WHAT TO LOOK FOR ON RECORDED DOCUMENTS

I. NOTARY
A. What State is the notary in compared to where the signers live
1. Signer from California being notarized in Texas pursuant to A
Texas D.L.
(CA resident better not have a Texas D.L.)
2. Why would signer be in Texas.
B. Signer is Assistant Vice President of MERS and BANK?
1. Does the IRS and state revenue know signer works for both
2. Secretary and Treasurer of MERS, Hultman, states in and
affidavit there are 10,000
persons registered as V.P. of MERS, none of which are really V.P.s.
C. Signer’s signature are often obviously forged.

II. SUBSTITUTION OF TRUSTEE


A. Did other Trustee resign?
B. Only LENDER can assign Trustee pursuant to Deed of Trust
1. Often the first Trustee assigns the second

III. ORDER OF DOCUMENTS


A. Are all the documents recorded on the same date at the same time?
1. The order of filing must be followed.
a. Often the assignment is made before the Trustee is
changed

IV. STATE LAWS


A. Find your state laws concerning recording documents
1. Look under criminal statutes, public records, UCC, property, etc.
a. In Arizona there is ARS §§ 39-161, 13-2407, 13-1002, etc.

B. 1. Notary rules are covered under the Secretary of State

I am now sure that my original concept is the best so far due to Ryan's letter from
the Arizona SOS.
We MUST attack the documents filed into the county recorder's office with
everything we have. Study the documents and find all the errors.
a. Assignment before substitution of Trustee.
b. Trustee substituted by someone other than lender.
c. Notaries for people from another state.
d. People acting as MERS and BANK ass. vice Pres.
e. etc
I will try to get a list together

File complaints with the AG, SOS, Dept. of Financial institutions. The letter to
Ryan established that we are right about the documents and now the bank and
attorneys can be held liable. If we can get the notaries revoked and the
documents considered false then the bank loses the presumption they use
to screw us.
THIS IS THE MOST IMPORTANT ASPECT OF THE CASE, DO THIS OR YOU
WILL MOST LIKELY LOSE.

There is a lot more you can find when you study the recorded documents
compared to the Deed of Trust and the laws. But these are a good place to start.
All it takes is 1 violation and the document is toast.

Don't forget that MERS failed to record anything, which is a criminal act of
depriving the State/County of its lawful due revenue.
