JUDICIAL AFFIDAVIT OF INFORMANT

I, Joel Taudil, of legal age, Filipino, single, and a resident


of Las Piñas City, after having been duly sworn to in accordance
with law, hereby depose and state under oath as follows:

PRELIMINARY STATEMENT

I am being questioned by PO3 RUFINA DALAGDAGAN duty


investigator of City Anti-Illegal Drugs Special Operation Task
Group, Las Pinas Police Station, in relation to the apprehension
of the above named respondent. The questioning is being held
at the same address, and I am answering his questions fully
conscious that I do so under oath and I fully understood that I
may face criminal liability for false testimony.

QUESTIONS AND ANSWERS

Q1: Please state your name and where you live.


A1: I am Joel Taudil, I live in Las Pinas City.

Q2: How old are you?
A2: 24 years old.

Q3: For the record, what is your highest educational attainment?


A3: I am a college graduate.

Q4: What prompted you to execute this affidavit?


A4: I want to give my free and voluntary statement in relation to
the entrapment operation of illegal dangerous drugs initiated by
SAIDSOTF that resulted to the apprehension of TENG MONER Y
ADAM (herein referred to as "Moner" for brevity), a resident of
No. 26, Varsity Lane, Brgy. Culiat, Tandang Sora, Quezon City.

Q5: When and where was this entrapment of illegal drugs


operation conducted?
A5: At around 6:00 o'clock in the evening, of April 23, 2005, at
No. 26, Varsity Lane, Brgy. Culiat, Tandang Sora, Quezon City.

Q6: How did this entrapment operation come about?


A6: Earlier that day, I was arrested by the police operatives of
Las Pinas Police Station Anti-Illegal Drugs Special Operation Task
Force (SAIDSOTF) for possession of illegal drugs. During
investigation, I admitted that the source of the illegal drugs was
Moner.

Q7: Why do you know Teng Moner?


A7: I know Moner because I am one of his frequent buyers and
he is my main source of "shabu".

Q8: Where did you first meet?


A8: I first met Moner in a "karadyan", a party in Tandang Sora,
Quezon City. It was a common knowledge there that he sells
"shabu".

Q9: What did the police operatives do after learning about this?
A9: The Police Chief Inspector formed a team that would conduct
a buy-bust operation for the apprehension of Teng Moner.

Q9: What happened next?


A9: An initial briefing was conducted by the Police Chief
Inspector based on the information gathered.

Q10: Were you included in the said briefing?

A10: Yes.

Q11: What were discussed during the initial briefing?


A11: The police operatives and I were given our specific tasks for
the conduct of the buy-bust operation.

Q12: What is your specific task?


A12: I was tasked to accompany P02 Panopio who will be the
poseur buyer and apprehending officer.

Q13: What happened next?


A13: We proceeded to the Central Police District Office (CPDO),
Camp Karingal, Quezon City for proper coordination. And then,
the team, including a CPD-DIID personnel and I proceeded to No.
26, Varsity Lane, Brgy. Culiat, Tandang Sora, Quezon City.

Q14: What happened when you arrived there?


A14: The police operatives made a surveillance of the place and
thereafter, assumed their respective positions.

Q15: What happened after that?


A15: P02 Panopio and I proceeded to the house of Moner. While
we were outside the gate, I called Moner and then he came out
of the house a few minutes later.

Q16: And then?


A16: Moner and I had a conversation. I asked him if he has shabu
because I brought a buyer with me.

Q17: What did Moner answer?


A17: He answered "yes".

Q18: What happened next?


A18: Thereafter, I introduced P02 Panopio to Moner as my friend
who is interested in buying shabu.

Q19: What did P02 Panopio say to Teng Moner?


A19: He asked how much does five (5) grams of shabu cost
because he is going to buy such.

Q20: What did Moner reply?


A20: He replied PhP 8,000.00. Then, he asked P02 Panopio if he
had the money with him.

Q21: Did P02 Panopio hand him the money then?
A21: Not yet. After P02 Panopio confirmed to him that he had
the money with him, Teng Moner asked us to wait for him there.
He went inside the house and came back a few minutes later.
Thereafter, he handed P02 Panopio a plastic sachet containing a
a shabu. P02 Panopio, in turn, gave him the marked and boodle
money.

Q22: What happened next?


A22: While Moner was about to count the money, P02 Panopio
gave the pre-arranged signal to the team and introduced himself
as a police officer to Teng Moner.

Q23: What was the pre-arranged signal?


A23: The signal was when PO2 Panopio raises his hand to look at
his watch.

Q24: How did Moner respond after learning that P02 Panopio is a
police officer?
A24: He resisted arrest and hurriedly ran inside the house so P02
Panopio ran after him and was able to catch up and succeeded
in arresting him.

Q25: What happened after that?


A25: The other members of the team proceeded inside the house
where they saw the other suspects gathered around the table re-
packing shabu.

Q26: What did the team do after witnessing such scene?


A26: They declared that they are Police Officers, and arrested
the suspects.

Q27: What happened after the arrest of the suspects?


A27: P02 Panopio informed Moner and his co-accused that
they’ve violated of Section 5 & 11 Article II, R.A 9165 for selling
and possessing of dangerous drugs and thereafter apprised them
of their constitutional rights but they opted to remain silent.
Q28: What happened thereafter?
A28: PO3 Edwina Lirio, confiscated the items seized and placed
them inside a plastic bag.

Q29: After confiscation of the said items, and the arrest of the
suspects, what did the Police Officer do?
A29: We all left the area, together with Brgy. Councilor Joaquin
Andromeda, and Erwin Arsenal. The police officers brought the
items seized and the arrested suspects to the Las Piñas City
Police Station.
Q30: What happened when you arrived at the Las Piñas City
Police Station?
A30: PO3 Edwina Lirio, turned over the items to P03 Dalagdagan
who marked the items seized, took photographs, and made its
inventory.

Q31: Who were present during the marking, taking of


photographs, and making of inventory of the items seized?
A31: It was all done in the presence of Teng Moner, the arrested
suspects, Brgy. Councilor Joaquin Andromeda, Erwin Arsenal, and
the police operatives.

Q32: I have no further questions for you. Do you have anything


more to add?
A32: None for the meantime.

1. I personally conducted the interrogation of JOEL TAUDIL;

2. I faithully recorded the questions I asked JOEL TAUDIL and


the corresponding answers he gave me; and

3. Neither I nor any other person then present has coached the
affiant regarding his answers.
