Narrative
SYNOPSIS OF EVENT:
Cinjin Nichols and Morgan Bradham allege that Aaron Smith Levin attempted to recruit Nichols to participate in a scheme to illegally
obtain information from a Church of Scientology computer in February 2018.
BACKGROUND INFORMATION:
Cinjin Nichols, Morgan Bradham and Zyanya Marsh have been friends for most of their life and live in the Clearwater area. Marsh and
Bradham left the church and have been excommunicated. Nichols also stopped attending courses and was not in good standing
however it is unclear if he was ever actually excommunicated.
Nichols grandmother, Cheryl Festa, is an influential member within the church. Bradham's mother, Carolyn Bradham, is also a
member of the church and owns a restaurant in downtown Clearwater.
Aaron Smith Levin is on the board of directors of the Aftermath Foundation which provides assistance to people who are leaving the
church. He is also associated with the television show Scientology and the Aftermath and is also an ex-member of the church.
INVESTIGATIVE ACTION TAKEN:
I was contacted by my supervisor and advised that there had been a complaint made to our Division Lieutenant regarding an attempt
to "hack" a computer at the Church of Scientology. I was instructed to contact Cinjin Nichols to discuss the allegations. I called and
spoke with Nichols and attempted to set up an interview. He explained that he would call me back with a time when he would be
available.

The following day I got a phone call from Attorney Steven Hayes who told me that he was calling on Nichols' behalf. He explained
that he would like to accompany Nichols to the interview. I attempted to schedule a meeting without success. I contacted Hayes
again a few days later and attempted to schedule a meeting and was told that Nichols was not available at that time. I eventually
asked Hayes to call me back when Nichols was ready to speak with me.

Approximately two weeks passed and I received a phone call from Hayes. He said that Nichols was ready to be interviewed and
added that there was another witness, Morgan Bradham, who also had information regarding the allegations.

On Tuesday January 22, 2018 I conducted the interviews of Nichols and Bradham. Attorney Steven L. Hayes had come to the
Clearwater Police Main Station with the two subjects. Each of the subjects were brought into a recorded interview room to discuss
their involvement in this case. Hayes requested to remain in the room during the interviews.

Cinjin Chase Nichols

I asked Nichols to explain what information he had regarding this incident. He states that he is the person that Aaron Smith Levin
approached about “the whole hacking thing”. He went on to say that this occurred at Smith Levin’s house in February 2018 and that
Zyanya Marsh was also present during this conversation. He said Smith Levin asked him to go into a church facility and plug a USB
drive into a computer – preferably a computer at the Fort Harrison building. Nichols said he was led to believe that the USB would
allow Smith Levin or his associates to remotely access the computer’s contents. He was later told by Morgan Bradham that Smith
Levin planned to use any information collected from the church computer on the “Aftermath” show. Nichols had read Smith Levin’s
story online regarding his former association with the church and knew that he was associated with Leah Remini and the
Scientology and the aftermath television series.
Nichols said that on January 3, 2018 he and Zyana Marsh were driving around downtown Clearwater. Nichols felt it was odd that
Marsh wanted to do that since they had never driven around downtown before. They drove past the Lucky Anchor Bar and Smith
Levin “happened” to be outside by himself with his dog and Marsh suggested that they stop and talk to him.Eventually Smith Levin
asked Nichols about himself and Nichols explained his association with the church – Nichols grandmother, Cheryl Festa, is a
high-ranking member of the church. Smith Levin appeared surprised and commented “so you’re a big deal”. On January 23, 2018
Nichols saw Smith Levin again at the Lucky Anchor Bar while Nichols was with his friend Nelson Bunch and Zyanya Marsh. The
following day Marsh and Nichols were at the Lucky Anchor Bar again and there was a birthday party for a woman named Marie
Rhodes that Smith Levin was attending. Nichols claims that he did not know that the people at the party had all been “declared”
(excommunicated) by the church or antagonizing it at all– he thought it was only Smith Levin. The party goers took pictures which
included Nichols and posted them online which further deteriorated Nichols relationship with the church. Sometime in February 2018
Smith Levin invited Marsh and Nichols to his house. Nichols claims that they were all socializing eating pizza when Smith Levin
offered both of them a beer. Smith Levin showed them his studio where he makes Youtube videos. Nichols states that Smith Levin
said, “let’s get down to the knitty gritty” and explained that he had an idea on how to hack the church and get information. Nichols
participated in the conversation and wanted to know if he would be paid for his participation. Nichols claimed he didn’t know at the
time that this would be a crime. Smith Levin told Nichols that he would need to go into the church and locate a computer with a USB
connection and WiFi capability. He would need to determine what operating system the computer was using and report back to
Smith Levin. He would later be supplied a USB drive based on the operating system which Nichols would have to insert into the USB
connection of the computer. After the USB was is in place “the other guy would do his magic” and gain access to the computer.
Nichols thought it sounded like a spy movie, but he wasn’t sure he wanted to participate. Over the next several days Smith Levin
communicated with Nichols via text and text-based applications asking Nichols if he could “do it today”, however I was not provided
with any of those text messages. Smith Levin said that Nichols could put the USB drive in a computer at the Belleair Mission, Tampa
Organization or Ideal Organization, which are buildings owned by the church. Nichols claims that he told Smith Levin that he would
cooperate but never followed through and eventually Smith Levin stopped contacting him; around April 2018. However, he learned
that Smith Levin asked Marsh and Bradham to convince Nichols to participate. Nichols explained that he was previously a member of
the church, but he left “quietly” because he had an issue with one of his courses, however he is now getting back into the church.
Nichols has known Marsh for many years and was her roommate at one point. Marsh was formerly a church member and believes
that she has been “declared”. Nichols stated that Marsh had been actively seeking out anti-church members. Nichols admits that he
was acting out against the church because of his dismay with his latest courses, which is why he was associating with Smith Levin.
Nichols moved out of Marsh’s apartment around April 2018 and Bradham moved in after that. Bradham moved out of Marsh’s
apartment around December 2018. Nichols has not had contact with Marsh since Bradham moved out of her apartment. Nichols
hasn’t communicated with Smith Levin since April 2018 except for one text message Smith Levin sent a couple of days ago asking
about Bradham.
Nichols had already sent his phone to Cellebrite for analysis and they have not been able to extract any data at this point (Note: the
phone was sent to Cellebrite by Nichols and the police have never had access to the phone). Nichols is attempting to have Cellebrite
extract the text communication that he had with Smith Levin.

