I have a Romanian driver license. I can drive 1 year in the UK with this car and with
the Romanian driver license.
After 1 year I must change my driver license with UK driver license.
For this I must send all my documents to DVLA and pay 50 pounds.
For my new car I must pay the insurance. Insurance will be depending on engine
power and driver license.

Vreau sa cumpar o masina in UK. O sa fie diferit de restul Europei. Am carnet de


conducere din Romania. Pot sa conduc un an in UK cu acest carnet si cu masina din
Romania.
Dupa 1 an trebuie sa schimb carnetul cu unul din UK.
Pentru asta trebuie sa trimit toate documentele la DVLA si sa platesc 50 de lire.
Pentru masina mea noua trebuie sa platesc asigurarea.
Aceasta depinde de puterea motorului si de permisul de conducere.

LEASE
BASIC RENTAL AGREEMENT OR RESIDENTIAL LEASE
This Rental Agreement or Residential Lease shall evidence the complete terms and
conditional under which the parties whose signatures appear below have agreed.
Landlord/Lessor/Agent, ____________________, shall be referred to as „OWNER’’
and Tenant(s)/Lessee, __________________, shall be referred to as „RESIDENT”. As
consideration for this agreement, OWNER agrees to rent/lease to RESIDENT and
RESIDENT agrees to rent/lease from OWNER for use solely as a private residence, the
premises located at __________________ in the city of ______________________.

1. TERMS: RESIDENT agrees to pay in advance £ ______ per month on the ___ day

consent and meeting the requirements of the OWNER. Such consent if granted, shall
be granted to have a pet and/or animal of any kind, an additional deposit in the
amount of £ ___________ shall be required along with additional monthly rent of

to carry insurance deemed appropriate by OWNER to cover liability and damages

8. LIQUID FILLED FURNISHINGS: No liquid filled furniture, receptacle containing more


than ten gallons of the OWNER. RESIDENT also agrees to carry insurance deemed
appropriate by OWNER to cover possible losses that may be caused by such items.

9. PARKING: When and if RESIDENT is assigned a paking area/space on OWNER’S


property, the parking area/space shall be used exclusively for parking of passenger
automobiles and/or those approved vihicles listed on RESIDENT’S Application
attached hereto. RESIDENT is hereby assignet or permitted to park only in the
following area or space __________. The parking fee for this space (if applicable is £
________ monthly. Said space shall not be used for the washing, painting, or repair
of vehicles. No other parking space shall be used by RESIDENT or RESIDENT guest(s).
RESIDENT is responsible for oil leaks and other vehicle discharges for which RESIDENT
shall be charged for cleaning if deemed necessary by OWNER.

10. NOISE: RESIDENT agrees not to cause or allow or any noise or activity on the
premises which might disturb the peace and quiet of another RESIDENT and/or
neighbor. Said noise and/or activity shall be a breach of this agreement.

11. DESTRUCTION OF PREMISES: If the premises become totally or partially


destroyed during the term of this Agreement so that RESIDENT’S use is seriously
impaired, OWNER or RESIDENT may terminate this Agreement immediately upon
three day written notice to the other.

12. CONDITION OF PREMISES: RESIDENT acknowledges that he has examined the


premises and that said premises, all furnishings, fixtures, furniture, plumbing,
heating, electrical facilities, all items listed on the attached property condition
checklist, if any, and/or all items listed on the attached property condition checklist,
if any, and/or all other items provided by OWNER are all clean, and in good
satisfactory condition except as may be indicated elsewhere in this Agreement.
RESIDENT agrees to keep the premises and all items in good order and good
condition and to immediately pay for costs to repair and/or replace any portion of
the above damaged by RESIDENT, his guests or/and invitees, except as provided by
law. At the termination of this Agreement, all of above items in this provision shall be
returned to OWNER in clean and good condition except for reasonable wear and
tear and the premises shall be free of all personal property and trash not belonging
to OWNER. It is agreed that all dirt, holes, tears, burns, and stains of any size or
amount in the carpets, draps, walls, fixtures, and/or any other part of the premises,
do not constitue reasonable wear and tear.

