2nd Reading Zoning Map Amendment

Applicant: Amazon.com.DED, LLC

Action requested: Conditional Use (Fifth District)

Property information: Total Acres: 22.05 acres


Located at 140 Commerce Court, zoned B-3.

Synopsis: Applicant requests a conditional use to allow for warehouse operations in


the B-3 zoning district.

Facts and Findings: Pursuant to Section 7.1.6 of the Effingham County Zoning Ordinance,
considerations for conditional uses shall be based upon the following:

(a) Approval of a conditional use shall not adversely affect the economic values or the
physical appearance of the neighborhood or areas surrounding the site or lot in question.
(b) The physical and environmental effects of allowing the conditional use shall be
considered.
(c) Buffer zones, where necessary to shield any adverse factors, shall be considered.
(d) Additional space for parking, landscaping, building, loading zones, and setback shall be
considered if necessary to protect adjacent structures or lots from any adverse impact.

The property is located within the Effingham Park of Commerce. Although zoned B-3 Highway
Commercial, the Commerce Park includes similar warehouse uses and carries the general appearance of
and Industrial Park. The existing site consists of open surface parking area, on which the proposed
temporary structures will be placed. No land will be disturbed during this process and there are existing
natural vegetative buffers to the sides and rear of this property; therefore the physical and environmental
effects of the conditional use on adjacent properties should be minimal to none. Additionally, a site plan
has been prepared showing parking, loading zones, and the placement of structures on site which
complies with the parking, loading, and setback requirements of the zoning ordinance.

Planning Board Recommendation: On October 9, 2018, Mr. Peter Higgins made a motion to approve
the request. The motion was seconded by Mr. Brad Smith. The motion carried unanimously.

Staff Recommendation: Approval, based upon warehouse operations being a permitted


conditional use within the B-3 zoning district.

AN ORDINANCE TO AMEND THE EFFINGHAM COUNTY ZONING ORDINANCE, MAP AND PARCEL NO. 466C-1

AND TO REPEAL ALL OTHER ORDINANCES IN CONFLICT HEREWITH.

BE IT ORDAINED by the Effingham County Board of Commissioners in regular meeting assembled and pursuant to lawful

authority thereof:

WHEREAS, Amazon.Com.DED, LLC, has filed an application for a conditional use to allow warehouse operations in the B-

3 zoning district; map and parcel number 466C-1, located in the 5th commissioner district, and

WHEREAS, a public hearing was held on October 16, 2018 and notice of said hearing having been published in the

Effingham County Herald on 09/26/2018; and

WHEREAS, a public hearing was held before the Effingham County Planning Board on October 9, 2018, notice of said
hearing having been published in the Effingham County Herald on 09/19/2018; and

IT IS HEREBY ORDAINED THAT a conditional use to allow warehouse operations in the B-3 zoning district is approved;

Map and Parcel number 466C-1, located in the 5th commissioner district.

All ordinances or part of ordinances in conflict herewith are hereby repealed.
