WHEREAS, the Commission is vested with the sole discretion, management, control and jurisdiction over contests, unarmed combatants, exhibitions and licensees of unarmed] combat, which includes mixed martial arts. WHEREAS, on September 27, 2018, the Commission granted Danis a Second’s License for the 2018 calendar year. WHEREAS, on October 6, 2018, Danis participated in Ultimate Fighting! Championship (“UFC”) 229 at the T-Mobile Arena, in Las Vegas, Nevada, as a Second for Conor McGregor (‘McGregor’) in MeGregor’s contest against Khabib Nurmagomedov| (Nurmagomedov’), at which Nurmagomedov won the contest by submission. WHEREAS, the Contest was conducted under the direction of the Commission. WHEREAS, following McGregor's submission, Nurmagomedov started walking in the direction of McGregor’s corner, exchanging words with, and pointing toward individuals| located thereat. Nurmagomedov then threw his mouthpiece in that direction. At or about} this time Danis, verbally and/or through gestures, challenged Nurmagomedov to leave the| Octagon. Commission Inspector Rangel stepped between Nurmagomedov and McGregor’s| ‘corner to de-escalate the confrontation. Nurmagomedov then evaded Inspector Rangel, jumped over the octagon fence, and then jumped into the gallery near Danis, Nurmagomedov and Danis then engaged in a physical confrontation until they were physically separated by security and/or Commission personnel and/or law enforcement (hereinafter collectively referred to as “Event Security”) WHEREAS, after Nurmagomedov and Danis were separated, Danis, in one or more| instances, had to be forcefully restrained by Event Security to keep him separated from, and/or to prevent him from participating in, the melee that resulted after Nurmagomedov leapt into the gallery and which Event Security was actively trying to extinguish (“Meleo”). WHEREAS, while Event Security was actively attempting to create/maintain peace and order within the T-Mobile Arena, Danis, in one or more instances, directed obscene gestures towards Nurmagomedov and/or members of Nurmagomedov’s team, and/or the public, to wit: extending his middle finger towards Nurmagomedov and/or members of Nurmagomedov’s team, and/or the public. WHEREAS, on or about January 7, 2019, the Director issued a Complaint for Disciplinary Action against Danis, and then on February 1, 2019 issued an Amended| Complaint for Disciplinary Action against Danis (“Complaint and Disciplinary Action”). WHEREAS, Danis admits that the above described conduct constitutes foul or unsportsmanlike conduct in connection with a contest. Page 2 of 7 DDocusign Envelope ID: CCSEO7OS COEA 4A12.9D4A.9DE5OS4ECEAD ee raeae ewe 10 ul 12 13 4 15 16 7 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, in light of the foregoing and in an effort to serve the Commission and Director's primary mission of protecting the health and welfare of unarmed combatants as| well as the industry of unarmed combat as a whole in Nevada, and in the interest of judicial| and administrative economy, the Parties wish to resolve the Complaint and Disciplinary] Action and potential litigation on the terms set forth herein; NOW THEREFORE, in consideration of the mutual covenants, agreements and conditions heroin stated, togethor with other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereto agree as follows: 1, TERMS OF AGREEMENT 1.1 The Parties recognize and agree that the Commission has the sole and| absolute discretion to determine whether to accept this Agreement. 1.2 Danis agrees to a seven (7) month period of ineligibility from the date of the| Contest, which suspension shall be lifted on May 6, 2019, subject to the terms set forth in| paragraph 1.3 of this Agreement. 1.8 Danis agrees to pay a fine in the amount of $7,500.00 (Seven Thousand, Five| Hundred and 00/100 Dollars) to the Commission which shall become due upon the Effective Date of this Order. Danis acknowledges that he shall remain suspended until the fine is paid in full or until he submits a written payment plan to the Commission that is approved by the Direetor. 14 In consideration for the execution of this settlement agreement, Danis, for himself, his heirs, executors, administrators, successors, and assigns, hereby release and| forever discharge the Stato of Nevada, the Commission, the Director, the Nevada Attorney] General and each of their members, agents, and employees in their individual and representative capacities, from any and all manner of actions, causes of action, suits, debts, judgments, executions, claims, and demands whatsoever known or unknown, in law and| equity, that Danis ever had, now has, may have, or claim to have against any and all of the persons or entities named in this paragraph arising out of, or by reason of, the investigation| Page 3 of 7
