M.Dakshina Murthy, Deputy Executive Engineer.

ORDER:

In the reference 1st read above, Government have issued orders

withholding one annual grade increment without cumulative effect against
Sri M.Dakshina Murthy, the then Assistant Executive Engineer, M.I. (W)
Section-II, Adoni, Kurnool District and presently Deputy Executive
Engineer, AVR HNSS Sub-Division No.1, Penukonda, in order to comply
with the directions of the Andhra Pradesh Administrative Tribunal,
Hyderabad dated 03.12.2012 in O.A.No.6903 of 2012.

2. Aggrieved by the above orders, Sri M.Dakshina Murthy, DEE has

filed O.A.No.6738 of 2013, before the Hon’ble Andhra Pradesh
Administrative Tribunal and in the reference 2nd read above, the Hon’ble
Tribunal in its orders dated 14.03.2017 in O.A.No.6738/2013 passed an
order i.e., “.....in view of the finding on the point, the impugned penalty of
withholding of one annual grade increment without cumulative effect
imposed to the applicant vide G.O.Rt.No.544, Irrigation & CAD (Ser.VI)
Department, dated 05.06.2013 is set aside and the O.A. is accordingly
allowed with all consequential benefits, without costs.

3. In pursuance of the orders of Andhra Pradesh Administrative

Tribunal, Hyderabad dated 14.03.2017 in O.A.No.6738/2013 and after
careful examination of the entire issue, it has been decided to cancel the
orders issued in G.O.Rt.No.544, Irrigation & CAD (Ser.VI) Department,
dated 05.06.2013, duly implementing the orders of Andhra Pradesh
Administrative Tribunal, Hyderabad in O.A.No.6738/2013 dated
14.03.2017 filed by Sri M.Dakshina Murthy, Deputy Executive Engineer.

4. Accordingly, Government hereby cancel the orders issued in

G.O.Rt.No.544, Irrigation & CAD (Ser.VI) Department, dated 05.06.2013,
keeping in view of the orders of the Andhra Pradesh Administrative
Tribunal, Hyderabad in O.A.No.6738/2013 dated 14.03.2017 filed by
Sri M.Dakshina Murthy, Deputy Executive Engineer.

Vijayawada, shall take further necessary action in the matter accordingly.
