REPUBLIC OF THE PHILIPPINES DEPARTMENT OF TRANSPORTATION & COMMUNICATI LAND TRANSPORTATION OFFICE East Avenue, Quezon City E-mail Address: ltombox@lto.gov.ph Website: wwrwlto.gov4 MEMORANDUM CIRCULAR No. _47-2014~1865 TO : REGIONAL DIRECTORS/ASSISTANT REGIONAL DIRECTORS/SERVICE DIRECTORS/OPERATIONS DIVISION AND RLEU CHIEFS SUBJECT : TIMELY SUBMISSION OF APPREHENSION/ ADJUDICATION REPORTS DATE : 3LJuly 2014 Whereas, compliance with the required periods of submission of reports under Joint Administrative Order No. 2014-001 have not been consistently complied with; Whereas, despite clarification of the periods concerned and other matters pertaining thereto, during the Joint LTO-LTFRB Directors’ Conference, compliance has still not been duly made; Whereas, constant reminders to the concerned Directors to timely submit the same has been for naught; Now therefore, the final reminder and final solution is hereby resolved for the strict implementation and observation of the above-captioned matter. TIMELY ENCODING OF APPREHENSION 1) As discussed during the Joint Directors’ Conference with the Land Transportation Franchise Regulatory Board (LTFRB) held last 24 June 2014, ENCODING of the franchise violation must be made within 24 hours from apprehension. 2) The Law Enforcer concerned must ensure that the Temporary Operator's Permit (TOP) is completely filled-up. RECORDS & CORRESPONDENCE UN Te 3) The failure to completely fill-up the TOP and/or to timely encode the violation shalll result to the same being void, and the Law Enforcer shall be subject to administrative and/or criminal liabilities. TIMELY RESOLUTION OF CONTESTED CASES 1) Pursuant to Joint Administrative Order No. 2014-001 (JAO) , a position Paper contesting any apprehension must be submitted to the Traffic Adjudication Service (TAS) within five (5) days from apprehension. 2) The TAS is in turn mandated to resolve contested cases within five (5) days from its receipt of the Position Paper. 3) The failure to timely file a Position Paper shall result in the consideration of the apprehension as an admitted case. TIMELY SUBMISSION OF ADJUDICATION REPORTS. 1) As provided by the JAO, all resolutions of the TAS on contested cases, shall be transmitted to the LTFRB within 24 hours, together with the TOP; Apprehension Report; and the Position Paper. 2) If the case is admitted, only the Official Receipt, TOP and Apprehension Report is transmitted to the LTFRB, also within 24 hours from payment, or from the lapse of the five (5) day period to contest the case. 3) As clarified during the said Joint Directors’ Conference, submission must be made by the LTO Regional Office to the appropriate (a) LTFRB Regional Office; and (b) to the Office of the LTO Executive Director. 4) The LTO Executive Director shall then compile all submitted resolutions with its attachments to the LTERB Executive Director upon receipt thereof. 5) The LTO Central Office TAS Director shall submit its resolutions directly to the LTFRB Executive Director, furnishing the LTO Executive Director a copy thereof. SUBMISSION TO THE OFFICE OF THE SOTC 1) As explained to all Directors, the LTO Executive Director submits the compiled reports, with the corresponding updated matrix every Friday of every week. A copy of the matrix is again attached for reference. 2) As such, it is required that adjudication resolutions/reports and matrix are submitted to the LTO Executive Director at Thursday of every week covering adjudication made up to such day or date. NO APPREHENSION/ADJUDICATION In the event that for a particular period or week, no apprehension is made, such fact shalll still be made by the submission of a formal, written report to the LTO Executive Director. REPORTS NOT PICTURES Only FORMAL, WRITTEN reports are required to be submitted under the JAO, without the need to include any picture of the implementation of the same, except if the same is relative to a traffic incident requiring such reference. FAILURE TO TIMELY SUBMIT ALL REPORTS The constant failure to AGAIN comply with the submission of any and all reports as required by the JAO, under the period provided shall result to the stripping of the concerned Region of the power to enforce the provisions of the JAO jn the said Region, and the concemed Directors and Officers of such Region shall be subject to appropriate administrative liabilities and disciplinary sanctions, For your guidance and strict compliance.