13. ALTERATIONS: RESIDENT shall not paint, wallpaper, alter or redecorate, change
or install locks, install antenna or other equipment, screws, fastening devices, large
nails, or adhesive materials, place signs, displays, or other exhibits, on or in any
portion of the premises without the written consent of the OWNER except as my be
provided by law.

14. PROPERTY MAINTENANCE: RESIDENT shall deposit all waste in a clean and
sanitary manner into the proper receptacles and shall cooperate in keeping the
garbage area neat and clean. RESIDENT shall be responsible for disposing of items of
such size and nature as are not normally acceptable by the garbage hauler. RESIDENT
shall be responsible for keeping the kitchen and bathroom drains free of things that
may need to be cleared of stoppage and for the expense or damage caused by
stopping of waste pipes or overflow from bathtubs, wash basins, or sinhs.

15. HOUSE RULES: RESIDENT shall comply with all house rules as stated on separate
addendum, but which are deemed part of this rental agreement, and a violation of
any of the house rules is considered a breach of this agreement.

16. CHANGE OF TERMS: T he terms and conditions of this agreement are subject to
future change by OWNER after the expiration of the agreed lease period upon 30-day
written notice setting forth such change and delivered to RESIDENT. Any changes are
subject to laws in existence at the time of the Notice of Change Of Terms.

17. TERMINATION: After expiration of the leasing period, this agreement is


automatically renewed from month to month, but may be terminated by either party
giving to the other a 30-day written notice of intention to terminate. Where laws
require „just cause”, such just cause shall be so stated on said notice. The premises
shall be considered vacated furnished for RESIDENT’S use are returned to OWNER.
Should the RESIDENT shall be liable for termination date or fail to vacate all
possessions on or befor the termination date, RESIDENT shall be liable for additional
rent and damages which may include demages due to OWNER’S loss of prospective
new renters.

18. POSSESION: If OWNER is unable to deliver possession of the residence to


RESIDENTS on the agreed date, because of the loss or destruction of the residence or
because of the failure of the prior residents to vacate or for any other reason, the
RESIDENT and/or OWNER may immediately cancel and terminate this agreement
upon written notice to the other party at their last known address, whereupon
neither party shall have liability to the other, and any sums paid under this
Agreement shall be refunded in full. If neither party cancels, this Agreement shall be
prorated and begin on the of actual possession.

19. INSURANCE: RESIDENT acknowledges that OWNERS insurance does not cover
personal property damage caused by fire, theft, rain, war, acts of God, acts of others,
and/or any other causes, noe shall OWNER be held liable for such losses. RESIDENT is
hereby advised to obtain his own insurance policy to cover any personal losses.

20. RIGHT OF ENTRY AND INSPECTION: OWNER may enter, inspect, and/or repair
the premises at any time in case of emergency or suspected abandonment. OWNER
shall give 24 hours advance notice and may enter for the purpose of showing the
premises during normal business hours to prospective renters, buyers,lenders, for
smoke alarm inspections, and/or for normal inspections and repairs. OWNER is

permitted to make all alterations, repairs and maintenance that in OWNER’S judment
is necessary to perform.

21. ASSIGNMENT: RESIDENT agrees not to transfer, assing or sublet the premises or
any thereof.

22. PARTIAL INVALIDITY: Nothing containned in this Agreement shall be construed as


waiving any of the OWNER’S or RESIDENT’S rights under the law. If any of this
Agreement shall be in conflict with the law, that part shall be void to the extent that
it is in conflict, but shall not invalidate this Agrement nor shall it affect the validity or
enforceability of any other provisions of this Agreement.

22. NO WAIVER: OWNER’S acceptance of rent with knowledge of any default by


RESIDENT or waiver by OWNER of any breach of any term of this Agreement shall not
constitute a waiver of subseqnuet breaches. Failure to require compliance or to
exercise any right shall not be constituted as a waiver by OWNER of said term,
condition, and/or right, and shall not affect the validity or enforceability of any
provision of this Agreement.

