INCIDENT:
Denver Police Department IAB forwarded a civilian complaint from Ms.
who alleged after her incarceration at a Denver Detention Facility, Deputy
Sheriff David Quintana sought her profile on Facebook, sent her photographs in
and out of uniform and initiated an intimate relationship which led to a
pregnancy. Ms. stated the relationship was severed by DS Quintana and
reported her concern about his behavior and concern he may have used his
authority to initiate other relationships.
INVESTIGATION:
Included with this case are numerous documents containing a variety of information.
These and other pertinent documents, including audio-recorded interviews are included
in the case for your review. For a complete understanding of this case, it is necessary
that all statements and/or audio-recorded interviews be reviewed in their entirety.
SUMMATION:
Denver Police Department IAB forwarded a civilian complaint from Ms.

who alleged after her incarceration at a Denver Detention Facility, Deputy Sheriff
David Quintana sought her profile on Facebook, sent her photographs in and out of
uniform and initiated an intimate relationship which led to a pregnancy. Ms. stated
the relationship was severed by DS Quintana and reported her concern about his
behavior and concern he may have used his authority to initiate other relationships.
On January 26, 2018, Ms. telephonically contacted the Denver Police

Department Internal Affairs Bureau to report she had been contacted by a deputy by
Facebook while she was incarcerated at the Denver Downtown Facility. She reported
Deputy David Quintana may have used his position and authority to begin a relationship
while she was in the jail. She reported she had screen shots of the interaction and would
send them to Sergeant David Timmerman. She reported when she was processed in the
jail, he didn’t do her paperwork, though may have overheard her name called. She
reported the staff gave her some Gatorade, and she felt the interaction was flirtatious,
and she had a Facebook message and request when she was released from jail from him
and he identified himself as a sheriff deputy. Ms. reported she was approached
in September 2017, when she was arrested. She reported she began a sexual
consensual relationship with Deputy Quintana, and reported she had since become
pregnant and felt he had made promises to her. Ms. reported she felt he may
have used his position and false promises to take advantage of her.
A second call with Ms. and DPD IAB is not audible.
A third call resulted in a message left for Ms. by Sergeant Timmerman to
confirm an appointment for Monday, January 29, at 1300.
A fourth call was not audible.
On January 29, 2018, at approximately 1245, Sergeant David Timmerman,

S05021, interviewed Ms. to discuss her complaint against Deputy David
Quintana. She reported she was contacted by him while she was still in custody at the
Denver City Jail. Ms. reported when she was released she had a Facebook
message from Deputy David Quintana. She reported she did not come into contact with
him and believed he had only overheard her name. Ms. reported she was
dehydrated and the medical station had given her Gatorade, and recalled Deputy
Quintana had offered to take the cup from her when it was time for her to move upstairs.
Ms. denied any conversation or promises to get her out of jail. She reported this
incident occurred in September 2017 and received the message when she was released
a few days later.
Ms. reported they began what she felt was a relationship. She stated they
both worked a lot, but her understanding was a relationship occurred, with about one or
two meetings a month. Ms. reported they had a sex in late December and had
informed him she was off birth control. She further reported she had been on her period
and did not think she would become pregnant. Ms. reported after they had sex,
he discontinued contact with her and she sent him screenshots and asked him what was
going on. She reported she fainted at work and was sent to the hospital where she
discovered she was pregnant. Ms. reported she called him when he was in
Fairplay with his parents and informed him she was pregnant. She reported she had not
had contact with him since January 9, 2018.
Ms. reported after the initial contact, their relationship was consensual.
She reported he met her at a mall once and had come to her house on other occasions.
Ms. stated she had never given him her name or contact information and felt he
found her by overheard her name. She stated when she sent Deputy Quintana the screen
shots, he had accused her of blackmail and she had requested he talk to her. Ms.
reported Deputy Quintana had said, “who are they going to believe, you or me?”. She
reported she had waited to bring this forward because the relationship was special
because he had put himself in jeopardy to be with her. Ms. denied any information
Deputy Quintana had done this to other women, though she had speculated based on his
reaction to her. Ms. identified a photograph of Deputy David Quintana in uniform.
She reported she was uncertain whether she would be willing to press charges against
Deputy Quintana at that time.
On January 30, 2018, the Denver Police Department, Internal Affairs Bureau
declined to pursue the case further and obtained and decline to pursue criminal charges
from the Denver District Attorney’s Office.
On February 8, 2018, Deputy David Quintana was contacted and placed on
Investigatory Leave as of Friday, February 8, 2018.
Review of Denver Sheriff Department booking records pertaining to Ms.

