STUDY LEAVE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This STUDY LEAVE AGREEMENT executed this _____ day of April 2019 at the
_______________________________, _____________________, Philippines, by and between:

The _______________________, Department of Education,


represented herein by ____________________________,
__________________________, hereinafter referred to as the GRANTOR;

and

______________________, of legal age, Filipino, married, residing


at _______________________________, Kalinga and employed as
________________________________________, _________________________,
hereinafter referred to as the GRANTEE.

WITNESSETH

WHEREAS, Civil Service Commission (CSC) Memorandum Circular No. 21, s.


2004, otherwise known as “Amendment to Section 68 of CSC MC No. 14, s. 1999
relative to the Guidelines on Study Leave” provides that officials and employees,
excluding those in the teaching profession who are covered by different provisions of
law, may be entitled to go on study leave on official time to prepare for their
BAR/board examinations or complete their master’s degree;

WHEREAS, the Grantee has manifested her willingness to avail of the study
leave for the purpose of taking the BAR review and examination; and accordingly,
favorably recommended by the Head of Office concerned;

WHEREAS, the Grantee has met the qualification requirements and conditions
provided in the aforementioned CSC guidelines on Study Leave;

NOW, THEREFORE, for and in consideration of the foregoing premises, the


GRANTOR and the GRANTEE hereby agree as follows:

1. That the Grantor shall authorize the Grantee to avail herself of the full time
study leave with pay for the purpose of taking the BAR review and examination,
effective 03 June 2019 until 2 December 2019;

2. That the Grantee shall continue to receive her salary and all authorized
allowances or benefits during the period of her study leave;

3. The GRANTEE shall pursue diligently and faithfully the courses of study
specified in the NOTICE(s) OF AWARD.

4. That the Grantee shall take the BAR review and examination for which the
study leave was granted and report back to her official work station after 02
December 2019, or after a reasonable travel time from place of examination.

5. That the Grantee, after the BAR examination, shall submit the following
documents to the Human Resource and Development Senior Education
Program Specialist and the Administrative Section Head, the following
documents for monitoring, updating and file purposes:

a. Proof of admission to take the BAR Examination


b. Proof of having taken the BAR examination
c. Certificate of assumption after study leave
d. Report of rating upon release by the Supreme Court

6. That if the Grantee fails to take the examination within the period authorized
for her BAR review and examination, she shall refund the salaries and
allowances received during the study leave, and for causes within her control,
she is warned that a repeat of the same shall bar her from future availment of
the study leave;

7. That the grantee shall render a service obligation of six (6) months for one (1)
month leave privilege availed of, one (1) year for two (2) to three (3) months
leave privilege availed of, and for a period of two (2) years for three (3) to six (6)
months leave privilege availed of;

8. That upon failure of the Grantee to render in full the service obligation referred
to in the agreement on account of voluntary resignation, optional retirement,
separation from the service through her own fault, or other causes within her
control, she shall refund the equivalent salary, allowances and other benefits
received while on study leave proportionate to the balance of service obligation
required based on the following formula:

Where:

R = Refund
TCR = Total Compensation Received (Gross Salary,
allowances, and other benefits received while on
study leave)
SOR = Service Obligation Required
SOS = Service Obligation Served

9. That in case of failure to take the BAR review and examination, the Grantee of
the study leave shall inform the Administrative unit through the Administrative
Officer V and the Schools Governance Division through the SEPS HRD within
two weeks from her failure to take the review or BAR examination for which she
was granted the study leave;

10. This agreement shall take effect 03 June 2019 and shall cease after the
Grantee has rendered in full the required service obligation.