23. ATTORNEY FEES: If any legal action or proceedings be brought by either party of
this Agreement, the prevailing party shall be reimbursed for all reasonable attorney’s
fees and costs in addition to other damages awarded.

24. JOINTLY AND SEVERALLY: The undersigned RESIDENTS are jointly and severally
responsible and liable for all obligations under this agreement.

25. REPORT TO CREDIT/TENANT AGENCIES: You are hereby notified that a


nonpayment, late payment or breach of any of the terms of this rental agreement
may submitted/reported to a credit and/or tenant reporting agency, and may create
a negative credit record on your credit report.

26. LEAD NOTIFICATION REQUIREMENT: For rental dwellings built before 1978,

1. Overview

The Criminal Records Bureau (CRB) and the Independent Safeguarding Authority (ISA)
have merged to become the Disclosure and Barring Service (DBS). CRB checks are
now called DBS checks.

A DBS check may be needed for:

 certain jobs or voluntary work, eg working with children or in healthcare


 applying to foster or adopt a child

There are different rules for getting a criminal record check inScotland and Northern
Ireland.

Who can ask for a DBS check


An employer can ask for a DBS check for certain roles.

DBS eligibility guidance lists most roles that are eligible for a check. However, the
guidance isn’t comprehensive so contact DBS if unsure.

Applicants (job candidates) can’t do a criminal records check on themselves. Instead,
they can request a ‘basic disclosure’ fromDisclosure Scotland (you don’t have to be
from Scotland to do this).

How to get a DBS check


1. The employer gets an application form from DBS or an umbrella body (a registered
body that gives access to DBS checks).
2. The employer gives the applicant the form to fill in and return to them along
with documents proving their identity.
3. The employer sends the completed application form to DBS or their umbrella body.
4. DBS sends a certificate to the applicant. The employer has to ask the applicant to see
the certificate.

If the applicant has subscribed to the DBS update service, the employer can check
their certificate online.

How long a DBS check is valid


A DBS check has no official expiry date. Any information included will be accurate at
the time the check was carried out. It is up to an employer to decide if and when a
new check is needed.

Applicants and employers can use the DBS update service to keep a certificate up to
date or carry out checks on a potential employee’s certificate.

Types of criminal records check


There are 3 types of check. The employer or organisation running the check should
provide the applicant with more information about the level of check required.

DBS check applicants must be 16 or over.

The time it takes to process a DBS check depends on:

 the level of check


 if the details given for the check are correct
 what police forces need to be involved in the check

Generally, it can take around 8 weeks to get a DBS check.

Standard (£26)

This checks for spent and unspent convictions, cautions, reprimands and final
warnings.

Enhanced (£44)

This includes the same as the standard check plus any additional information held by
local police that’s reasonably considered relevant to the workforcebeing applied for
(adult, child or ‘other’ workforce).

‘Other’ workforce means those who don’t work with children or adults specifically,
but potentially both, eg taxi drivers. In this case, the police will only release
information that’s relevant to the post being applied for.

Enhanced with list checks (£44)

This is like the enhanced check, but includes a check of the DBS barred lists.

An employer can only ask for a barred list check for specific roles. It’s a criminal
offence to ask for a check for any other roles.

Volunteers
Checks for eligible volunteers are free of charge. This includes anyone who spends
time helping people and is:

 not being paid (apart from for travel and other approved out of pocket expenses)
 not only looking after a close relative

An employer can only apply for a check if the job or role is eligible for one. They must
tell the applicant why they’re being checked and where they can get independent
advice.4

MODEL EMPLOYEE AGREEMENT
TERMS AND CONDITIONS OF EMPLOYMENT (EMPLOYEE)
(Revised Jan 2015)
In this contract:
“Employer” (referred to in these terms and conditions as “insert company name” or
“we” or “us”) means PERSHORE Care Ltd a company limited by guarantee.
And
“Employee” (referred to in these terms and conditions as the “Employee” or “you”)
means Adrian Triff whose present address is (insert address of employee).
This contract sets out the terms of the Employee’s employment and is subject to any
variations or amendments contained in individual letters or other documents which
the Employer may issue to you from time to time relating to this employment.