revealed she was booked into the Denver Downtown Detention Center from
September 21, 2017 at approximately 1709 and released September 25, 2017 at
approximately 0124. Records reflected an additional booking from October 30, 2017 to
November 2, 2017 at the Downtown Detention Center and November 2, 2017 to
November 9, 2017 at the Denver County Jail. A booking from February 5, 2018 to
February 6, 2018 was also noted. A review of her February booking, no incident or offense
identified a reason she was placed in an isolation cell to await booking.
Review of screenshots emailed from Ms. to Sergeant David

Timmerman reflected a Facebook request from a Quinn Quintanilla, which was accepted
September 25, 2017 at approximately 0458. Her response reflected, “Who is this”, and a
response received September 25, 2017 at approximately 0701, responded, “If I tell you
can you keep a secret?”. The conversation began again at approximately 0934,
September 25, 2017. The screenshots further included two photographs consistent with
the likeness of Deputy David Quintana, one in his uniform with his Denver Sheriff
Department badge visible. The individual who communicated under the Facebook profile
Quinn Quintanilla identified himself as David Quintana, and stated, “But thought you were
so gorgeous and had to tell you.” He immediately after the photograph in uniform sent,
“So since you know who this is…Maybe we can text and make this chatting easier?”.
On February 22, 2018, at approximately 0810, Senior Investigator (SI) Penny

Runions, this office, interviewed Deputy David Quintana, S15068, with his attorney
representative Walter Bradley, who signed the Garrity Advisement. Deputy Quintana
reported he met Ms. downtown in September or October 2017, when he was out
downtown. He reported he got her number and he could not recall if he contacted her
first or if she had contacted her. David Quintana stated they eventually met up to go
shopping for his niece’s birthday and she met him to shop for an hour or two. Deputy
Quintana reported they texted back and forth with her, and he stopped to talk to her at
her house or her grandparents’ home. He reported after work he had texted with her and
they met to go shop and eat at Buffalo Wild Wings. Deputy Quintana reported he had at
one time noticed she had printed a picture of him that he had sent her and he thought it
was weird she had a printed photograph of him in her wallet.
Deputy Quintana stated he did not talk to her as much for a while and in December
she contacted him by text and invited him to stop at her work, and in a staged apartment
they had some activity that would lead to sex. He reported when she stated she was on
her period they didn’t have sex. Deputy Quintana further stated as they were in the
apartment she asked if he remembered her and disclosed he had booked her into the jail.
He reported he had gone to work that evening and had used the system to look up Ms.
and realized she had been in the jail multiple times and had decided not to see
her anymore. Deputy Quintana reported not long after she had sent him a photograph of
a pregnancy test and continued to text him. He reported he thought the photograph was
fake and told her he didn’t believe she was pregnant. Deputy Quintana stated she
threatened to contact his family and his job. He admitted he had accused her of lying and
stated she sent his mother a message on Facebook in January and told his mom about
the pregnancy.
When confronted by the Facebook snapshots, Deputy Quintana denied he had a
Facebook account. He reported he had taken the photographs and they are pictures of
him. Deputy Quintana stated he sent the photographs to her cell phone and could not
identify who she would have made the pictures date to September 25, 2017. He denied
any knowledge of the text conversation. Deputy Quintana stated he did not know she
had been in the jail until she told him in December 2017. He reported he knew she had
a copy of the photograph of him in the civilian clothes. Deputy Quintana reported in
October 30, 2017, he could not recall whether he or his partner fingerprinted Ms.
He denied any recall of her being in jail in October or November 2017.
Deputy Quintana reported he was not aware of her incarceration on February 5,
2018, and called in sick for four hours of his shift due to taking care of his father. He
further reported when he arrived at work she was in an isolation cell and he noted her
presence and did not notify a supervisor of her identity or their relationship.

on the classification desk for an extended period of time.

09:22:16 – Inmate approached the book desk with the red tape.
09:26:14 – DS Quintana approached classification desk and leaned on the
short wall.

items and spoke to the deputy who interviewed Inmate He then appeared to walk
through the far male side of the waiting area, then walked up to the classification desk
from the opposite side.

10:33:34 – DS Quintana walked to shower dress, Inmate hid during
his passing and watched him after he passed.
10:42:14 – Inmate walked to the book desk, then returned to the
phone.

