Dear NAME:

It has been approximately eight months since I spoke with you over the phone and
corresponded with you by mail requesting a Right of Entry Agreement which would allow the
Utah Abandoned Mine Reclamation Program (AMRP) to close a host of abandoned mine sites
located on your property. More recently, I have spoken with you on at least three separate
occasions in an effort to determine your position on the Right of Entry Agreement. Each time
you have stalled, assuring me that your decision on the matter would soon be made.

Given that the AMRP has made repeated attempts to persuade you to act on this matter
over a significant duration of time with little or no response on your part, I will assume that you
are not interested in providing permission to the AMRP to close your abandoned mine sites. I am
therefore forced to assume that it is your desire that these mine sites be left open.

Your failure to address this safety concern bears several important ramifications. The
open, unsafeguarded mine adits and shafts that you own represent a public safety hazard that you,
as the landowner, are personally liable for. The AMRP will have permission to close hundreds of
mine openings in the PROJECT NAME area with the exception of the mines located on your
property.

As a result, visitation by explorers and, more importantly, an unwary public will likely

increase. Your liability could be significant if there is an accident involving

someone exploring these mines or inadvertently falling into them.

Since the inception of the Utah AMRP in 1982, there have been 29 reported accidents and
5 deaths resulting from hazards associated with abandoned mines. Approximately one third of
these accidents and two of the deaths have occurred in the highly visited Oquirrh Mountains.
Despite the fact that Utah Code 76-6-206.1 makes trespassing in abandoned mines a criminal
offense, many of the accidents and most of the deaths in the state have resulted in lawsuits that
found in favor of the trespasser and against the landowner. Enclosed is a copy of the trespassing
law and a summary of the accidents and fatalities in Utah.

If you should change your mind about this matter and are willing to consent to the mine
closures, then I urge you to promtly call me at (801) 538-5318 and return a signed copy of the
Right of Entry Agreement to the AMRP as soon as possible. This letter will be filed in the
PROJECT NAME realty file as evidence of the AMRP’s many attempts to contact you for
permission to reclaim these hazards and as documentation of your non-responsiveness.
