COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Compromise Agreement, made and entered into by and between:

CHARISA ANN DABALOS RIVERA, of legal age, single, Filipino Citizen and a
resident of Sitio Valle Estrella, Kalunasan Cebu City hereinafter referred to
as the FIRST PARTY,
And

ANTONIO F. PIELAGO, of legal age married, Filipino and a resident of


Guinabasan Asturias Cebu, hereinafter referred to as the SECOND PARTY;

WITNESSETH THAT

WHEREAS, the FIRST PARTY, is the Complainant of a criminal case for


reckless imprudence resulting in physical injury against the SECOND PARTY
who stands as the accused pending before MTC – Branch5 Cebu City
docketed as Crim. Case No. M-CEB-18-05524-CR;

WHEREAS, during the scheduled preliminary conference, parties tried to


reach an amicable settlement so that this case can be dismissed wherein
the first party proposed a sum of money in an amount of P15, 000.000

After due deliberation of the of First party and Second party, both of them
reached an agreement wherein the Second Party agreed to pay the
aforesaid amount to avoid the hassle and rigors of litigation and in order to
have peace of mind without going into the merits of the case;

It was agreed by the First Party and the Second Party that the payment will
be under the following terms:
1. The Second Party will give initial payment of P3,00.00 personally to the
First Party during their next scheduled hearing which will be ON June 25,
2019.

2. The succeeding payments will be under the following dates;

July 8, 2019 – P2, 000.00


July 15, 2019 – P2, 000.00
July 22, 2019 – P2, 000.00
July 29,2019 – P2,000.00
August 9, 2019 - P4, 000.00

3. With the execution of this Agreement, the First Party hereby desists and
moved for the dismissal of this case.

4. In case of non-compliance on the terms and conditions set forth in this


Agreement, the aggrieved party may seek the assistance of this Honorable
Court for the issuance of Writ of Execution and/or for an appropriate
sanction to be imposed against the erring party.

5. Being not contrary to law, morals, good customs, public order and public
policy, both parties pray for the approval of this Compromise Agreement
and for the dismissal of the criminal aspect of this case.

IN WITNESS WHEREOF, parties hereto have read, fully understand


the merit of this Agreement and voluntarily agree to the above stipulations
and signed this Compromise Agreement with their own volition knowing
fully of its consequences.

BEFORE ME, A Notary Public for and in the City of Cebu personally
appeared the above-named principal and her attorney-in-fact, who have
satisfactorily proven to me their identities through their identification cards
and that the same person who executed and voluntarily signed the
foregoing Contract to Sell, which they acknowledged before me as their
free and voluntary act and deed.
