CLASS PROJECT FOR

TORTS AND DAMAGES

PAPER WRITING. Group yourselves into teams of 2 to 3 members.


Each group will submit a paper of no less than twenty (20) pages (Legal Size,
Font 12, Single-Spaced) on the following topics:

 Progression of Awards for Indemnity for Death under Article 2206


 Damages as Compensation in Quasi-Judicial and Administrative
Cases
 Minimum Age of Criminal Responsibility, The Pangilinan Law and
Vicarious Civil Liability
 Volenti Non Fit Injuria: The Doctrine of Assumption of Risk

Be mindful of the following mandatory content:

1. How did these doctrines or rules become part of Philippine law?


Chronologically cite jurisprudence on the doctrine or rule. The facts
of each case should be cited and used to explain why the doctrine
or rule was applied by the Supreme Court. Cases tend to
“converse” with each other with the passage of time. Ensure that
you are able to properly convey this “conversation” in your paper.

2. Compare and contrast Philippine precedents on the doctrines or


rules with their counterparts in at least two (2) foreign jurisdictions.

3. Form a legal conclusion on the applicability of the continuing


applicability of the doctrine or rule, taking into consideration factors
like possible moral or equitable objections to their applicability in
the context of Philippine law and the foreign law or laws to which
comparison was made.

Attribute your sources properly. Plagiarized work will be rejected. Please


be reminded that your professor will not ask you to write a paper on a topic he
himself has not written about. Compliance with the foregoing and timely
submission of a well-prepared and well-researched paper will merit as much as
a 100 PERCENT (100%) grade. Minimum grade is ZERO. Deadline for
submission of hardcopies is April 5, 2019 at the AdDU Law School Dean’s Office
on or before 5 pm of the same date. Softcopies shall also be electronically sent
to eyelaw1415@gmail.com following the same deadline while making sure that
the body of the email states the names of the group members. Softcopies are
required so that your work can be run through plagiarism-checking software.
Failure to make timely submission shall mean a failing grade for the group.