Morgan Bradham
Bradham has known Nichols and Marsh “their entire lives” and they have a lot of history together. Around March 15, 2018 Bradham
stated that Nichols and Marsh were living together at 311 S. Betty Lane. Bradham walked into the apartment and Marsh was arguing
with Nichols. Bradham said that Marsh was upset with Nichols because he would not cooperate with Smith Levin’s plan to put a USB
drive into a computer at the church. Bradham said Marsh was also upset because Smith Levin was pressuring her to find someone
who would help them, and Marsh felt Nichols was the perfect solution. Bradham said he advised Nichols not to cooperate with the
plan. Marsh told Bradham that Smith Levin was asking her to recruit someone else to go through with the plan. Bradham told Marsh
that it was a crime to hack into the church computers.
Later, Smith Levin recruited Bradham to be on the Scientology and the Aftermath show. Bradham and Smith Levin went to Los
Angles to film an episode of the show. In August 2018 once they returned from Los Angels Smith Levin picked up Bradham to go to

dinner.Bradham said that Smith Levin had told him that the Aftermath Foundation was going to pay for Bradham’s education among
other things, however once they finished filming in Los Angles Smith Levin told Bradham that the foundation would not be giving
him any money. During the conversation Bradham said that he specifically asked Smith Levin if he was still looking for someone to
do “this whole USB thing” and he replied affirmatively. Bradham asked him what was happening with Nichols and Smith Levin stated
that he was not responding to his requests, so he was actively looking for someone else. Smith Levin said that he was basically
trying to remotely access a church computer to download information. Bradham decided that he would not allow his interview to be
aired on the show.
Both Nichols and Bradham were offered the opportunity to participate in a voice stress analysis which was conducted by Detective
Loder. See his supplement report for further details.

On February 11, 2018 I made contact with Aaron Smith Levin via telephone and made arrangements for him to respond to the Main
Station for an interview.

At approximately 1330 hours Smith Levin arrived and was brought to an interview room where his statement was video and audio
recorded. The following is a summary of his statement, for more detail refer to the DVD containing the recording:

