I believe there is probable cause to charge the defendant with these charges because:
I observed a van in the parking lot of McDonalds and a male and female outside of it that appeared to be
arguing. I approached them and contacted Jeffrey Winn. As I spoke to Jeffrey he denied there was an argument,
and when he exited the vehicle he left the front passenger side door open. I saw a glass jar in the door side
pocket that appeared to have a residue at the bottom. I suspected it was marijuana. I asked Jeffrey to let me
inspect it and he said no. I asked him if it contained marijuana and he said maybe. Jeffrey told me the car was
not his. I then contacted the female party who identified herself as Amber Stinson. As I spoke to Amber at the
driver side of the vehicle I detected the odor of marijuana. She denied knowledge of marijuana in the vehicle.
At this time Jeffrey shouted that it was his. Amber said neither she nor Jeffrey had a prescription or doctors
recommendation for marijuana use.

I began to search the vehicle with assisting officers. While searching the vehicle, the couple’s 2 year old girl and
4 year old boy were in forward facing car seats in the middle row. On top of the center console of the vehicle I
found a green metal grinder which contained a green substance I recognized from my training and experience
as marijuana. I also found a multi colored glass pipe with the same looking substance, partially burnt. On the
floor of the vehicle I found another small metal grinder. An assisting officer located a black binder on the floor of
the front passenger seat area. The binder contained a plastic baggie with a blue pill. The inscription on the pill
identified it as Xanax based on an internet search. The binder also contained multiple squares of foil, and a
plastic baggie with a dark tar like substance that I recognized from my training and experience as heroin.
Finally, on the floor of the vehicle just inches away from the 2 year old’s feet, was another plastic baggie that
contained a substance appearing to be heroin.

After a Miranda warning, Jeffrey identified all of the property as his, and identified the tar substance as heroin.
After a Miranda warning was given to Amber, she admitted to smoking marijuana, and knew of the presence of
marijuana and paraphernalia in the vehicle. Amber also told me she knew the heroin was in the vehicle. She
even specifically told me Jeffrey had two baggies of heroin, and that he sometimes separates it out for future
use. She also said the vehicle was hers. The binder was also found next to a backpack that Amber identified as
hers.
The marijuana grinder and pipe was on the center console, and had been covered by papers, but was less than 2
feet away from the children. They were in the immediate presence of the controlled substances and were able
to perceive their existence, as well as odor.
