
some extent, fundamental rights are
universally recognized.
Social Construct
Even in ancient and primitive
cultures, some rights were recognized
and already well-established. These
included the right to life, the right to
liberty and the right to private property.
However, it should be noted that
the right to private property was once
more important than the right to liberty
particularly in the case of slavery. It
was not too long ago that some groups
of humans were legally considered as
property. Although slavery still exists in
a few parts of the world today, slavery
is now internationally banned.

GMA – HOUSE SPEAKER: The
presidential SONA was delayed for
more than one hour because of a sur-
prise squabble in the leadership of the
House of Representatives. It turned
out that more than 180 of the 284
congressmen opted to oust Speaker
Pantaleon Alvarez (and his allies) from
the leadership of the House. For the
speakership, they installed former
president and Pampanga congress-
woman Gloria Macapagal-Arroyo. The
House leadership shake-up is a real
spectacle to watch.
To preserve traditional protocol,
Speaker Alvarez was allowed to main-
tain his seat at the rostrum before
the Duterte SONA. Afterwards – the
House reconvened and elected its new
speaker! At the Senate – the common
reaction was “fear” - that is, once the

in a vacuum – they are not mere
abstract entities that exist separately
from human interactions. Even animal
rights are defined by the way humans
interact with various species of
animals.
Moral Justification
Rights are foundationally justified
based on ethical-moral arguments.
These are also called natural
rights. The moral arguments for the
fundamental rights may be viewed as
objective and transcendental such as
in the case of religious (theistic) views.
Rights are seen to be God-given such
as the right to life or even the now
obsolete “divine rights” of monarchs
to rule with absolute political control,
making them accountable only to God.
Moral rights may also be considered
as logically obligatory, such as in the
case of deontological moral argument
based on Immanuel Kant’s categorical
imperative. Rights as founded on
moral arguments may also be viewed
as situational and consequentially-
justified such as in the case of John
Stuart Mill’s utilitarianism.
To some great extent, the moral
rights (natural rights) are the
foundation of legal rights. Many types
of legal rights can be considered as
extensions and corollaries of moral

Hohfeldian Analysis
In analyzing legal rights, some
basic elements can be distinctly
recognized. One or more of these
elements must be present in
order for something to be properly
considered as a right. These
elements of legal rights are known
as the “Hohfeldian incidents” named
after Wesley Hohfeld (1879-1918).
He was an American legal theorist
who discovered that rights have four
fundamental components, namely,
the privilege (liberty or freedom), the
claim, the power, and the immunity.
These simple “atomic” elements
have clear logical forms that can be
combined in certain ways to create
complex “molecular” rights.
The four Hohfeldian incidents
can be arranged in tables of jural
“opposites” and jural “correlatives.”
The tables will display the logical
structures of the system. For
example, the legal right to vote has
the Hohfeldian incidents of privilege
and immunity because those who
exercise it do not have the obligation
and the liability (Hohfeldian jural
opposites) to exercise it. Simply
put, voters are not obligated to vote
and they will not be prosecuted if
they don’t vote. The Hohfeldian
analytical system is very useful in
distinguishing legal rights.