Smith Levin stated that he knew Nichols through his association with Zyanya Marsh. He explained his relationship with Marsh and
Nichols as well as their association with the church. Smith Levin had met Marsh through the Aftermath Foundation when Marsh left
the church. Marsh introduced Nichols to Smith Levin. He also explained his relationship with Morgan Bradham. He told me that
Bradham had videotaped an episode for the Scientology and the Aftermath show and then rescinded his permission to use the
footage. He said that the Aftermath Foundation had given him thousands of dollars in financial assistance and Bradham has since
gone back to the church. He explained that the foundation bought Bradham a car and paid some of his rent. Smith Levin said
Bradham asked for more money after he had videotaped the episode and then three days later said that he did not want his footage
used. Bradham told Smith Levin that he was having mental health problems and did not want his information in the show. He told me
about times where Nichols and Bradham were openly associating with “declared” anti-church members even though their family
members were still church members.
He talked about a text message that he received from Marsh which mentioned “the USB thing”. I asked him to explain what he knew
about the USB thing and he stated that he was not willing to talk about it – but he did say the USB thing was Nichols idea. He asked
what the accusation was about, and I explained the information that I had been given regarding the placement of a USB drive in a
church computer in order to gather data. He said that was Nichols idea or at least the concept. He said that Marsh and Nichols felt
like they could take down the church because Nichols family member is so influential that he cannot get in trouble. Smith Levin
explained that he was interested in getting accurate statistics/data regarding church membership which would potentially disprove
church media releases. He said that Nichols thought he could get into the Belleair Mission, but didn’t think he could get into the
FLAG building. He said he participated in the conversation and was interested in pursuing the idea, however nothing else was every
done to further the plan. Smith Levin admitted that he contacted Nichols via text message and asked if Nichols was going to move
forward with the idea, but Nichols never responded to him. He said they discussed ideas about how to get a USB into an internet
capable computer and he admitted that he spoke to “someone” (he would not identify the person) about the technology required to
access the computer via a USB drive. Smith Levin stated that he came up with the idea to do “something effective” to open people’s
eyes regarding the church and said he suggested getting the information that would show that the church was lying to it’s
membership regarding church statistics however he said that is when Nichols suggested that he could access a church computer
and they began brainstorming the USB idea. Smith Levin said the idea ended because they needed to know the operating system of
the computer and Nichols was going to go into the mission and take a picture of the computer screen but apparently never went in.
Smith Levin said he believed that Nichols abandoned the plan because he did not have the access that he thought he did .He said
that Nichols would have to take steps (ethics interview) with the church in order to obtain access to the facilities and he was not
willing to take the necessary steps. At that point the plan was abandoned and no further action was taken. He allowed me to listen to

a voicemail message from Marsh which stated that she had been told that Bradham was trying to get Nichols to say things to
discredit the anti-church members

Smith Levin declined to take a voice stress analysis and the interview was ended.
A copy of the video was placed into evidence at the District II Main Station.

Zyanya Marsh
I later contacted Zyanya Marsh by telephone. I asked if she could come to the station to be interviewed and she became very
anxious. When I told her what I wanted to talk about she said that she suffers from anxiety and felt like she was having an anxiety
attack. After calming down she agreed to provide a verbal statement over the phone but did not want to respond to the station.
Marsh said that whatever Nichols was saying that she was sure that he was lying. Marsh stated that she and Nichols had both left the
church and that she had been declared a suppressive person by the church. Nichols became her roommate when he left the church.
She recalled the conversation between Smith Levin and Nichols and claims that Nichols asked Smith Levin what they could do to get
"real" information about the church. She said Smith Levin suggested that they need true membership information from the church
computers. Smith Levin talked about putting a USB in a church computer and Nichols agreed to participate. Marsh was very
emotional and began crying, she was very angry with Nichols about a multitude of things. She stated that Smith Levin never asked
her to pressure Nichols to participate and she believed that the conversation regarding the USB drive was never serious. She said
that she no longer talks to Nichols or Bradham and is very upset that Nichols and Bradham went back to the church.
A copy of the audio recording of Marsh's statement was placed into evidence at the District II Main Station.

INVESTIGATIVE ACTION TAKEN/CONCLUSION:

In my interview with Cinjin Nichols he stated that he had at least one conversation with Aarron Smith Levin about placing a USB flash
drive in a church computer in order to obtain data that was not accessible to the public. The conversation occurred at Aaron Smith
Levin's residence located at 1615 Harvard St. Clearwater, FL. in February 2018. Nichols went as far as to ask how much he would get
paid for his cooperation. The conversation between Nichols and Smith Levin was witnessed by Zyanya Marsh.

Aaron Smith Levin also admitted that he had the conversation about accessing the church computers and was "very interested" in
obtaining that data, which he described as church statistics and/or membership information which he would use to discredit the
church. Smith Levin said that he contacted a subject, which he refused to identify, to determine what information would be needed in
order to gain access to the computer via the USB drive. He was told that he would need to know the operating system and the
computer would need to be internet capable. Smith Levin talked with Nichols about locating an internet capable computer on church
property and taking a picture of the home screen so that they could determine the operating system.

Both Smith Levin and Nichols stated that they never followed through with the plan. Nichols said that he originally agreed, but
changed his mind and stopped communicating with Smith Levin. Smith Levin said that he believes Nichols discovered that he did
not have access to the church facilities unless he completed an "ethics interview" and he was not willing to go through the
procedure.

Morgan Bradham claims that Smith Levin attempted to pressure Nichols into cooperating by getting Marsh to influence him.
However, everyone that was interviewed agrees that Nichols did not follow through with the idea and no church computer was ever
compromised.

