Please take notice that on
October 9, 2018, at 6:00
pm or as soon thereafter as
the matter may be heard, in
the Donahue Council
Chambers in Highland City
Hall located at 27215 Base
Line in Highland, the City
Council will consider intro-
ducing and conducting first
reading of an ordinance
that would amend the City’s
business license and zon-
ing regulations relating to
massage establishments
and massage therapists
and practitioners. The ordi-
nance would amend and
update definitional provi-
sions in Chapter 5.16 re-
lated to massage thera-
pists, massage practitio-
ners, and massage estab-
lishments, and establish re-
quirements related to mas-
sage establishments. In
summary, the ordinance
provides that no person
may practice massage in
the City who does not have
a CAMTC certificate, and
no business may offer mas-
sage services without first
obtaining a massage estab-
lishment license from the
City. A massage therapist
or massage practitioner
employed by a massage
establishment, who is not
the owner of the massage
establishment, shall not be
required to possess a mas-
sage establishment license.
The ordinances includes list
of the classes of individuals
who are exempt from the
requirements of the ordi-
nance. Additionally, a BILITATION
beauty salon, nail salon, or
day spa where massage
services are performed on
less than 30% of the gross
square footage of the busi-
ness, shall not be required
to obtain a massage estab-
lishment permit. Massage
therapists and practitioners
are permitted to provide
massages on an outcall ba-
sis. The ordinance also
sets forth the application re-
quirements for obtaining a
massage establishment li-
cense, the grounds for issu-
ance or denial of a license,
procedures for revoking a
massage establishment li-
cense, and appeals proce-
dures. The ordinance also
establishes operational and
public health and safety
regulations including, but
not limited to, limits on
hours of operation, posting
of services offered, clean-
ing of equipment and facili-
ties, and draping require-
ments. The ordinance also
includes regulations regard-
ing the maintenance of re-
cords, inspection require-
ments, enforcement and
abatement procedures.
The ordinance also amends
Chapter 16.06 of the devel-
opment code to include a
definition of massage es-
tablishments, and amends
other sections of Title 16 to
identify that massage es-
tablishments are condition-
ally permitted uses in the
following commercial zon-
ing districts: General Com-
mercial, Planned Commer-
cial, Village Commercial
and Business Park. Mas-
sage establishments are
prohibited in all residential
districts, as well as Neigh-
borhood Commercial,
Mixed Use, Industrial and

Office Professional Zones.
The Ordinance is exempt
from the California Environ-
mental Quality Act (CEQA)
pursuant to State CEQA
Guidelines Section
15061(b)(3), which is the
general rule that CEQA ap-
plies only to projects which
have the potential for caus-
ing a significant effect on
the environment, and
CEQA does not apply
where it can be seen with
certainty that there is no
possibility that the activity
may have a significant ef-
fect on the environment.
This Ordinance involves up-
dates and revisions to exist-
ing municipal and zoning
regulations that require
massage establishments to
obtain a permit to operate
in the City. There is no
possibility that the Ordi-
nance may have a signifi-
cant effect on the environ-
ment since these types of
uses are already allowed to
operate in the City. This
document is intended as a
summary of the ordinance
only. Interested persons
are encouraged to obtain a
copy of the full ordinance
from the office of the City
Clerk during normal busi-
ness hours, and to attend
the City Council meeting on

No bid will be considered
unless it is made on a pro-
posal form furnished by the
City Engineer. All propos-
als or bids shall be accom-

payable to the City of High-