1.Commencement of Employment and Probationary Period:


1.1 Your period of continuous employment began on (insert date) and shall
continue until terminated by either you or us in accordance with these terms of
employment. Any employment with a previous employer does not count as part of
your continuous period of employment.
1.2 You warrant that you are entitled to work in the United Kingdom without any
additional approvals and will notify us immediately if you cease to be so entitled
during the course of your employment.
1.3 Your employment will be subject to a three month probation period during
which time your performance and suitability for continued employment will be
monitored. At the end of that period, employment will be reviewed and may be
terminated if you are found for any reason whatsoever to be incapable of carrying
out, or otherwise unsuitable for, your job. Alternatively, the Company may extend
your probationary period by up to three months. During the probationary period
your employment may be te terminated by either party upon giving one weeks’
notice in writing.
1.4 This employment is entered into by us in reliance on the personal information
that you have supplied to your employer and is liable to termination without notice if
such information or any of it is subsequently found to have been grossly inaccurate
or misleading.

2. Title of Job and Place of Work


2.1 Your normal place of work will be PERSHORE Care Centre. You are employed as
a Care Assistant and a copy of your job description is attached. This should be seen as
a guide to the types of duties you are required to undertake. The Company reserves
the right to vary your duties and responsibilities at any time and from time to time
according to the needs of the Company’s business.

2.2 You must devote the whole of your time, attention and abilities during your
hours of work to your duties for the owning Company. You may not, under any
circumstances, whether directly or indirectly, undertake any other duties, of
whatever king, during your hours of work for the owning Company.
2.3 You may not without first obtaining our prior written consent (which will not
be unreasonably withheld)engage whether directly or indirectly, in any business oe
employment which is similar to or in any way connected or competitive with the
business of the owning Company outside your hours of work for the owning
Company.

3. Pay
You will be paid at monthly intervals in arrears by cheque or direct bank
transfer.
3.1 You pay is subject to an annual review. A pay review does not, however,
guarantee that any increase to pay will be implemented as any increases to pay are
entirely at our discretion. There will be no pay review after either you or we have
given notice of termination of employment.
3.2 You authorise us to deduct from your pay anysums due to us including without
limitation any overpayment of pay and any advances or loans made to you by us. In
the event of such sums being due to us on the termination of your employment, if
your final payment is insufficient to allow for the whole of any such deduction, you
agree to repay the outstanding amount due to us within one month of the date of
termination of your employment.
3.3 If should you resign your post before completion of one year’s employment, you
will be required to refund 50% of the cost of induction training and 50% of the
recruitment fee paid by the company to your agent.

4. Normal Hours of Work


4.1 You will be required to work shifts of varying length as notified to you from time
to time by your employer. Your weekly hours will be 36.
Dependent on the occupancy there may be occasions when your contracted
hours may not be available.
4.2 Your maximum weekly hours may exceed 48 hours. However, over a 17 week
period, your average weekly hours will not usually exceed 48 hours. You hereby
agree that the 48 hour limit under the working Time Regulations 1988 will not apply
to you unless or until the expiry of three months’ written notice from you to the
Employer to terminate this arrangement.
4.3 In each shift that exceeds six hours you will be entitled to a continuous break of
twenty minutes.