11:38:33 – DS Quintana entered intake, appeared to survey whole waiting
area. Inmate sitting in center of the waiting are on the female side.

deputy standing by, he opened the door and spoke with the inmate inside.
08:32:27 – SGT closed the door to the cell.
08:34:53 – SGT opened the door and Inmate exited in a cell
uniform. She then appeared to participate in the initial booking process.
08:39:47 – Inmate left view of the camera.
09:28:18 – DS Quintana opened and entered I-8, then exited. Then
opened I-7, looked into I-6, opened I-5 and entered, looked into I 4, 3 and 2, then
opened I-1 and exited. He then walked into the male waiting area, then left view.
No view of Inmate or DS Quintana in any remaining views.
Securus Record Review
A review of Securus revealed no calls placed to the known phone number of DS

Quintana. Inmate made a call from the book waiting area to All American Bail
Bonds, an unverified number whom identified in the conversation as her mother and
father, and a call to a number verified as TJ Ruiz. Inmate called the number
identified as TJ Ruiz, twice from pod 2B, which primarily appeared to be a conversation
with a third party called Mike who appeared to be in the process of securing her bond
money from her vehicle which was impounded at the time of her arrest. Audio review of
all calls made from 2B during her detainment revealed only these calls made by Inmate
Denver Sheriff Interviews and Investigation
On April 12, 2018, at approximately 1519, SI Runions interviewed Deputy Ian

Schiffhauer, S16073, with his attorney representative Lucas Lorenz, who signed the
Garrity Advisement. Deputy Schiffhauer reported he was assigned to work within Intake
at the Downtown Detention Center. He reported he at times has used the city computers
to stream music on YouTube, watch news and at times had streamed other videos. He
reported he had only used the system for a maximum of 15 minutes. Upon video review,
DS Schiffhauer identified himself as the individual at the book desk. It was later into video
review, identified that DS Schiffhauer had left that position and a male deputy of similar
build and description took his position. He identified the deputy as Deputy Christopher
Needham, S14015. DS Schiffhauer reported he had no knowledge of any relationship
DS Quintana may be involved and stated he does not interact with DS Quintana outside
of work. He denied he ever had knowledge of a relationship and had not been asked to
process or delay any inmate on the behalf of DS Quintana.
Due to the identification of an additional deputy during the investigation of this

case, it was determined a DSD IAB Case S2018-0294 would be initiated to properly
address the city electronic usage separate from this case.
Multiple attempts were made by this office to contact and further interview Ms.
at both number registered to her in previous documents. Calls and messages
were left on February 21, 2018, March 1, 2018, March 5, 2018, March 19, 2018 and April
19, 2018. Number is no longer in service and at times reported the number
could not accept calls. Number had allowed this office to leave messages
though no calls were returned, and no party answered the phone.
Cell phone authorization list for February 2018, revealed Deputy Quintana was not
authorized to have the cell phone identified in his possession and use on February 5,
2018.
Deputy David Quintana received informal counseling in January 2018, regarding

an inappropriate pursuit of a relationship with a Denver Health Employee.
On April 23, 2018, SI Runions, SI Gregory Huff and SGT Tony Gehring
DS Quintana was found to be in good health at his residence and was

notified that availability and acceptance of calls from the DSD IAB is a condition of his
administrative leave. DS Quintana verbally acknowledged the need to be available for
contact from the DSD management and IAB.
On April 24, 2018, at approximately 1045, this office attempted to contact Ms.
at , voicemail space allowed for a message to contact this office to
be recorded.
On April 26, 2018, at approximately 1402, Senior Investigator (SI) Penny Runions,
this office, interviewed Deputy David Quintana, S15068, with his attorney representative
Walter Bradley, who signed the Garrity Advisement. Deputy Quintana admitted he had
taken his cell phone into the facility on February 5, 2018, due to concerns about his
parents. He further explained he had communicated to his parents that he had arrived
on shift and would be on until 1200. Deputy Quintana admitted he knew the policy
prohibited the introduction and use of a private cell phone without authorization. He
further explained SGT Gary Rolando had informed him of the process to acquire
authorization though he had not yet done so or received any permission from a supervisor
to have the phone. He further stated he could not wait for approval. Deputy Quintana
stated he had filed for authorization on the same date as his and did
not know if he had since been authorized. He denied any photos or video were taken.
Deputy Quintana denied he had contacted or been contacted by Ms. on that date.
Her further denied she had contacted him during the interim of this investigation. Deputy
Quintana denied the use of social media to act on her behalf on February 5, 2018. He
stated he did not use his cell phone outside of the shower dress office. He denied any
intent to delay her processing which did not occur until he was off shift.
