Sevak (Conduct and Engagement), Rules, 2011 framed against
Shri Bijoy Kanti Debnath, Gramin Dak Sevak Branch Postmaster,
Saidabari EDBO in a/c with Kumarghat SO.

Superintendent of Post Offices, Dharmanagar Postal Division, Dharmanagar vide Memo

No.A-101/SR/1 dated 08.02.2017 has appointed me as the Inquiring Authority to inquire into
the charges framed against Sri Bijoy Kanti Debnath, Gramin Dak Sevak Branch Postmaster,
Saidabari EDBO in a/c with Kumarghat SO under Rule-10 of Gramin Dak Sevak(Employment &
Engagement) Rules, 2011. The Charge sheet issued vide Superintendent of Post Offices,
Dharmanagar Division vide Memo No. EST A-101/SR dated 30.12.2016 has already been served
to the Charged Official by the Disciplinary Authority. To conduct the preliminary hearing, the
Charged official has been directed to appear before me today (Friday, the 28th April 2017) at
1100 hours in the office of the Inspector Posts, Kailashahar Sub-Division, Kailashahar vide my
notification No. Rule 10/B.K. Debnath/ 2017 dated 11.04.2017. He has also been asked to furnish
the particulars of Defence Assistant, if any, proposed to be nominated by him for his Defence,
so as to reach me on or before 25.04.2017.

2. The proceedings were taken up as scheduled in the office of the Inspector Posts,
Kailashahar Sub- Division, Kailashahar at 1100 hours when the following were present.

i. Sri Bijoy Kanti Debnath, Gramin Dak Sevak Branch Postmaster, Saidabari EDBO, the
Charged Official.
ii. Sri Bibhankur Nath, Inspector Posts, Dharmanagar Sub Division & the Presenting Officer.

The Charged Official does not want to nominate any Defence Assistant. However, the
Charged Official has been given understanding that he has every opportunity to attend the
Inquiry along with his Defence Assistant at any point of time during the inquiry proceeding.

3. The Charged official when questioned by me, admitted to have received the charge
sheet issued vide Superintendent of Post Offices, Dharmanagar Postal Division, Dharmanagar
Memo No. EST A-101/SR dated 30.12.2016 and to have understood the charges levelled against
him clearly and fully. When I asked him whether he admits his guilt or deny any of the
charge/portion of charges or has any evidence(s) for his defence, the Charged Official
straightway admitted and pleaded guilty fully for the charge(s) that has been framed against
him in ARTICLE-I & II in ANNEXURE-I of the charge sheet Memorandum. The Charged Official
added that he has nothing to defend; rather agreed with the charges levelled against him fully.
He also added that after getting the charge sheet Memorandum on 12.01.2017, he had
confessed his guilt fully with each article of charges and submitted his reply to the Office of the
Superintendent of Post Offices, Dharmanagar Division on 18.01.2017. In support of his
admittance, the Charged Official submitted an application before me today in Bengali wherein
he categorically and clearly admitted his guilt without raising any confusion, eradication on the
charge sheet and a copy of his reply submitted to Office of the Superintendent of Posts Offices,
Dharmanagar Division dated 18.01.2017 also has been produced before me.

4. Since the Charged Official has admitted all the Charges and pleaded guilty; no further
inquiry is required. Inquiry is necessary in respect of those Article(s) of charge(s) which are not
admitted by the delinquent official. In the instant case, the Charged Official has admitted all the
Articles of Charges and pleaded guilty. Hence, the case is returned herewith to the Disciplinary
Authority with the finding that the Charged Official has admitted all the Articles of Charges
framed against him vide Superintendent of Post Offices/Dharmanagar Division Memo No. EST
A-101/SR dated 30.12.2016.

Sir,

Under His Order No. A-101/SR/1 dated 08.02.2017, a copy of which has been endorsed
to you also , the Superintendent of Posts , Dharmanagar Postal Division, Dharmanagar has
appointed me as Inquiring Authority to enquire into the charges framed against you vide his
Memo No.EST.A-101/SR dated 30.12.2016.

2. I shall hold preliminary hearing in the case on Friday the 28th April 2017 in the Office of
the Inspector Posts, Kailashahar Sub-Division, Kailashahar at 1100 hours. You are therefore
required to attend the proceedings either alone or accompanied by your Defence Assistant on
the appointed date, time and place.

3. Instructions for getting your Defence Assistant relieved will be issued, if his / her
particulars and willingness to work as such along with the particulars of his controlling authority
are received by me before 25.04.2017.

4. While nominating a serving Government Servant as Defence Assistant the relevant

instructions on the subject should be kept in view. If a Government servant is selected by you as
your Defence Assistant, he/she should certify that more than 2 two cases are not in his hand at
present in the capacity of Defence Assistant including your case.

Sub: - Admittance of Charges leveled against me vide Superintendent of Post

Offices, Dharmanagar Memo No.EST A-101/SR dated 30.12.2016.

Sir,

This is regarding confession of Charges leveled against me vide

Superintendent of Post Offices, Dharmanagar Postal Division Memo No.EST A-
101/SR dated 30.12.2016. I received the said charge sheet Memorandum on
12.01.2017; and understood the contents of the Charges framed in ARTICLE-I &
ARICLE-II in Annexure-I & II of the Charge Sheet and understood my guilt clearly
and fully without any doubt/confusion.

2. I have been given opportunity by your kind authority to nominate any

Defense Assistant for defending of the case on my behalf. Since I admit my fault
and agree with the allegation that has been framed in the charge sheet without
any doubt/confusion, I do not want to nominate any Defense Assistant.

3. I would like to inform you that I had submitted a representation after

getting the Charge Sheet Memorandum No.EST A-101/SR dated 30.12.2016 to the
Superintendent of Post Offices, Dharmanagar Division, Dharmanagar on
18.01.2017 confessing my guilt in respect of all the article of charges. A copy of
the said letter is enclosed herewith.

4. I, Sri Bijoy Kanti Deb Nath, S/O Baroda Mohan Debnath, Vill- Saidabari, P.O-
Saidabari EDBO, do Sewer in the name of GOD that such type of guilt shall not
repeat in future in my life. I pray the almighty that I may pardon for my guilt for
the last time.