Nichols stated that he stopped communicating with Smith Levin in April 2018.

The following Florida State Statutes apply to this investigation:

The act of accessing the church computer and obtaining data without authorization would be a violation of F.S.S 815.06(2)(a) as
follows:

815.06 Offenses against users of computers, computer systems, computer networks, and electronic devices.—
(2) A person commits an offense against users of computers, computer systems, computer networks, or electronic devices if he or
she willfully, knowingly, and without authorization:
(a) Accesses or causes to be accessed any computer, computer system, computer network, or electronic device with knowledge that
such access is unauthorized;

(3)(a) Except as provided in paragraphs (b) and (c), a person who violates subsection (2) commits a felony of the third degree,
punishable as provided in s. 775.082, s. 775.083, or s.775.084.

Although they never accessed a church computer they did conspire to commit the offense during their conversation in violation of
F.S.S. 777.04(3) as follows:

777.04 Attempts, solicitation, and conspiracy.—

(3) A person who agrees, conspires, combines, or confederates with another person or persons to commit any offense commits the
offense of criminal conspiracy, ranked for purposes of sentencing as provided in subsection (4).

The conspiracy to commit the third degree felony reduces the applicable charge to a 1st degree misdemeanor.

F.S.S. 777.04(5)(a) contains a specific defense to a charge of criminal conspiracy as follows:

777.04 Attempts, solicitation, and conspiracy.—

(5) It is a defense to a charge of criminal attempt, criminal solicitation, or criminal conspiracy that, under circumstances manifesting
a complete and voluntary renunciation of his or her criminal purpose, the defendant:
(a) Abandoned his or her attempt to commit the offense or otherwise prevented its commission;

Cinjin Nichols stated that he abandoned the plan and stopped responding to Smith Levin's text messages. Smith Levin confirmed
that he contacted Nichols via text message and asked if he was going to proceed, however Nichols eventually stopped responding.
Therefore Nichols cannot be charged with conspiracy to commit Offenses Against Computer Systems because he abandoned his
attempt to commit the offense.

Smith Levin has also stated that he abandoned the plan once Nichols stopped responding to his text messages in April 2018. There
has been no other information brought forward to suggest that Smith Levin continued his attempt to access a church computer.
Therefore Smith Levin cannot be charged with conspiracy to commit Offenses Against Computer Systems because he abandoned
his attempt to commit the offense.

Thus, in order to establish the corpus delicti of


conspiracy, the State must present “substantial evidence

a crime and that the defendant intended to commit the

In conclusion, the information gathered during this investigation revealed that the criminal act of conspiracy to commit an offense
against computer networks was abandoned and therefore, as per statute, is not prosecutable. Furthermore, based on the case law
listed above, there must be "substantial evidence" of the conspiracy other than the suspect's statements and admissions in order to
prove the crime of conspiracy has been committed and in this case that burden has not been met.

On 02/01/19, Detective Lazzaro requested that I offer a Vipre Exam to Morgan Bradham and Cinjin Nichols, subjects in this
investigation.
Detective Larrazo and I agreed to the following questions for Morgan Bradham's exam:

Did Marsh tell you Levin was trying to recruit someone to plug a USB into a Church of Scientology computer?

Did Levin tell you he was looking for someone to do "This whole computer thing"

Bradham answered “yes” to all the above

After completing the test, I reviewed the results which indicated NO Deception on the control questions or the immediate follow up
questions during the exam.
I informed Detective Lazzaro of the results of the exam.

Detective Larrazo and I agreed to the following questions for Cinjin Nichols exam:

1. Did Levin ask you to plug a USB into a Church of Scientology Computer?

2. Was Zyanya present when Levin asked you to plug a USB into a Church of Scientology computer?

Cinjin Nichols answered “yes” to all the above

INVESTIGATIVE ACTION TAKEN:

On February 19, 2018 Morgan Bradham and Steven Hayes responded to the main station to speak with me about Smith Levin. They
brought to my attention that Smith Levin had published a youtube video on his channel discussing this investigation. I watched the
video and determined that the information that he shared was basically the same thing that he had told me in his interview.

Bradham and Hayes questioned whether it was legal for Smith Levin to publicly reveal the information. Morgan was very concerned
that his mother was mentioned by name in the video. Bradham felt that the video was making his mother, Carolyn Bradham, and her
business, Kara Lynn's Kitchen, a target for "anti-scientologist". We had a discussion regarding freedom of speech and I reminded
him that police interviews are subject to public record requests once the case is closed. Therefore, the information contained in the
youtube video would have been available to the public at the conclusion of the case.

Bradham asked about restraining orders and I explained the process and the interview ended.

A copy of the interview was burned to CD and placed into evidence at the District II Main Station.