5. Holiday Entitlement and Pay (including Statutory Holidays)
5.1 You are entitled to 28 days annual holiday inclusive of 8 Statutory Bank
Holidays. These are New Years Day, Good Friday, Easter Monday, May Day (usually
1𝑠𝑡 Monday in May), Spring Bank Holiday (usually last Monday in May), Summer
Bank Holiday (usually last Monday in August), Christmas Day and Boxing Day; a total
of 28 days. Pro-rata entitlement for part time employees based on your contracted
hours, holiday entitlement accrues monthly.
5.2 Holidays are paid at your normal basic rate.
5.3 Statutory Bank Holidays are normal working days and employees who wish to
book any of the Statutory Bank holidays must use the holiday request system in the
normal way. Or
5.3a If you work a Bank Holiday you can choose to be paid at double your hourly rate
and the hours worked deducted from your annual leave entitlement. If you choose
this option you must notify the Administrator on each occasion before payroll is
submitted, otherwise you will be paid at your normal hourly rate of pay and the
hours will not be deducted from your annual leave entitlement.
5.4 The holiday year runs from January to December. You must use all of your
holiday entitlement by the last day of each holiday year and you may not carry your
holiday entitlement forward into the next holiday year. Holiday entitlement not used
by the correct date will usually be lost and under no circumstances will payment in
lieu be made for holiday entitlement that is lost through not being exercised by the
correct date, except in the case of termination of employment.
5.5 You must not book holidays until your request has been formally authorised. No
more than two weeks holiday may be taken at any one time. You should give one
month’s notice of the proposed annual leave dates. The company will try to co-
operate with your holiday plans where possible, but this is always subject to the
requirements of the smoot running of the Care Home and to adequate staffing levels
being maintained at all times. Staff are referred to the company Annual Leave
protocol in the policy manual.
5.6 On commencement of employment you will be notified of your pro-rata
entitlement of the current year. Should you leave the company employ, payment for
any holidays taken but not accrued in the current year will be deducted from your
final payment.
5.7 In your first and last year of employment your holiday entitlement will be that
proportion of the holiday year in question during which you have been employed.
This will be calculated to the nearest half-day and assuming that holiday entitlement
accrues at an even rate from day to date. During your first year of service unless
otherwise agreed in writing by your Line Manager, you will not normally be
permitted to take more annual leave than you actually accrued at the time your

holiday is taken. Entitlement during your first year of service is calculated monthly in
advance at the rate of 1/12𝑡ℎ of the full year’s entitlement.

6. Sickness or Injury
6.1 The Statutory Sick Pay Scheme is operated and absence without leave for any
reason other than personal sickness will not be paid for.
6.2 On the first day of any sickness absence you must ensure that your line manager
is informed by telephone of your sickness at the earliest possible opportunity. You
should aslo give details of the nature of your illness and the day on which you expect
to return to work. You must inform the Company as soon as possible of any change in
the date of your anticipated return to work.
6.3 Sickness absence of up to and including seven consecutive days (including
weekends) must be full supported by a self-certificate and thereafter by one more
doctor’s certificates provident to the Company at intervals of no more than seven
days during the period of sickness absence.
6.4 You must inform your line manager on the first day of your return to work after a
period of sickness absence and complete a self-certificate form if applicable. Self-
certification forms are available from the Administrator’s office. A return to work
interview may be required.
6.5 You warrant that have disclosed any injuries and/or illnesses you have previously
suffered that may affect your ability to carry out effectively your functions and
responsibilities under this employment.

7. Medical Examinations
The company may require you to undergo a medical examination by a medical
practitioner nominated by it at any stage of your employment. The cost of any such
examination or examinations will be met by the Company will only request such an
examination where reasonable to do so.

8. Pensions & Pension Schemes


The Government has introduced new laws to help workers save more for their
retirement. It requires employers to enrol their employees into a workplace pension
scheme if they are not already in one and they meet certain criteria regarding annual
earnings and are aged 22 years and under State Pension age. The company operates
this pension scheme with Now Pensions and full details of the scheme can be
obtained from the Administrator.

9. Social Security Pensions


A contracting out certificate is not in force for the employment in respect of which
this statement is given.

10. Retirement Age
The Company does not have a compulsory retirement age but operates a flexible
retirement policy that permits employees to voluntarily choose to retire at any time
provided that they give the required period of notice of termination of employment
indicated in this contract.

