NPA in Paquibato violates CARHRIHL

Improvised explosive device (IED) exploded resulting to ten casualties in


Sitio Guinobatan, Bgy. Paquibato Proper, Paquibato District, Davao City during
the encounter between 69th IB, Philippine Army and the NPA belonging to PBC 1
at 4:A.M today.

Joint public security operations of soldiers from 69th IB and PNP- SAF was
conducted in Sitio Guinobatan, Paquibato Proper in response to the complaints
of the civilians regarding the presence of the NPA who are extorting and
collecting food stuffs from one house to another in their communities.

A team led by 2LT Bryan Malinao deployed. As they reach the main
objective, the soldiers discovered an enemy camp but immediately the NPA fired
on their position. After which, 1 IED exploded which resulted casualties to the
government troops.

More than 30 NPA members were encountered by my team. The fire fight
lasted about 30 minutes after which, they withdrew to the different directions.

NPA shows their total disrespect to the Comprehensive Agreement on


Human Rights and International Humanitarian Law and disobedience of the
Philippine Landmines Bill just for the sake of their extortion activities.

Cpt Benjie Arciaga, the CMO officer of 69th IB condemned the use of the
Improvised Explosive Device which resulted in 8 wounded government personnel
and 2 killed in action. “The use of IED of the NPA is a manifestation of their
violation to two international warfare agreements namely, the 1997 Ottawa
Convention and the amended 1996 United Nations convention in Geneva that
banned the use of anti personnel explosive devices”. Cpt Arciaga said. “Prior to
the incident, our troops already discovered and recovered 3 anti personnel
explosive devices at Sitio Riverside, Paquibato”, he added.

The 8 IED victims were immediately transported to Panacan Station


Hospital for medical treatment. They were identified as 2lt Bryan Malinao, Cpl
Ayat, Pfc Villar,P02 Nabua, P01 Maralit, P01 Macapas, P01 Galicia, P01 Tang, ,
while Pfc Estacio who was transferred to Davao Medical Center who gave in to
his wounds and died at about 2:05 in the afternoon today. Cadaver of Cafgu
Paguilan was brought to St. Peter Funeral Home in Panabo.
Acting Commanding Officer of the 10th Civil Military Operations Battalion
and Spokesperson of the 10th Infantry Division Lt. Col. Joshua Santiago
condemned the said act of the rebels adding emphasis that the AFP-PNP-SAF
were just conducting public security operations to ensure the security of the
civilians.
