 Scheduled for legal review today for RFP release
 This isn’t going to happen
o Baker can get the package for legal review April 1
 Issue date for RFP April 4
 Need real estate subject matter experts to provide input for change requests
 There are two property owners involved that will be impacted by the toll
plaza project happening in two years
o OBP is concerned they may complain that they don’t have access
due to the fence
o We need a good understanding of all the implications of the fence
and extension
 How will it work relative to the existing POE, relative to the
new POE and who it is going to impact
 We need this before we are going to be comfortable
approving a change request
 There are 7 residents south of the fence alignment
 We could potentially set them up in another
temporary situation since they’re mobile homes
anyway
 Estimated completion date for M-1 real estate certified is not correct in the
Sector Book
 Add 3 months – real estate doesn’t match up
o M-2A & M-2B (Eagle Pass)
 Occurring April 30
 Believe is April 18 in Smart book
 Real estate certified in Smart Book

 Still maintains time – condemnation

 Building a retaining wall into an embankment
o Need to stay in the cliff and not outside
o Need to confirm the retaining wall is okay from a real estate
perspective

 Appraisal came back saying we’d have to cut into people’s


property located on top of the embankment (they own the
slope)
 ~100 owners including commercial
o Need to submit a change request to move the
wall ~15 ft south of the river so it’s only on
city property
o Need real estate map showing the divide
between property owners on the cliff to the
city line
 2 issues
o Is OBP okay with this?
o The City of Eagle pass doesn’t know about this yet
 IBWC will say something if we move it more than 5-10 ft. into the flood
plain
o RGV
o Baker’s getting ready to move out with geotechnical work
o Clarification has been provided to Baker that nothing’s off the table but the priority is to
do O-1, O-2, O-3 first, then Cameron County, and then Hidalgo
o There are unknown ownerships in O-1 – O-3 so we can condemn those

 Full steam ahead but don’t proceed with real estate requisition until Mr.
Giddens meets with the Commissioner next week

 We should know if the Hidalgo deal goes through by this Friday
 If it does, we will only be responsible for real estate for access and
staging and will no longer be responsible for land acquisition
o There may be landowners that are considered an uneconomic
remnant and we’ll have to buy the land south
o May need to buy property for access
 This mileage is included in the total mileage
 If this isn’t complete by Dec. 2008, we’ll have to do contingency miles

 There’s an issue with the state of New Mexico not recognizing the Roosevelt
Reservation but we don’t think Mexico will fight us

o Concerned may take the same life of Columbus Cattle Company

o Review is finished and comments have been incorporated

 Package is complete but hasn’t been approved for Robert
Jansen’s signature
 Not aware of any problems
 Need to give the contractor notice to proceed because they’re just
waiting
o Getting close to completing I-1A and need to keep them busy

 Concerned the concrete factories aren’t able to support the necessary
supply since the area is so remote
o There are two options:
 Get batch plants set up – need a lot of money
 Preferred option is to drive in corrugated sheet piles

 “A” Road – middle access road for the project

 Need to go to condemnation to clear


 Implication was that the maps are wrong relative to the Roosevelt
Reservation
o ½ mile gap is not reflected on maps and that’s why we have to
acquire real estate in the first place
 IBWC map is wrong
o San Diego
o Concern from the Office of Council and contracting for A-1
 USACE Office of Council arguing based on their interpretation of FAR, to
maintain A-1 as an option and contract is unbiddable based off of EIS and
concerns that there are only two alternatives in draft
o Moved proposal due date to April 9th to come to conclusion
o (b) (6) is asking the Office of Council that if there is a waiver, how will that
change their option
o RFP points to EIS as design documents
o Final EIS isn’t going to change dramatically from the draft EIS
 Staging areas have been moved and access alignment tweaked
 Nothing substantial
 They realize this but because it’s an EIS, three IP’s in this area and concern is
that the contractors finals will come back with drastic changes which haven’t
mitigated risks
 But the burden is on the contractors correct?
o The difference is that it’s an EIS
 Even if we have the waiver we will still make changes in
the final EIS
 After today, conversations will have to occur at the senior
level in order to expedite this
 New programmatic risk of USACE contracting people
inserting delays in the process

 (b) (6) is focusing on how to package projects together and how the access
roads are being utilized

 Western Access Road
 Alternative A or Alternative B?
o De La Fuente change request?
o Need change request submitted
o Both alternatives need to be included in the EIS
 OBP prefers Alternative A

 Move ahead with access roads and staging areas but not real estate
acquisition until that occurs
o Can do survey and exploration if we have ROE’s
o Department of the Army hasn’t formally accepted Delegation of
Authority
 This has to occur to amend the Support Agreement
 (b) (6) putting together a policy with OFAM on
how the document will be filed and handled for
permanent record
o Will be finalized the week after next
o Need costs from the spreadsheet (b) (6)
owns on tracking tool
o Need input on change requests for real
estate
o Need a handle on the change request review

o Found glitches in the dates on Phase I projects
 Getting issues fixed so that when the baseline is published it’s reliable
 PM’s are doing sanity check and Ops Cell is doing sanity check on the

 Need solid understanding of rollout of segments
 What’s going to MATOC and what’s not
o Real estate database needs to be updated in TIPO
 Polygons aren’t on access roads
 Colors aren’t right for real estate
 Public roads should be differentiated from private
