SEC. 5. Equal Opportunity for Employment. – No person with disability shall be denied access

Section 1. Article One hundred thirty-five of the Labor Code, as amended, is hereby further

amended to read as follows:Art. 135. Discrimination Prohibited. — It shall be unlawful for any

employer to discriminate against any woman employee with respect to terms and conditions of

employment solely on account of her sex. ;The following are acts of discrimination:

(a) Payment of a lesser compensation, including wage, salary or other form oof remuneration and

fringe benefits, to a female employee as against a male employee, for work of equal value; and

(b) Favoring a male employee over a female employee with respect to promotion, training

opportunities, study and scholarship grants solely on account of their sexes.

Minimum wage law

Section 3. Minimum wage. - (a) Every employer shall pay to each of his employees who is

employed by an enterprise other than in agriculture wages at the rate of not less than -

(1) Four pesos a day on the effective date of this Act and thereafter, for employees of as

establishment located in Manila or its environs; (2) Three pesos a day on the effective date of
this Act and for one year after the effective date, and thereafter P4 a day, for employees of

establishments located outside of Manila or its environs; Provided,

That this Act shall not apply to any retail or service enterprise that regularly employs not more

than five employees.

OVERTIME PAY

Under the provisions of Article 82 of the Labor Code of the Philippines, working hours apply to

employees in all establishments and undertakings whether for profit or not.Work may be

performed beyond eight hours a day provided that the employee is paid for the overtime

work, which consists of an additional compensation equivalent to his regular wage plus at least

25% thereof.Work performed beyond eight hours on a holiday or rest day shall be paid an

additional compensation equivalent to the rate of the first eight hours plus at least 30% thereof.
