AFFIDAVIT

I, GIRLIE T. OPSINAR, of legal age, Filipino, currently residing at Habitat Cantil-

e, Dumaguete City, on oath do hereby depose and state that:

1. I am married to JERRY OPSINAR, as evidenced by a Certificate of

Marriage (Annex A), with whom I have four children, as evidenced by birth
certificates (Annex B and C).

2. I worked as a reflexologist and there were times when I offered my clients

home service.

3. Sometime in 2008, while I performing reflexology in the house of the owner

of Star Ice, my husband, who was with me at that time texted me saying
“nganong dugay man ka? Ikaw na bay gi reflex diha?” (“What is taking you
so long? Are you the one getting reflexed?”).

4. When I was done working, I went outside and to my surprise he was no

longer there and so were my slippers.

5. I heard him blowing his horn along the seawall. There he hit me two times
and I was confused as to what I did to deserve the beating. This is where
our problems began until he delved into other vices such as illegal drugs
and extramarital affairs.

6. After that incident we continuously fought. In one occasion he hit me again

when I brought up the topic of his extramarital affairs.

7. During the year 2009 or 2010, I filed a complaint against him but he asked
for my forgiveness. Because I loved him, I forgave him and gave him
another chance that is why I did not come to the hearing.

8. During the year 2011 to 2015, as I was working in Manila, he was very .

9. At one point he got infected with a Sexually Transmitted decease causing

him to piss puss out of his genitals.

10. Not only did I suffer from being infected by his decease but also
because he refused give to monetary support as well as provide food for
me and my children.
 11. When I nagged him about his responsibilities towards the family, he
would physically hurt me.

12. At one point my children could no longer go to school because they

had no breakfast or snacks, I was afraid they might collapse while in
school.

13. Because of my anger towards my husband, I thought of getting back

at him by entering into a relationship with someone because I could no
longer bear the pain he made me feel.

14. That person helped me during the times me and my children had no
food to eat. However, our relationship only lasted about two (2) months as
I felt guilty and I never felt anything for that person, I was just forced to
like him out of desperation and anger towards my husband.

15. Even after that incident, my husband still has not changed. He still
continue with all his vices and sometimes would not even come home
because he would sleep in the house of his mistress.

16. If he ever gave me support, it would not be enough for our food and
expenses because he already divided his salary between me and his
mistress.

17. Because of my problems with my husband, I decided to ask help

from the Barangay, the Police and I also asked a medical certificate from
the Provincial Hospital of Dumaguete City.

I am executing this affidavit to attest to the truth of the foregoing statements

based on my personal knowledge of the facts and circumstances and to attest to
the validity and authenticity of the documents attached.
