DECLARATION OF ORAL GIFT OR HIBA

This Declaration of Oral Gift/Hiba is made and executed on this 19th day of October
2010 at Bangalore, by

SRLRAHAMATH ULLA,
S/o.Late Abdul Ali,
Aged about 70 years,
Residing at No.223, ground floor,
8th Main, Byrasandra,
Jayanagar 1st Block East,
Bangalore-560

Hereinafter called as the “DONOR” (the term Donor Wherever the context so applies
shall mean and include his heirs, executors, administrators, legal representatives and
assigns of the One part;

Aged about 37 years,
Residing at 11/6,borebank road ,Benson town,
Opp. To railway station, Bangalore

Hereinafter called as the “DONEE” (the term Donee Wherever the context so applies
shall mean and include her heirs, executors, administrators, legal representatives and
assigns of the Other part;

Witnesseth as follows:

Whereas, the Donor is the absolute and lawful owner in possession of the property
bearing No 223,New No.223/26, measuring 60 x 40 feet, situated at 8th Main Road,
Byrasandra, Jayanagar 1st Block East, Bangalore, having purchase the same from one

Smt.AHALYA BAI, by virtue of the registered Sale Deed dated 16.11.1978 registered as
Document No.2429/1978-79 of Book No.1, Vol. No.399, at Pages No.98-100, registered
at the office of the Sub-registrar,Jayanagar, Bangalore.
Whereas, the Donor, ever since the date of purchase is in uninterrupted peaceful
possession and enjoyment of the above said property, as the absolute and unlawful
owner, without any claim of whatsoever in nature or objections or hindrance from
anybody whomsoever, by paying upto date tax to the Corporation City of Bangalore.

Whereas, the Donor, is well seized and possessed of or otherwise well and sufficiently
entitled to deal with the above said property in any manner he likes without any let or
hindrance from any body Whomsoever and in any manner whatsoever.

Whereas, the Donee is the daughter of the Donor and in view of the natural love and
affection and attachment towards the Donee/beneficiary, the Donor has now decided to
Gift, bequeath the 3rd floor portion constructed on the Front side (Front portion) of the

Premises bearing No.223, New No223/26, situated at 8th Main Road, Byrasandra,
Jayanagar 1St Block East, Bangalore, which is more fully described in the schedule
hereunder and hereinafter referred to as the “Schedule Property”

Whereas, the Donor, being the absolute and lawful owner of the schedule property has
this day Gifted the same in favour of the Donee who is no other than his own daughter,
out of his own free will and wish by way of this Declaration of Oral Gift/Hiba and he has
transferred all his right, title and interest in respect of the schedule property in favour of
the Donee without any monetary consideration.

Whereas, the Schedule property is free from all or any kind of encumbrances and the
same is hereby gift/ Hiba, bequeathed absolutely to the Donee, henceforth, the donee is at
liberty to enjoy the same in any maneer she likes and in any maneer of whatsoever in
nature or objections or hindrance horn anybody whomsoever.

NOW THIS DECLARATION OF ORAL GIFT/HIBA WITNESSETH AS


FOLLOWS:

1.The Donor in view of his natural love and affection towards the donee who is no other
than his elder daughter, gifted the Schedule Property in favour of the Donee and the
Donor as this day delivered the vacant possession to the Donee and from this day
onwards, the Donee is entitled to use and enjoy the schedule property together with all
the right, title and interest, liberties, privileges, easements, hereditaments and free from
all or any kind of encumbrances.

2. The Donee may apply and get the katha and all other revenue records transferred,
bifurcate to her name, by paying necessary taxes, betterment charges, etc., in respect of
the Schedule property to the competent authority.

3. The Donor do hereby declare that out of his natural love and affection to his
daughter/Donee and out of his own free will and wish, without any force. coercion,
compulsion or un due influence and with a keen desire to see that the donee is settled and
well established in her life, grant, convey, and tansfer all the rights by way of this hiba to
the donee,to hold the same unto the donee and her successors,legal heirs,etc.,
Under Mohammedan Law. Absolutely forever
.
4. The Donee is entitled to use the schedule property together with all amenities,
hereditaments including ways water courses, passages, privileges, easements,
appurtenances of whatsoever belonging to same and appurtenant thereto or enjoyed
therewith and to HAVE AND TO HOLD AND ENJOY the same unto and to the use of
the DONEE free of all encumbrances and without any manner of let or
hindrance, interruption and disturbances or claims or demands by the Donor or any body
lawfully, equitably claiming through or in trust of his or any of his predecessors in title
immediate or remote.

5. The Donor has this day delivered physical vacant possession of the schedule property
to the Donee. The donor has also handed over all the original documents of title and
reference to the Donee, which was in his custody and the Donee is at liberty to deal with
the schedule property in any manner she likes and she is entitled to raise loan from any
Govt., Schedule Banks, Private Financial Institutions, or from any- Co-operative Society
on the security of the schedule property as the absolute and lawful owner thereon.

6. The Donee hereby accepts the Gift of the Schedule Property,Gifted by her
father/Donor and acknowledges her acceptances of the gift and taken actual and physical
possession of the schedule property.

7. The Donor further declares and covenants to do any further acts, deeds or things to
perfect the title of schedule property in favour of the Donee.

SCHEDULE

All that part and parcel of the 3rd floor , Front portion Measuring 15 X 14 ft.,constructed
on the front portion of the premises Bearing No.223, New No.223/26, situated at 8th
Main Road, Byrasandra, Jayanagar 1st Block East,Bangalore, measuring East to West: 30
feet and North to South: 40 feet, along with the 50% of the undivided share in the land
consisting of one Room and attached bathroom,With A.E.H. connection with water
facilities and there is a common passage which is igress and ingress to the second floor
and First floor portion of the building, and bounded on :-

East by : Private Property (NIMHANS PROPERTY)

West by : Front portion of the same Building then 8t Main Road,

North by: Private Property Site No.224,

South by Private Propenv belonged to One Sri.Javeed Pasha


IN WTINESSES WHEREOF both the Donor and Donee in token of their offer and
acceptance , have set their respective hands and put their signatures in presence of the
attesting witnesses hereunder after the contents of the Giftdeed/Hiba were read over to
them ,on the day ,month and year mentioned above.
