Rules in Determining One’s Domicile of Origin

a) Legitimate child – domicile of origin is that of his parents at the time of his birth; if
the parents are separated, the domicile of the custodial parent.
b) Illegitimate child – domicile of origin is that of the mother at the time of his birth.
c) Legitimated child – domicile of origin is the domicile of the father at the time of his
birth controls, since the effects of legitimation retroacts to the time of the child’s
birth (Art. 180, Family Code).
d) Adopted child – domicile of origin is the domicile of his real parents at the time of
his birth.
e) Foundling – domicile of origin is the country where it was found.
