WH EREAS Plaintiff Dmitri Klimentov ("Klimentov") filed an application for naturalization

("N..400") with U.S. Citizenship and Immigration Services ("USC IS") on or about July 28,2007, which

is currently pending; and

WHEREAS Klimentov filed this action seeking, inter alia, an order compelling USCIS to

adjudicate the N .. 400;

IT IS STIPULATED AND AGREED, by and between the undersigned counsel, that:

1. This action is dismissed with prejudice and without costs or attorney's fees.

2. uscrs shall adjudicate Klimentov's N..400 within 90 days of the date ofthis order.
3. Nothing in this stipulation and order shall preclude USCIS from conducting further

interviews, requesting evidence, collecting biometric data, or requesting any other information that

uscrs deems relevant in furtherance of its adjudication of Klimcntov's N..400.
