Thank you for your assistance. Pursuant to your instructions and our conversation on Friday,
10/15/2010, PM, the undersigned is faxing this notification from abroad to Hon. Judge Turner’s
Office at 001-239-774-3618 and opposing Counsel at 001-239-333-2999.
For the first time, today, on Friday, 10/15/2010, the Clerk’s electronic docket showed a “status
conference” on 10/18/2010. The undersigned, who is a foreign citizen, is abroad and could not
possibly return to the U.S.A. by 10/18/2010 on such short notice. Here, no notice of hearing had
been sent to the undersigned under the Rules.
Again, under the governing documents, O.R. 330/466-500, Collier County Public Records, and
Florida law, “Granada Condo Homes Association, Inc.” was not entitled to sue Dr. Jorg Busse,
O.R. 330/498, 472. Here, the governing documents did not authorize the association to “assess”
more than 105%:
“The total of assessments for recurring common expenses shall be not more than
105% of the assessments for this purpose for the prior year unless approved in
writing by apartment owners…”

Here absent any written owner approval under said O.R. 330/498 (“6. Fiscal Management; 6.2
Assessments”), Granada’s “complaint” was without merit.
Here, there had been no service of any summons and complaint under the Rules.
