Plaintiffs make no objection to the intervention of the Arizona Democratic Party
21
(“ADC”), League of United Latin American Citizens of Arizona (“LULAC-AZ”), League
22
of Women Voters of Arizona (“LWV-AZ”), Arizona Advocacy Network Foundation
23
(“AARF”), Arizona Republican Party (“ARP”), and Public Integrity Alliance (“PIA”) as
24
parties to this lawsuit.

Plaintiffs wish to respond to certain assertions in the Motions to Intervene, however,
26
and take the opportunity to further clarify their position. Plaintiffs’ Complaint makes no
27
attempt to “wrongfully disenfranch[e]” Arizona voters. See ADC Motion to Intervene at 2.

1 Plaintiffs do have grave concerns about the legality of the actions by those County
2 Defendants who are “curing” ballots past Election Day. However, as such actions have
3 already occurred and the ballots have not been separated to allow judicial remedy, Plaintiffs
4 now seek to ensure that every Arizona voter is provided an equal opportunity to vote vis-à-
5 vis their equal opportunity to cure a facially deficient early ballot—a general proposition
6 with which proposed intervenors LULAC-AZ, LWV-AZ, and AARF “do not disagree.”
7 LULAC-AZ, LWV-AZ, and AARF Motion to Intervene at 5.
8 Given the timing limitations imposed by Ariz. R. Stat. §16-552(E) as outlined by
9 Defendant Yavapai County and the comments by Defendant Pima County during the case
10 status conference today,1 Plaintiffs submit that an early ballot cure period for each county
11 extending to no later than Saturday, November 10, 2018, would provide Arizona voters

12 with an equal opportunity to participate in Arizona elections while also ensuring compliance

13 with statutory early ballot challenge requirements. However, if a Defendant is allowed to

14 continue to “cure” ballots past this timeframe, the other Defendants should be required to

23 A.R.S. §16-552(E) states, in relevant part, “Within twenty-four hours of receipt of a
challenge, the early election board or other officer in charge of early ballot processing
24 shall mail, by first class mail, a notice of the challenge including a copy of the written
challenge, and also including the time and place at which the voter may appear to defend
25 the challenge, to the voter at the mailing address shown on the request for an early ballot
or, if none was provided, to the mailing address shown on the registration rolls. Notice
26 shall also be mailed to the challenger at the address listed on the written challenge and
provided to the county chairman of each political party represented on the ballot. The
27 board shall meet to determine the challenge at the time specified by the notice but, in any
event, not earlier than ninety-six hours after the notice is mailed, or forty-eight hours if the
28 notifying party chooses to deliver the notice by overnight or hand delivery, and not later
than 5:00 p.m. on the Monday following the election.” (Emphasis added.)
