The undersigned Petitioner respectfully shows that:

Petitioner is Elena Svenson and resides at 2620 Ocean Parkway #3K Brooklyn, NY
11235, County of Kings and has a child in common with the Respondent.

2. Respondent is Michael Krichevsky and resides at 4336 Manhattan Ave. Brooklyn,


NY 11224, County of Kings.

3. (Upon information and belief) Respondent committed the following acts against
Petitioner which constitute (disorderly conduct)(aggravated harassment in the second
degree)(harassment in the first degree)(harassment in the second degree)(menacing in
the second degree)(menacing in the third degree)(reckless endangerment)(assault in
the second degree)(assault in the third degree)(attempted assault)(stalking in the first
degree)(stalking in the second degree)(stalking in the third degree)(stalking in the
fourth degree) in that:

On October 24, 2008, Respondent changed the locks on 4336 Manhattan Ave
without Petitioner's knowledge. Petitioner and her son no longer have access to
many of their important documents and belongings. They also fear that
Respondent will throw out some of their belongings out of spite, and take their
furniture, leaving then with an empty apartment. On the same day, Respondent made
a false police accusation against Petitioner, saying she was terrorizing her landlord.

Around early October 2008, Respondent became angry during an argument with
David, his 14 year old son. Respondent threw David's home phone at the wall,
smashing it. This outburst frightened David and Petitioner, and they decided to
leave 4336 Manhattan Ave, where they have been living for three years, and live
temporarily at an apartment Petitioner's parents own (2620 Ocean Parkway). `-

For most of 2008, Respondent has not been living at 4336 Manhattan Ave with
Petitioner and her son. He comes there occasionally, often drunk, to harass
Petitioner and her son and to collect some of his belongings. During these visits,
Respondent wakes up David and verbally abuses him, calling him, "retarded, a loser,
fat, bastard" and sometimes hitting the 14 year old boy (most recently a couple
months ago). Respondent has also told David, "when you grow up, you'll know
what kind of garbage you are." Respondent threatens Petitioner, "I will rip out
your hands and legs." In those days, Petitioner told Respondent that if he wants to
come to the house, he should call first, but Respondent did not listen.

Petitioner fears that Respondent will pick David up without her permission. She
is also afraid that she will be harmed by Respondent, or falsely arrested, and that
David will not have anyone to take care of him (they have no family in America).
Likewise, David is afraid to go to school because he is scared something will
happen to his mother. Petitioner also fears that Respondent will charge her with
kidnapping.

Respondent has raised his fist at Petitioner on occasion, as if about to hit her,
most recently around January 2008.

4. The following are the names, dates of birth, ages, and relationships to Petitioner and
Respondent of each and every child under 18 years of age in Petitioner's household:

WHEREFORE Petitioner prays:

(a) that the Respondent be adjudged to have committed the family offense(s) alleged;

(b) that the Court enter an Order of Protection specifying conditions of behavior to be
observed by the Respondent in accordance with §842 of the Family Court Act,
including but not limited to the following:
do not commit any criminal offenses against the Petitioner
stay away from Petitioner
stay away from Petitioner's home
stay away from Petitioner's children
stay away from children's school
not interfere with Petitioner's care and custody of the children
Petitioner requests that Respondent not throw out her belongings or her son's
belongings, or take their furniture from 4336 Manhattan Ave
Petitioner requests police escort to retrieve belongings from home
Petitioner requests access to 4336 Manhattan Ave during the remainder of 2008
Petitioner requests that 4336 Manhattan Ave be returned to her and her son by
January 2009 at latest

temporary order of child support

(c) for such other and further relief as to the Court seems just and proper.

Elena Nabiouline, being duly sworn, deposes and says

1. I am not the party to this action, and I reside in Brooklyn, New York, and I

am over 18 years of age

2. On or about October 21, 2008 I was contacted by my friends Nelly Frid

and Michael Krichevsky.

3. They asked me to go with them to Mr. Krichevsky apartment located at

4336 Manhattan Ave in Brooklyn.

4. They asked me to be a witness to anything that might happen to Mr.

Krichevsky in his apartment as Mr. Krichevsky suspects that his former

girlfriend Elena trying to provoke some violence.

5. I was told that they spoke to Krichevsky landlady and she informed that

Elena looting his apartment.


6. When three of us arrived Mr. Krichevsky invited his landlady, Natella, to

personally inspect her apartment and witness condition as Elena and

Michael's son loaded her car with suitcases and left.

7. Natella told us that Elena was yelling and cursing, and it sounded as if she

was trashing apartment, but she decided not to interfere and call Michael.

8. When four of us entered apartment it was a mess. Papers and documents

were on the flour. Clouse and other items were on the flour. We could

barely walk throughout.

9. Computer wires were mixed with books and folders.

except as may be agreed upon by the parties through counsel or as may be ordered by the court.