11. Rights of Notice to Terminate Employment


11.1 After the probationary period the notice period shall be as follows:

11.2 Once notice has been given by either party we may, at our absolute discretion,
bring your employment to an and before the expiry of the notice period by paying
you an amount based on your current pay and holidays due in lieu of the remainder

11.3 However, nothing in these terms and conditions prevents us from terminating
your employment summarily (i.e. without notice or payment in lieu of notice) in the
event that you are guilty of gross misconduct or if you commit a serious or repeated
breach of your obligations as an employee or a material term of your contract of
employment.
11.4 If you leave without giving the period of notice or leave during notice period
without permission, the Company shall be entitled as a result of your agreement to
the terms of this contract to deduct a day’s pay for each day not worked during the
notice period, provided always that the Company will not deduct a sum in excess of
the actual loss suffered by as a result of your leaving without notice and any sum so
deducted will be in full and final settlement of the Company’s claim for your breach
of contract. This deduction may be made from any final payment of salary which may
be due to you. The amount to be deducted is a genuine attempt by the Company to
assess its loss as a result of your leaving without notice. It is not intended to act as a
penalty upon termination.

12. Confidentiality
You may not disclose any information of a confidential nature relating to the owning
Company or any of its associated companies or their business or trade secrets or in
respect of which the owning Company owes an obligation of confidence to any third

party during your employment except in the proper course of your employment or at
all after the termination of your employment.

13. Delivery Up Of Company Property/Documents


Upon the termination of your employment under this contract for whatsoever cause,
you shall forthwith deliver up to the Company all uniforms, keys and any swipe cards,
credit cards, computer hardware or software, books, documents, account records,
and any other papers which may be in your possession, custody or control and which
are the property of the Company or which otherwise relate in any way to the
business or affairs of the Company and no copies of the same or any part thereof
shall be retained by you. You shall then (if required by the Company) make a
declaration that the whole of the provisions of this clause have been complied with.

14. Disciplinary Rules


In addition to the copy of the Disciplinary procedures relating to this employment
provident to yon on commencement of employment, a further copy is available on
request from the Care Centre Manager or Administrator.
If you are dissatisfied by any disciplinary decision you should raise the matter orally
or in writing with the Care Centre Manager or a representative of the Company.

15. Grievance Procedure


In addition to the copy of the Grievance procedure relating to this employment
provided to you on commencement of employment, a further copy is available on
request from the Care Centre Manager or Administrator.

16. Health and Safety


Employees are reminded that they have a statutory duty to observe all health and
safety rules, inclusive of fire regulations and to act in a way, which does not put
themselves or fellow employees at risk. Serious breaches of Health and Safety Policy
will be deal with through the disciplinary policy.

17. Date Protection


You expressly consent to us holding and processing information about you for legal,
personnel, administrative and management purposes and in particular to the
processing of any of your sensitive personal date (including medical details) as
defined in the Data Protection Act 1998. You are entitled to examine your records at
an appropriate agreed time.

18. Third Party Rights

The contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and
conditions of employment and no person other you and (insert company name) shall
have any rights under it. These terms and conditions may be suspended, cancelled or
terminated by agreement in writing or these terms and conditions may be rescinded
(in each case) without the consent of any third party.
19. Collective Agreements:
There are no collective agreements applicable to your employment and we do not
recognise any union for collective bargaining or any other purposes. 13

1. Overview
You get Child Benefit if you’re responsible for a child under 16 (or under 20 if they
stay in approved education or training).

Only one person can get Child Benefit for a child.

You must report any change of circumstances to the Child Benefit Office.

You may have to pay a tax charge if your or your partner’s individual income is over £
50,000.

You can choose not to get Child Benefit payments, but you should still fill in the claim

How and when Child Benefit is paid

Child Benefit is usually paid every 4 weeks into your bank account on a Monday or
Tuesday. It can be paid weekly if you’re a single parent or getting certain other
benefits, eg Income Support.
