Atty. Tepace - Will the prosecution admit that the subject firearms
of this case which is the Armscor Cal. 45pistol with Serial No. 1091306
was registered under the name of Joker Garcia?

Fiscal - Denied Your Honor/

Atty. Tepace - WE have no more stipulation to offer Your Honor.

Court - Do you have the subject firearm now fiscal?

Fiscal - At this time Your Honor, the prosecution does not have it yet
and for this reason Your Honor. May I request for the issuance of subpoena
to the person who is in possession of the subject firearm which is PO2
Aldrien M. David Your Honor. Your Honor, this person who is now present
is supposed to be a witness in the alleged commission of other, the threat
case against the accused Your Honor but the information for grave threats
was not filed because of the settlement between the complainant and the
accused Your Honor. So the police officers filed only the illegal possession
of firearm against the accused but he was a witness Your Honor to the
commission by the accused of the possession of the subject firearms which
is not license Your Honor.
