“The Bureau’s advisory boards and councils have provided valuable advice and consultation as we
carry out our mission. It is natural that new leadership would reevaluate its community and consumer
outreach efforts, and that will necessarily include consideration of the timing, frequency, content, and
other aspects of the Bureau’s meetings. The Bureau will meet all FACA and statutory obligations for
CAB, including those around composition and the requirement of at least two meetings this year. The
Bureau is committed to expanding its external engagements and hearing from a diverse range of
consumer advocacy, civil rights, and industry voices.”

Just the two requests below, we were waiting to see if any additional incoming came in after the
conference call on CAB, but this is it.

In addition, Evan Weinberger at Bloomberg Law asked if MM has any public speaking engagements
this week.

David Dayen, The Intercept: Received today, deadline today

* Request: I'm writing from The Intercept. Over a dozen members of the Consumer Advisory Board
are charging that the CFPB refuses to meet with them, in violation of statutory requirements. The Dodd-
Frank Act says that the bureau must meet with the consumer advisory board twice per year. The past
two meetings have been cancelled, the members say.

* Will you be meeting with the CAB twice, as is legally required, this calendar year? Why have the
previous meetings been cancelled?

* Is the bureau attempting to add members to the CAB by October, as per an advertisement that
members of the media have viewed? Those choices would have to be in line with the Federal Advisory
Committee Act, and balanced in terms of not stacking with representatives from industry or the
consumer space. Is that holding up these meetings? If so why?

* Suggested response: [Same as what we provided to Bloomberg last week] Attributable to a


Bureau spokesperson: “The Bureau’s advisory boards and councils have provided valuable advice and
consultation as we carry out our mission, and the Bureau will continue to meet its statutory obligations

1. Can you tell me who Delicia Reynolds Hand is – what is her title?

Answer: Assistant Director, Office of Advisory Board and Councils

2. Has MM had any contact at all with CAB since he joined the bureau?

Answer: Yes, there was a call in March 2018.

3. What is the reason why MM has not had contact with CAB members since it is mandated by the
statute?

Answer: The statute requires the board to meet twice per calendar year.

4. What is the CFPB's response to CAB protesting their treatment?

Answer: Decline to comment, or provide the same response we gave Bloomberg about the CAB
changes in general: “The Bureau’s advisory boards and councils have provided valuable advice and
consultation as we carry out our mission, and the Bureau will continue to meet its statutory obligations
in that regard. It is natural that new leadership would reevaluate its community and consumer outreach

5. Members of CAB have told me that the February CAB meeting was cancelled but they were only
informed of it when the CFPB put the cancellation notice on its web site. Did the CFPB inform
members directly of the February meeting's cancellation or was it through notice on the web site?

Answer: Members of the CAB learned about the meeting cancellation directly from the Bureau.
There are four advisory boards. Have all of them met since MM came on? Any of them?

Answer: The Bureau’s Academic Research Council (ARC) met in-person on April 23, 2018 in
Washington, DC. Additionally, the CAB has held a number of subcommittee calls that were open to the
public.
