CASE SUMMARY
Case: S2018-0126
INCIDENT:
Denver Police Department IAB forwarded a civilian complaint from Ms.
who alleged after her incarceration at a Denver Detention Facility, Deputy
Sheriff David Quintana sought her profile on Facebook, sent her photographs in
and out of uniform and initiated an intimate relationship which led to a
pregnancy. Ms. stated the relationship was severed by DS Quintana and
reported her concern about his behavior and concern he may have used his
authority to initiate other relationships.
INVESTIGATION:
Included with this case are numerous documents containing a variety of information.
These and other pertinent documents, including audio-recorded interviews are included
in the case for your review. For a complete understanding of this case, it is necessary
that all statements and/or audio-recorded interviews be reviewed in their entirety.
SUMMATION:
On January 30, 2018, the Denver Police Department, Internal Affairs Bureau
declined to pursue the case further and obtained and decline to pursue criminal charges
from the Denver District Attorney’s Office.
On February 8, 2018, Deputy David Quintana was contacted and placed on
Investigatory Leave as of Friday, February 8, 2018.
Multiple attempts were made by this office to contact and further interview Ms.
at both number registered to her in previous documents. Calls and messages
were left on February 21, 2018, March 1, 2018, March 5, 2018, March 19, 2018 and April
19, 2018. Number is no longer in service and at times reported the number
could not accept calls. Number had allowed this office to leave messages
though no calls were returned, and no party answered the phone.
Cell phone authorization list for February 2018, revealed Deputy Quintana was not
authorized to have the cell phone identified in his possession and use on February 5,
2018.
On April 23, 2018, SI Runions, SI Gregory Huff and SGT Tony Gehring
On April 26, 2018, at approximately 1402, Senior Investigator (SI) Penny Runions,
this office, interviewed Deputy David Quintana, S15068, with his attorney representative
Walter Bradley, who signed the Garrity Advisement. Deputy Quintana admitted he had
taken his cell phone into the facility on February 5, 2018, due to concerns about his
parents. He further explained he had communicated to his parents that he had arrived
on shift and would be on until 1200. Deputy Quintana admitted he knew the policy
prohibited the introduction and use of a private cell phone without authorization. He
further explained SGT Gary Rolando had informed him of the process to acquire
authorization though he had not yet done so or received any permission from a supervisor
to have the phone. He further stated he could not wait for approval. Deputy Quintana
stated he had filed for authorization on the same date as his and did
not know if he had since been authorized. He denied any photos or video were taken.
Deputy Quintana denied he had contacted or been contacted by Ms. on that date.
Her further denied she had contacted him during the interim of this investigation. Deputy
Quintana denied the use of social media to act on her behalf on February 5, 2018. He
stated he did not use his cell phone outside of the shower dress office. He denied any
intent to delay her processing which did not occur until he was off shift.
