CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease made and executed by:

FERDINAND F. MADARANG, Filipino, of legal age, married and resident


of Blk- K-1 Lot 2 & 8, Brgy. San Antonio De Padua II, Dasmariñas City, Cavite,
hereby after referred to as LESSOR;
-in favor of-

CMC PAWNSHOP, INC, represented herein by its Executive Vice President


CHRISTOPHER L. DARZA, Filipino, of legal age, married and with principal office
at S-801 Cebu Holdings Center, Cebu Business Park, Cebu City, Philippines,
herein after referred to as LESSEE; with its trade name HENRY LHUILLIER
PAWNSHOP.

WITNESSETH:

WHEREAS, the LESSOR is the owner of the commercial space located at


Blk K-1 Lot 2 & 8, Brgy. San Antonio De Padua II, Dasmariñas City, Cavite;
WHEREAS, the LESSOR is desirous to lease the afore-mentioned
commercial space to the LESSEE who is likewise desirous to lease the same;
WHEREFORE, for and in consideration of the foregoing, the LESSOR
hereby leases the above afore-mentioned property to the LESSEE subject to the
following terms and conditions:
1. PERIOD. The term of this lease is ONE (1) YEAR, which shall
commenced on April 1, 2014 and expires on March 31, 2015,
renewable at the option of both parties. However, in case the LESSEE
intends to renew their contract, the latter may communicate the same to
the LESSOR within THIRTY (30) DAYS prior the expiration of the
contract.

2. MONTHLY RENTAL. Monthly rental shall be FIFTEEN THOUSAND


PESOS (P 15,000.00); The LESSEE agree to pay their ONE (1) whole
year rental equivalent to ONE HUNDRED EIGHTY THOUSAND
PESOS (P180,000.00) Philippine currency to be paid at the office
address of the LESSOR;

Upon signing of this contract, the LESSEE shall pay the LESSOR the
amount of THIRTY THOUSAND PESOS (P 30,000.00) representing TWO (2)
months SECURITY DEPOSIT as a guarantee to secure the faithful compliance by
the LESSEE of all the terms and conditions of this contract. The said security
deposit shall be refunded by the LESSOR to the LESSEE if:
a. the premises is still in good and tenantable condition;
b. there is no unpaid bills such as electric, water, etc.
c. there is no breach of contract on the part of the LESSEE.
In case the LESSEE fails to comply any and all of the above conditions, the
security deposit of THIRTY THOUSAND PESOS (P 30,000.00) shall be
FORFEITED.
3. WATER, ELECTRICITY, ETC. Charges for water consumption,
electricity and other utility services in the premises, as well as for the
repairs in the utility system and in the building shall be for the account
of the LESSEE; if the LESSEE renew their contract, the LESSEE should
repaint their lease premises inside and out.

4. LESSEE is not allowed to sublease the same to another without the


written consent of the LESSOR or shall no use the above said property
for residential purposes; the LESSEE shall use the leased commercial
space for “HENRY LHUILLIER PAWNSHOP” only and cannot be
change without the consent of the LESSOR;

5. The LESSEE shall not make or cause to be made any improvement in


the premises without prior written consent of the LESSOR, it being
understood that such improvement if approved by the LESSOR in the
premises shall be at the sole expense of the LESSEE and in case of
such authorized alterations or improvements, the same shall became
the property of the LESSOR at the expiration or termination of the lease
contract such as signages, air conditioning unit,etc. except the VAULT.

6. INSPECTION OF PREMISES. The LESSOR or his duly authorized


representative shall have the right to inspect the leased premises at any
reasonable hour of the day.

7. That the FAILURE of the LESSOR to insist upon the strict performance
of any terms and conditions hereof shall not be deemed a waiver on his
part of the terms of the contract.

8. The LESSEE shall give a ONE (1) MONTH advance notice to the
LESSOR in the event he desires to vacate the property.

9. The LESSEE hereby agrees that all the agreements herein contained
shall be deemed essential conditions hereof and that any DEFAULT or
BREACH of the same shall, upon THIRTY (30) DAYS notice, entitle the
LESSOR to terminate this contract and extra-judicially eject the LESSEE
from the premises without prejudice to the LESSOR of filing a court
action against the LESSEE for the recovery of actual and consequential
damages resulting from such default and termination.

10. That the LESSEE hereby expressly acknowledges that the leased
premises are in good and tenantable condition and agrees to keep the
same in good and tenantable condition complying with all laws,
ordinances and regulations of the Municipal City of National
Government as regards the use occupation and sanitation of the leased
premises and failure to comply shall be at the risk and expense of the
LESSE

11. That any and all violation of the conditions of this contract shall subject
the guilty party to the payment of damages aside from cost of suit and
attorney’s fees.

12. RETURN OF PREMISES UPON TERMINATION OF LEASE. The


expiration of the term of this lease upon cancellation thereof as herein
provided, the LESSEE shall promptly surrender the premises to the
LESSOR, in as good and tenantable condition as when taken, ordinary
fair wear and tear expected, devoid of all occupants, furnitures, articles
and effects of any kind.
13. OWNERSHIP AND POSSESSION of all improvements built or
introduced by the LESSEE within the leased premises shall be for the
account of the LESSEE and shall remain with the LESSOR.
That the LESSEE agreed that upon renewal of the contract, the LESSEE will
renovate the building in their own expenses.
IN WITNESS WHEREOF, the parties have hereunto set their hands
at the place first above-written on this ________day of ___________2014.
